NSSF Issues Statement on ‘Operation Choke Point’

NSSF today issued the following statement:

The National Shooting Sports Foundation has been investigating the possible role of the federal government in influencing banks in their lending and business banking relationship decisions regarding companies in our industry. We have heard from several industry members that they had banking relationships terminated by their lending institutions.

We respect the right of financial institutions to make business decisions based on objective criteria. It is unacceptable, however, to discriminate against businesses simply because they are engaged in the lawful commerce of firearms, an activity protected by the Second Amendment.

NSSF staff has met with members of the House Financial Services Committee and members of the Oversight and Government Reform Committee concerning several documents that have surfaced from the FDIC labeling companies in the firearms and ammunition industry as “high risk.”

As a result, we have worked with U.S. Rep. Blaine Luetkemeyer (R-MO) and expect that he will offer today an amendment to the FY15 Commerce, Justice, Science and Related Agencies Appropriations Bill, which would prevent federal funds from being used as part of “Operation Choke Point” or in any effort targeting companies involved in the lawful commerce in firearms.

We will continue to investigate the extent of any improper government involvement and will update our members as more information becomes available.

Glad to see there is something happening, however, with all of the violations of law and the lack of ethics of those in charge I will be surprised if anything other than lip service happens. Boil the frog slow…….

I think it’s a stretch to think this is some kind of attempt at gun control, but whatever. If you want off that list go to the most obvious missing industry of that list and ask them how they got off it. The liquor industry. biggrin.gif Edited by DaveTN

There have been quite a few folks in the adult film industry who have been having their banking institutions sever ties with them due to OCP. While some of the merchant categories are legitimately shady, it really does appear that undue influence is being placed on businesses in industries that, while perfectly legal, the government finds objectionable in one manner or another.

My organization, the Competitive Enterprise Institute, broke the story on this earlier this year.  As has been pointed out above, it is a multi pronged attempt to cut off and starve industries Elizabeth Warren, when she was the head of the Consumer FInancial Protection Bureau, deemed risky behavior  In other words consumers buying things she didn't, doesn't, think they should be involed in.

 

The DOJ is threatening / pressuring banks to cut off banking and access to credit to legal industries the administration has a problem with.  I am at present interested in knowing someone / business, who has been effected and who would like to sue the governmet for cause.  Holdler said Monday he is committed to seeing this operation though.  I hope to stop him in his tracks and we have a history of sucessfully doing just that.

And this is the real problem with our current form of government.  Qualified immunity and sovereign immunity...  that the law makers and government bureaucrats get to decide who has 'standing' to challenge their bad behavior in court, and even if they're problem wrong/guilty nothing happens to them...  they don't owe any money... they don't loose their jobs...  the don't spend time in jail.

 

We need a way for citizens to force the criminal prosecution of a government employee or politician, and completely remove virtually all qualified immunity from government employees.

 

The sad part is there is no "cost" for the current administration to behave badly, as any penalty or even just the court costs all are paid from the public trough. Thus they have tremendous incentive to behave badly
