Interstate Transportation of Firearms and Ammunition Bill Introduced

U.S. Rep. Morgan Griffith (R-Va.) recently introduced H.R. 131, a bill that would more comprehensively address the interstate transportation of firearms and ammunition for law-abiding gun owners.

H.R. 131 would ensure the law has the effect Congress intended when it passed more than 25 years ago. Specifically, the legislation would make clear that transportation of both firearms and ammunition is federally protected, as well as expand the protections afforded to travelers to include "staying in temporary lodging overnight, stopping for food, fuel, vehicle maintenance, an emergency, medical treatment, and any other activity incidental" to the trip. Additionally, the bill would place the burden of proof clearly on the state to show that the traveler failed to comply with the law.

I sure would like to be able to drive through anywhere in the country.

Obama isn't the problem. This is a "Shadow Bill" in that it simply reinstates a law already in effect. The only reason to do this is to present a bill that will allow the attachment of "riders" to pass other legislation. As this pertains to guns, the pro-gun faction (which includes me) would push the bill. The riders will be party specific provisions unrelated to this issue. (probably anti-ACA and/or tax cuts for "superwealthy" ) and bill will either die in committee or will be fought by other factions in Congress. I am not a Democrat but I don't really believe Obama would veto this bill if it were presented in the clean version shown here. Just watch how the bill changes as it goes through the legislative process. This law is already in effect so why would we need a new one? We gun owners are being used again.

We don't have safe passage through all states.

If done as FOPA describes, we do. I've not seen any of the "horror story stops" where the people were abiding by it.

It would be good I guess to more precisely exempt various stops in the journey, though.

I think that this is coming into light more because of the lady that was a legal permitted carrier and she made a wrong turn and ended up in New Jersey and she then was arrested and all of that other B.S. She even stated that she was not planning on even going into NJ but they still did it to her anyways. I would not feel comfortable carrying anywhere that is anti-gun. When I have to go to Illinois for family reasons I leave mine at my uncles house in Indiana and do not carry it past that state line.

This bill would do nothing to protect the lady who mistakenly turned into NJ.

Please see the end of Page 9 and beginning of Page 10 about vehicle carry in Illinois. Out of staters with a valid permit from their home state are permitted to keep one in their car. This came along with the carry permit law being passed in recent times.  :)

Yep, I can carry door to door from my property here to our business there now, much better but I would still love to eventually get the ability to actually apply for a friggin IL out of state permit.

Even if we could get one, I really don’t want to pay $300 for one. And if they can get a case in front of the Illinois Supreme Court; you may not need one. Illinois could go from the last to allow carry to the next Constitutional Carry State. I do a lot of my shooting there; I hope they get it straightened out.

Don't get me wrong, I'd love to not need one at all but it baffles me that I can't even apply as a nonresident from TN currently.

Tennessee doesn’t restrict gun ownership for an involuntary commitment to a mental institution; they require a court order. I think that is what stops Tennessee from being eligible; but I’m not sure.

New York, NJ, Mass, DC are about the only states you would have problems bringing a handgun to as a non resident.  NY, DC (non resident license available), and Mass (non resident license available) require a license just to possess a handgun.  NY and NJ seem to let non residents bring handguns there for matches.  A few other states you may not be able to carry on your person, but you can possess a handgun there as a non resident, such as California.  You just have to put your handgun in the trunk of your car or keep it in your hotel room in California.  I'd say that is pretty good.

That is why I love this forum. I did not even know that. Now when I make my trip up there this spring I will probably just do that. Thanks.
