Nah...I knew too...and know the post he was using as a refrence. I was talking with a deputy friend of mine the other day...holding a twelve pack of beer even. He had no idea I was armed till we started talking about carry laws etc...and I told him. -
I see what your saying. It's really not a matter whether the HCP law is constitutional, but if § 26 of the constitution is racist, right? I do think the permit system is designed to limit those who can legally carry...I mean $115, come on. ...and as I've said many time, I don't think one should have to get a permit from the state. But I guess I've never thought the wording of § 26 or the carry permit laws were to target a single race. But sometimes I always view things in the best light.

It would seem on it's face the the HCP laws are constitutional (at least as far as the TN constitution) based on the very part of the TN constitution you posted. § 26. Weapons; right to bear arms That the citizens of this State have a right to keep and to bear arms for their common defense; but the Legislature shall have power, by law, to regulate the wearing of arms with a view to prevent crime. Not sure if the current wording is a "Jim Crow" law to use your words. Also the general opinion of most seems to be that SCOTUS in D.C. v Heller will rule firearm ownership as an individual right, but subject to "reasonable restrictions". Now whether permits are a "reasonable restriction" would require another court challenge. In my very unexpert opinion, I think permits would be ruled reasonable. (Although I don't personally agree with that)

I'm not sure someone killing a LEO that could/would take them to jail and people going to gun range looking to steal guns really compare to the average smash and grab robber at the 7-11 that probably doesn't want to deal with any armed resistance. But if someone doesn't want to OC...that is fine. ...and if they truly believe that everyone who does will be the first killed off....just sit back and watch darwin at work then. Otherwise it is personal choice to me.

Thankfully it's been a long time, but the last ticket I got the Trooper was VERY curtious....almost made me feel bad for putting him out...lol I would check, if you can take a class, take it. If not pay it and move on.

Ok...just to keep things confusing. I was the Hardin Co/Savannah DL station today getting my son his Learner's Permit, so I though I'd ask them about HCP renewal. The lady there told me "as of now" they do not require proof of citizenship or legal residency to renew a HCP. But the way she said it leads me to believe it could be coming in the future. Of course I don't know for sure, but I feel the person where R1100R went just got the requirements for DLs and HCPs mixed up, or the change is so new no all personnel know if it and I was told wrong. Either way it is much easier to bring proof and not need it than the other way around. Of course as long as you can renew by mail, I don't see how they could require proof doing that, but I wouldn't be surprised if when you get your renewal notification in the coming months it will say you must come in and show proof of citizenship or legal residency to renew.

See....this goes back to my thing about a standard looking, obnoxious sign. You shouldn't have to "look" for it or wonder if didn't see it. It should stick out at you. Might be a tough defense, but even the current law does say a posting is supposed to "prominent"

It's good to see by the poll that apparently most LEOs don't see the armed citizen as a threat in general anymore. This was not always the case back in the early days of the HCP program. I did notice on all three times where the HCP holder was disarmed the LEO also unloaded the weapon. I wonder if this was simply safe handling of the weapon or for some other reason. I also can't help but to wonder if he truly felt his, your or the publics safety was in danger though. But apparently these things are the exception and not the rule. -

You're right that there is no general "public gathering" law. The reason "public" has been mentioned is because of 39-17-1311 that says you can not carry in or on the grounds of any public park, playground, civic center or other building facility, area or property owned, used or operated by any municipal, county or state government, or instrumentality thereof, for recreational purposes.

Well it's not beyond the realm that employees don't know all the requirments etc... We had a guy on here not too long ago, that they wouldn't let him use Military ID as proof. Called Nashville and they said he could, printed of the states web page and went back....all was ok like nothing ever happened.
