Legal for Me to Carry on the Property of a Felon?

Recommended Posts

This may or may not be a stupid question, but I've done some browsing & haven't found a defined answer. My mother-in-law is living with her ex husband who's has multiple felonies & he is not allowed to own firearms (she's never been known for making good decisions about anything in her life...ever!). Is it legal for me to carry on their property or in their home? My wife & I both tend to keep our distance from them so we only visit her house a couple times a year, but don't want to break any laws when we are there. Thanks.

Do you have a HCP?  Then yes.  If you don't have an HCP, then no it's probably not legal outside your vehicle to have a loaded gun on their property.

You're in possession, not him.  Keep it on your person and don't let the dirtbag touch your gun.  I don't see how that can be illegal.

Good question, though.

Heck, there is no way I WOULDN'T carry around a multiple felon.

There are felons and felons - murderers and people who crossed the IRS.  Don't be so hasty.

I don't believe felons can live in a home where a firearm is stored, even if the owner is legal to own a firearm. My neices boyfriend was charged on a gun possession by living at his moms home, it was perfectly legal for her to own one but he wasn't supposed to reside in a house where a firearm was stored. His mom wasn't charged for anything but the drugs he had in his car, squeeled on by what he thought was his friend got the house searched where they discovered her gun. So the way it sounds, a non-felon will not be charged but the felon can be charged.

True. But apparently the guy has MULTIPLE felonies. I realize that I'm assuming, but it doesn't sound like he filed his 1040 improperly.

Edit: after rereading the OP, he gave no indication that they were violent crimes. So mea culpa. Maybe he is just a tax violator. Edited by Clod Stomper

I wasn't going to discuss it, but he's been arrested multiple times over the years for sexual assault & sexual battery & attempted rape. Like I said, my MIL isn't known for making good decisions. She sure knows how to pick 'em. This is why we almost never visit their house.

I dunno, sounds like he had just the attributes she was after, eh? ;)

G. Gordon Liddy used to joke all the time on his radio show that he didn't own any guns(convicted felon), but his wife owned a bunch. Wink wink. Nudge nudge.

I guess different states have different laws but I really believe that in Tennessee a felon can't live in a home if there's a gun INSIDE the home. I may be confused about what my neices boyfriend was charged with then.

I'd go re-read 39-17-1308 again, there are defenses for carrying on your property, residence and place of business... There are defenses for hunting and shooting sports...

But there are no defenses to carry on another's property for self defense, without a permit.

The crazy thing is, if you're 15 have your parents permission and the property owners, you can carry a loaded handgun for self defense, but can't as an adult.

You don't have to have a permit to carry on private property, so it would still be legal.

A guy I worked with and kinda a friend had some drug abuse problems, wrote some fake prescriptions and such but has a felony record, I even bought one of his guns from his dad to help him with money. I would never leave out a prescription if he was over my house, it would be like leaving a bottle of good whiskey out in front of an alcoholic but I would trust him not to steal any of my belongings. Now there's some felons like the one you are talking about I wouldn't want to even be near, real scum who hurts others without conscience. If he's capable of those crimes and rape, he's also capable of murder. I believe I would wear my gun to their house, I wouldn't trust that scumbag for nothing, at least you would be perfectly legal to do so.

Whether it was right or wrong I believe my uncle was instructed to remove firearms from his home when my cousin got out. Then again maybe he was just playing it safe as not to risk anything.
But the issue would have been times when say my uncle was away and possibly my cousin could be home. Then I suppose he would be in possession.

I carry on their property every time I go there.

On a side note I'm going to ask him if I can buy his Rem 700 .257 Bob. Seein' that he's strictly a bowhunter now.
