  2. I'm just decompressing after bushwhacking up and down hills in Beaman Park (Nashville) to find a hiker who had been lost for two days. Amazingly, he was found uninjured this morning, but there are some important safety lessons to be learned, especially for those of us who spend time hiking in the woods. He left his phone in the car, left the trail, and got lost. He was found by ATV riders searching their land that borders on Beaman Park. Beaman Park is big... about 2.5 miles wide and nearly 5 miles long in places, but there is still no excuse to get lost for two days. Here's my thoughts and advice. Please feel free to add to this list. Carry your phone. Turn it off if you must, but carry it! Let someone know where you're hiking. Share your location with someone. My phone's location is shared on my wife's phone so if I fall and I'm unconscious, she can see my location on her phone. Know how to tell direction by using the sun and the time of day... or the stars. Know the boundaries of your wilderness. Even if you're hopelessly lost in Beaman Park, heading north will bring you to Little Marrowbone Road in an hour or two. Follow the streams downhill. Streams eventually reach valleys and valleys mean houses. People who have no sense of direction, leave their phones in the car, and can't navigate shouldn't leave marked trails. Sorry to rant. I'm glad he's been found unhurt, but this was over a hundred volunteers and a thousand manhours of searching.

  3. You don't think law enforcement gives their fellow cops a pass on a lot of things? Of course blue backs blue. This has been documented over and over and over. In this case, she was allowed to meet with the head of the police union after the shooting who subsequently had the camera in the police cruiser turned off so she wouldn't be recorded. You think us peons would ever receive such treatment? Not a chance. That video is evidence that would have been used against us. "In a hearing that took place outside the jury's presence Tuesday, lead prosecutor Jason Hermus said Guyger was told not to say anything while the camera was on.   6. Unless things have changed in 26 years, Missouri requires intent. Manslaughter covered the rest: However, I seem to recall her stating that she intended to kill the person because she was in fear for her life. I didn't think about it in this context before, but during my HCP class the instructor pointed out a circumstance where you come home and find a burglar in your house you were entitled to the same measures as you would if you were already home when he/she entered your house. If you live in an apartment complex where everything looks the same, this case clearly establishes the need for you to make darn sure you're entering the correct apartment.

  8. Sometimes even finding a road doesn't help you find civilization. When you're following a road and the road is getting worse, go the opposite direction. If you come to a fork, take the better looking road. Good roads lead to people.

  23. I thought the same thing, until I reviewed the Texas penal code. Negligent homicide in Texas requires that the death be unintentional. She clearly and explicitly said on the stand that she intended to kill him. Her case does meet the penal code definition for murder (which I find surprisingly broad).

  24. You could try being more informed. There's a huge difference between what Dave posted about traffic tickets or misdemeanors and homicide. There's also a difference between corrupt cops protecting corrupt cops. The average cop doesn't do that, but go ahead and continue painting with such a broad brush.

  26. Of course, they do. We had discretion in misdemeanors and tickets. We didn’t have discretion in felonies, and we couldn’t even charge murder; only our States Attorney could do that. DA’s in this state make the decisions; not cops. The Nashville Metro DA charged a cop that was chasing a fleeing thug with a gun in his hand with murder. I don’t think the Metro DA and former Mayor can be accused of protecting cops or protecting innocent citizens that use deadly force. I violated Department policy in a shooting. A command Officer said that to which I replied “The policy is wrong.” Another Command Officer said “Don’t say another word until you talk to your attorney.” Should he have been fired for saying that? I’ve told people I knew not to make a statement. That’s something I wouldn’t have said to someone I didn’t know. Should I have been fired?

In any case, we have a saying that, “the evidence has to tell the story.” There’s a big difference between that and, “the evidence needs to support the story.” At the end of the day, this case’s evidence (and also the defense’s lack thereof) told a different story than the defense team would have had the jury believe.

You don't have to look any farther than former FL Trooper Donna Watts who was stalked and harassed because she pulled over a speeding off duty Miami officer. Seeing the way that cops talk about her and what she did, yeah, I didn't have to look to movies for how cops are.

  29. Motive =/= intent they aren’t the same thing. Intent makes a homicide a murder, but motive isn’t required to prove intent. It just makes proving intent easier. Hypothetical time. I’m walking down the street, calmly pull out my gun and shoot a total stranger in the head and kill them in front of witnesses. Then I say nothing about why or my state of mind. In nowhere is that not still murder. My motive is unprovable, but the intent to kill was easily provable by the deliberate nature of my actions. Her words doomed her for sure, but there’s plenty of case law that shows that the deliberation required in most murder statutes doesn’t require advance planning, but only a deliberate decision to kill that can be made on the spot.

  30. Talk about absurd. You watch too many movies. Law enforcement took the case to the prosecutor, the prosecutor charged her with homicide, and she was convicted. Where was the blue backing blue in this case?

  31. That is absolutely absurd. By your standard, burglars only need to say that they thought they were in their house and they at the very least earn your sympathy. I don't care that she is a cop. Its irrelevant to this story in my opinion. What I care about is that through her actions of ignorance and negligence, an innocent man no longer breathes. She earns no sympathy from me for illegally entering someone else's home and taking their life. Of course, the story at the time was that she was inebriated but the toxicology reports at trial dispute that. Whether we can trust that or not is up for debate, blue backs blue. But the prosecution also presented that she was pre-occupied sexting her partner as this all unfolded. So her sending naughty texts was more important than Botham Jean's life. That's simply unacceptable.

  32. And the jury agreed with you. She was found guilty of murder today. The defense actually tried to claim she could use the castle doctrine defense and the judge allowed it. That doesn't make any sense to me.   34. We've been dealing with these issues for years in knox county. many neighborhood pets been taken. There are rules about hunting within certain distances of homes, so that may limit your ability to shoot them. Of course you can shoot, shovel and STFU. Have you talked to TWRA? What part of the county do you live in? Coyote hunting his open year round with no limit. You can hunt at night but cannot use predator calls or center fire ammunition. So you can used a shotgun or 22mag if you can locate them

  36. I have to laugh when YouTube folks waste time explaining the weapon is clear or viewers get excited about trigger or muzzle control. It’s an inanimate object in a video…you are safe. Now when someone is making a video on quick drawing and they shoot themselves in the leg; that’s different; give them grief. But I must confess I laughed at that also. When someone is doing an intelligent gun video; I give them the benefit of the doubt that the weapon is clear. So I don’t get excited when they muzzle sweep me through the camera or start playing with the trigger.

  37. Even taking it a step further, they go so far as to point out in the video that he is not muzzle sweeping the other guy because they are on different planes. Like Chuck said, there is a reason for the finger placement.

  42. If you live in Franklin, Chip Cain has an office in the downtown area and does NFA trusts. He did mine for me a few years ago and it's gone through several Form 1s without an issue.

  44. I know they are scared of losing them. I will probably receive a bunch of flak for this comment, but as my wife has told me I don't know when to shut up sometimes. I was an NRA member for many years, but I kind of saw between the lines, all a member is to them is membership dues dollars and a contact to ask for more free money. Kind of the way I feel about politicians, for years the Dems and Repubs have been pointing fingers at the other saying it's their fault, basically batting the ball back forth like a game of badmitton. And we taxpayers are paying for them to "play". I feel the NRA has been doing the same thing to an extent. You know what they always say, follow the money. If there is a big pile of money, somebody is trying to figure out how to skim more than their fare share.
