From the above article: According to the VA Page on Opencarry.org VA has complete state preemtion of firearm laws. I was curious about the source of info on local regulations on vehicle carry. Hopefully this matter will be cleared up soon though and make it moot. -

Hmmmmmm...... I still think it needs to be changed, but if the legal eagles of VA and TN can get together...I think that even with present wording someone who lives in VA, has a VA permit and works in TN would be valid and hopefully therefore a TN permit be valid in TN. 39-17-1351®(3)©(ii) The provisions of this subdivision ®(3)© shall not apply if the state of residence of the person employed in Tennessee has entered into a handgun permit reciprocity agreement with this state pursuant to this subsection ®. 39-17-1351®(1) A facially valid handgun permit, firearms permit, weapons permit or license issued by another state shall be valid in this state according to its terms and shall be treated as if it is a handgun permit issued by this state; provided, however, the provisions of this subsection ® shall not be construed to authorize the holder of any out-of-state permit or license to carry, in this state, any firearm or weapon other than a handgun. 39-17-1351®(1) says all other state permits are good in TN, so that would seem to statisfy the provision of 39-17-1351®(3)©(ii), if they want it to at least. -

I think this all comes down to situations changing and the law not following suit. Since TN now recognizes any other states permit/license I don't think, in general, it enters into written reciprocity agreements anymore. Here is the relevant law to this whole situation. Seems to me 39-17-1351®(3)©(i) was for back before TN recognized all permits. It was a way to allow someone with an out of state permit to apply for a TN permit if they worked here, even if they lived in a state that TN didn't recognize at the time. Because 39-17-1351®(3)©(ii) says they did not have to apply for a TN permit is the had a permit for a state that TN had reciprocity (before TN recognized all permits) with. Now that TN recognizes all permit, without reciprocity, it would seem to me this part of the law needs to be removed. -

Reciprocity Update - Virginia Tennessee's Department of Safety is charged by law with the duty to publish a list of states that honor Tennessee's handgun carry permits. According to that list, Virginia honors Tennessee permits. http://www.tennessee.gov/safety/handgun/reciprocity.htm However, the Virginia State Police web site does not at this time list Tennessee as a state whose handgun permits are honored in Virigina. http://www.vsp.state.va.us/Firearms_Reciprocity.shtm TFA has contacted Virginia state police to seek clarification of the status of Tennessee permits. In the meantime, those intending to travel in Virginia may want to seek clarification of this change in the law. -

Sounds right to me razorback. Isn't AL still a "may" issue state as well? You'd think they would raise it up to the state level and make it "shall" issue. -

AFAIK in all the states that allow OC without a permit, anyone (residents and non-residents) can carry that way without a permit. You go by the laws of the state you are in at the time. Sort of like those with permits from TX, AR or other states that don't allow any type of OC can still OC when they are in TN with their permit. -

Well from that it sounds like the "offical" reciprocity may have been dropped. But as I said before, that is not requied for permits from one state to be valid in another. It sounds like the issue has more to do with TN law when it comes to working in TN a certain amount of hours and carrying a firearm. Not that TN residents can't carry in TN... or for that matter that a VA resident can't carry in TN. Just TN wants you to have to get a TN permit also if you work here. -

Apparently it can vary by county. From Handgunlaw.us list of off limits places for AL. So it would seem there is no "State Law" against it, but each Sheriff can place that restriction on there if they choose to. Not 100% sure how that would affect out of state permit holders in AL. -

Handgunlaw.us which is kept updated very well still shows VA honoring a TN permit. Remeber just because two states don't have Reciprocity doesn't mean that you can't carry there. TN has Reciprocity with only a few states, but now recognizes all state permits, so no need for a Reciprocity agreement. Of course just by looking at the VA page it doesn't list TN, so makes you wonder. If you have to go to VA, just remember you can OC in VA without a permit. -
They may not, if the somehow knew. Doubt the rider would tell them that though.

I guess you could look at it preventing gifting, but I take it more that it is trying to prevent you from buying one for someone that it would otherwise be unlawful for them to purchase. ....of course I guess that could be underage as well.

I believe that is TX, not TN Other than that OS provied some good links. The main ones to check are 39-17-1305 39-17-1306 39-17-1309 and 39-17-1310 39-17-1311 39-17-1359

I normally wear a a non-DOT helmet and have rode in a Tank Top or Sleeveless shirt....and on the rare occasion shorts. The way I see it, it is my skin grafts or funeral so no one else need worry about it.

Yes I know this.... I have ended up talking about two things. The blog in the OP and the Wal-Mart scenario, of which most of my reply that you quoted dealt with. My point on the blog in the OP is that had he not mentioned being armed or having a HCP even if the LEO ran the DL he may or may not have noticed the HCP status since it would not have been relevant to the traffic stop, but even if had seen it, since there had been no mention of weapons to that point he may have not worried about it. Or he could have come back and asked if he was armed, but maybe not. That is my point...at least he would have had a chance if he hadn't brought it up. On the Wal-Mart scenario I was saying the LEO may choose not to check the status of the HCP since the one presented was valid on it's face. Also that not ever LEO that is responding to a report of an armed citizen throws them up against the wall or holds them at gun point before asking if they have a HCP. Sorry for any confusion caused on my part. -

The officer could have reacted badly in this case as well, but didn't We have all heard of horror stories of interactions with LEO's, but they can just as easily approach you and ask if you have a HCP. In your scenario, the LEO may have even taken the HCP at face value and not ran it (also no reason to run the DL since not driving) and all would have been ok. But no way of knowing for sure. I agree it was good for him to find out.....but probably no way with a LEO involved would have been 100% good for him. -

Yes it would and did show up. Remember the LEO showed the guy the status on his computer. But a LEO may or may not check your DL before giving you a ticket or warning. But even if he did....and he saw HCP status cancelled, revoked or whatever, it still doesn't mean he would bring it up if you didn't. I'm not saying this guy for sure would have only got a ticket or warning had he not handed over his HCP with his DL, I'm just saying he would have had a better chance of not having his 1911 taken away had he not. -
