  1. I tend not to aim at imaginary targets in my driveway and yard/driveway. But I live in town with close neighbors. But as I said, if LEOs showed up and I was armed or had ones close to me.... I would wait and follow their commands. Just because you are legal and standing in your driveway is not worth getting shot over to prove a point.
  2. When it comes to the requirement for signs...one issue has always been signs on state buildings and the cost to change them. That is why government buildings that were already posted were covered under 39-17-1359 when was first established and a leading reason as to why the circle and slash symbol is legal now. They want to be able to prevent carry at any state buildings that are already posted (by any means) without having to change the sign. (Remember state parks on park carry) because changing and/or posting new ones cost money...and that is something that state doesn't want to spend money on. So rather than just make the state capitol etc... off-limits by statute (not what I really want to see) they keep tweaking the sign law so that the postings already on state buildings are legal. But I agree in general, I'm not sure if trying to change 39-17-1359 is the best thing now. If any change was to be made, I think simply removing the part that makes it a criminal offense would be the best. That way it really wouldn't matter what a sign said, the size etc.....
  3. Just to be clear though...in practicality, there is a difference between placing allowing carry and those that just haven't posted against it. I figure there are several places that haven't posted against carry, but if asked would say they don't allow it or if you OCed you'd be asked to leave. Sort of like the difference between not guilty and innonecent...get to go home either way, but one feels a bit better....

  5. I know CA doesn't honor TN permits....I meant if the National Carry bill I spoke of was to ever pass, they would have to. AFAIK IL and WI are the only two states that don't issue permits period. Many other states (including most you listed) are "may issue" states, but they do still issue them or at least have a procedure in place to do so. Although according to OC without a permit in WI is legal according to their AG. But I think a few LE agencies have said they're not particularly impressed with that opinion.
  6. It sounds like this guy had a lot going against him already. I'd like to see the actual law. Does it actually say radio, or radio broadcast? The phone itself is not a radio, but it does/did allow you to listen to radio broadcast. Does simply possessing one is a crime or listening to it or using it for illegal purposes? Hard to believe it just being in your vehicle would be illegal, but it could be I guess. In TN it is illegal to listen to scanner for criminal purposes (39-13-608 like robbing a place and listening to patrols, running and listening to where they are setting up etc...) but in general it is not illegal to listen to it while in your car. I could be wrong...but if this was just Joe Blow not sure there would have been a big problem....it's just that this was an additional charge to lump on the guy...
  7. If I am in my driveway with my gun "in hand" I will probably be on the phone the police as well describing whatever situation has caused me to draw my weapon. If somehow they got their before I made such a call, since I usually pocket carry, I probably wouldn't put it back in my pocket, but lay it down and follow instructions. I would assume they received a MWG call. Because normally no one, neighbors or LEOs are going to see handgun and make a call or worry about it. If I was just carrying (OC or printed or something like that) and a neighbor called, since I wouldn't know what is going on, I would simply follow the officer's instructions. But I doubt I would lay down or throw down as it would be in my pocket or holstered. I have talked with LEOs on calls around my apartment complex and out and about while armed and thankfully haven't been shot yet. Not really sure why you would be just standing around in the driveway with your handgun?

  9. The last National Carry bill that was introduced didn't set any Federal Standards, it simply said that if a state issues a carry permit, they must honor another state's carry permit. You would still be subject to the carry laws of the state you were in, just as you are subject to the driving laws of the state you are in. So since CA issues permits (although rarely I take it) any other state's permit would be valid there. But since IL doesn't issue permits...still no carry there. That said...I'm not 100% sure it's a good idea. I would just rather see all 50 state's adopt VT/AK/AZ carry.
  10. As I am late to this thread and not going to read through 100+ post, I'm sure what I'm going to has been said, and argued for against...but here it goes. If you can legally own/posses a firearm, you should be able to carry it without any further government involvement. If you can not legally possess it, you are already violating the law by having it... no real need of an additional charge of not having a permit.

  12. To answer the OP questions.. No, carrying a firearm (even one unloaded) with the intent to go armed is illegal. It being unloaded is simply an enumerated defense, like having a HCP is, of it is a rifle possessed incident to hunting etc.... So until the determination can be made that is handgun is unloaded, that you have HCP, you've been hunting etc.... as far as the officer you are acting illegally. Yes, had the ammo been in his reach or close to the gun under TN law it is considered loaded and the defense of it being unloaded would no longer apply. No, you are not required in TN to notify an officer you are armed. As far as police jurisdiction. I believe in general city officers only have jurisdiction up to one mile beyond the city limits (6-54-301) unless they are in fresh pursuit of a subject. Not 100% sure about County Deputies outside of their county. As search of TN Atty General opinions can find ones where "if an officer has jurisdiction" is used, so that would seem to imply there are restrictions on jurisdiction. However I agree on the side of the road is probably not the place to argue that.

  16. Pretty much what I meant....lol Just didn't mention that pointing on or off the weapon would be bad...but yes, especially bad if still on the weapon.
  17. Got me thinking... Yeah just OCing when there is a non legal sign that says No Concealed weapons seems weird for someone so worried about the law they won't show their HCP to a guard.
  18. Wow....can't belive I've seen others who were in Wado. I made it to 3rd Dan in Wado-Ryu Karate-Do. My main instructor was Jean Coop-Zimmerman but also trained under Cecil T Patterson and others. David Deaton that DaddyO mentioned was one of the evaluators on my Black Belt exam. I have always been a fair sized boy, but used to wonder how big I might get if I quite working out....I have found out. :-( Keep thinking of starting back at times.   19. Dave beat me to posting the only law that I know of that deals with lasers. So as long as you don't point it at those you're not supposed to don't know of how/why it would be illegal.

  22. When I dispatched always found it funny when the one who called was the one arrested. Most of the time I could tell when it was going to happen and I'd be thinking to myself, I really don't think you want them to come...
