I agree that the way the law is written (39-17-1307) it is illegal to carry a loaded weapon in TN and that 39-17-1308 provides defenses to 39-17-1307, however it doesn't automatically mean you will be arrested. Have a HCP is a defense 39-17-1308(a)(2) Being on your own property is a defense 39-17-1308(a)(3) To my limited knowledge not many people are arrested for carrying in those locations or conditions and have to present defense to the judge that they had a HCP or where on their property.

I think they must get messed up as to whether they are talking about to/about new applications or renewals sometimes. As we all know they only have 90 days, by law, to issue a new permit, but there is no time limit on renewals. They are very much behind on renewals, but that shouldn't have any affect on the 90 days for new permits. If you renew at a DL station, it really doesn't matter how long it takes for the renewal permit to be issued, your legal to carry with your old permit and the reciept from the renweal application.

Well of course all the same off-limits places (HCP or not) would still apply, including 39-17-1311 and 39-17-1359.

I really can't say for sure. To me it does read as if you can carry while camping or any of the other activities mentioned in 39-17-1308(a)(4). But I don't know of anyone that has done it, been confronted be LE and then told it was ok.

Of course thankfully not all polling places are in shools or posted...... I see the sign has "T.C.A. 39-17-1359" but no other real wording from that statute. Of course since it was at a school no real need to post to prohibit weapons anyway...

As with a lot of Catholics it seems... I was raised Catholic and went to Mass regularly. As an adult I have not been that good at attending regularly. But I guess I will always consider myself Catholic.

Well just to update anyone that may have been wondering.... I have got moved into the new place.....took a week before I could even get the dial-up. But that is what I have for now....and it is KILLING ME!!! Thankfully I have high-speed at work, but of course I am limited on the websites I can browse. I did take my laptop to the library the other day and can log on there....but not the same as being at home. Till I know more about my future, just can't go with the satellite internet I don't think....have to pay $250+ up from and sign a 2 year contract. Even if I buy used equipment is still has to professionally installed which I'm not sure how much that would cost and you still have to do the 2 years. It's very possiable my living situation could change again after the first of the year and I don't want to be locked into anything like that.

From Handgunlaw.us RV/Car carry Florida 790.25 Lawful Ownership, Possession, and Use of Firearms and Other Weapons (5) POSSESSION IN PRIVATE CONVEYANCE.Notwithstanding subsection (2), it is lawful and is not a violation of s. 790.01 for a person 18 years of age or older to possess a concealed firearm or other weapon for selfdefense or other lawful purpose within the interior of a private conveyance, without a license, if the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use. Nothing herein contained prohibits the carrying of a legal firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. Nothing herein contained shall be construed to authorize the carrying of a concealed firearm or other weapon on the person. This subsection shall be liberally construed in favor of the lawful use, ownership, and possession of firearms and other weapons, including lawful selfdefense as provided in s. 776.012. 790.001 Definitions. As used in this chapter, except where the context otherwise requires: (17) "Securely encased" means in a glove compartment, whether or not locked; snapped in a holster; in a gun case, whether or not locked; in a zippered gun case; or in a closed box or container which requires a lid or cover to be opened for access. Georgia In plain view or in glove box or console Georgia Code 1611126 (d) This Code section shall not forbid any person who is not among those enumerated as ineligible for a license under Code Section 1611129 from transporting a loaded firearm in any private passenger motor vehicle in an open manner and fully exposed to view or in the glove compartment, console, or similar compartment of the vehicle; provided, however, that any person in possession of a valid permit issued pursuant to Code Section 1611129 may carry a handgun in any location in a motor vehicle.

I agree with your first statement. I feel each situation is unique as to when (if at all) you should notify an officer you have a HCP and you are armed. In no way would I bring up or show my HCP if for some reason I was unarmed at the time. But your last two statements are incorrect. As others have stated your HCP number and DL number are the same. As far as what is in the state's database they are the same thing. When an officer runs your DL it will come back with your Name, Address, etc.. and whether you have a HCP or not. There is simply a field called Gun Permit and it will have a Y or N. Of course it would be up to the dispatcher to tell the officer of the HCP status, most I know do whether requsted or not, but some may not. And to the OP, with a HCP carry however you want in whatever condition you want.

I have always taken that to mean like maintenance buildings etc.... that may not be directly related to "recreation" but are on the grounds of public recreational place. Also the way it is worded it seems a government could argue ANY place that is used for "recreation" is covered regardless of whether the place is called a park, civic center or playground. Just another reason I would like to see 39-17-1311 repealed in its entirety.

HCP;States reciprocity agreements
Fallguy replied to jeremiah's topic in Handgun Carry and Self Defense
+1 on Handgunlaw.us Also if you have permit and are in a state that recognizes TN's permit, I'm pretty sure you can have your weapon anywhere ine the car, including on your person. It would only be if you didn't have a permit you would need to know if and how certain states regulate carry in a vehicle. But that is also covered at Handgunlaw.us -
Sorry Dave, think I have misinterpreted your post before. Guess I was just used to the anti OC rant of most and took it that you meant it goes against common sense to OC. My apologies. I need to quit posting when I have other things on my mind.
