If your gun is inside your locked house and it stolen I would say you made a reasonable effort to keep it from being stolen. However if you purposely left it sitting on top of the mailbox, I would say it was reasonable to expect it to be stolen. Either way it was stolen and shouldn't have been, but in one of the scenarios you have made it a bit more easy to be stolen. Does that make you liable? Maybe not, but the CoA says a jury gets to decide that. Again, all that has been done at this point is to let it go to trial. I truly hope the owner isn't held responsible at all... -

I don't think I'd hold the owner at fault either. ...and as of know all the court of appeals has done is to let a jury decide it. The simply reversed a summary dismissal against the owner. -

As Mike said...the owner of the car is not facing and criminal liability, only civil. Also as he said the Court of Appeals is not saying the owner is liable, only that a jury should get the chance to determine if they are if so to what degree. It sounds that if the jury was picked from this group the owner probably wouldn't be found with any responsibitly...and that could happen in this case. Also even if the owner is found partially responsible, it may only be 2% or something like that. I have to admit, the car being stolen could reasonably be seen as a foreseeable act if you leave the keys in the ignition. How responsible that makes the owner will be be determined at trial. -

Police spokesman Yvette Walker says the older man was reportedly causing a disturbance Thursday afternoon at the restaurant on the city's east side, tried to hit the employee and the employee swung back. WJBK-TV reports police say the punch may have caused the elderly man to choke on his dentures. The man died at a hospital. Walker says an autopsy will determine cause of death. Police say the employee was being held Friday and information would be submitted to prosecutors for review. Burger King spokeswoman Denise Wilson said Friday that company officials were aware of the incident and the franchise owner was cooperating with police.

Overall I think it's usually pretty stupid to leave your keys in your car. However I really don't think your liable if someone steals you car. Just to be clear, this ruling is not saying you are responsible, it is simply allowing to case to go forward against the car owner. It is possible that no fault will be imposed in the final disposition. -

***PLEASE READ*** Ok...after even a bit more discussion this thread will be allowed to continue. However....Do not discuss, intentionally and knowingly breaking the law. I believe what the OP is looking for are situations where you have carried past what appeared to be non-properly posted signs and/or postings (proper or not) that you did not see and then were found out to be armed. Then what happened after that point. Please keep post on that subject. Thanks.... -
No, A Handgun Carry Permit is good for Handguns only, it does not cover any other weapon. It is illegal to carry a club in TN (39-17-1307) There is a defense to that, if you have had training for use of a club/baton.

Either form of notice used shall be of a size that is plainly visible to the average person entering the building, property, or portion of the building or property, posted Section ((3)© A building, property or a portion of a building or property, shall be considered properly posted in accordance with this section if one (1) or both of the following is displayed in prominent locations, including all entrances primarily used by persons entering the property, building, or portion of the property or building where weapon possession is prohibited: (i) The international circle and slash symbolizing the prohibition of the item within the circle; or (ii) The posting sign described in this subdivision ( (3). These changes were made in Section 3 of SB3012 which became effective June 4, 2010 as Public Chapter 1009

While I know this wasn't directed at me and I am not educated in this area, but it would seem fairly clear in the law the answer is no. 39-11-622(a)(1)( says you are immune from civil liability unless, "The force used by the person resulted in property damage to or the death or injury of an innocent bystander or other person against whom the force used was not justified." http://www.michie.com/tennessee

I think his point was you said no compromise, but then you admit you need your job, which probably isn't posted, is it? Well if your like most, you don't necessarily need the job you're at now, just a job. So if your truly 100% was not going to compromise you could try and find another job that allowed carry. Which I admit I wouldn't do and don't figure most others would as well. But if you you aren't going to do that, then you have compromised some, all be it minuscule. Others are just willing to compromise a bit more based on the situation. Some don't compromise to the point of breaking the law, but I am not recommending that nor condoning it. I'm pretty sure you each understand the other.....just arguing a bit of symantics...lol Anyway...didn't mean to jump in....just have to add my $.02 sometimes....

The law doesn't prevent them from suing. It just says if the shooting is ruled justified they can not collect anything and also that that must pay for your lawyer, lost time from work and any other expenses you incurred in defense of the suit. T.C.A. 39-11-622 (http://www.michie.com/tennessee) So I may be naive, but my only preparation has been to only shoot in what is a clearly justifiable situation. That being said, one definitely should be aware of the possible consequences (legal and civil) of using a firearm and if they are not prepared (whatever that means to them) to accept them, they should not own one. Am I 100% prepared/protected if I use a firearm...maybe not, But I know I am not ready to accept the possible consequences if I did not have one!

From reading it and the page on handgunlaw.us it seems he saying the can not impose a general ban, but can still prohibit carry in certain situations and places.

Well I don't think the baggage claim area is a "sterile" area of the airport. Even if you got it out, loaded it etc.... you're not going to get into any secure area with it.

Considering there is nothing on the outside of your luggage to indicate there is a firearm in it and therefore the baggage handlers will not know, my guess it would come out in the baggage claim area. But hopefully those that have done it will answer soon.

Do I think the alcohol laws need to be revamped....yes. Do I want to see it done so carry can be prohibited in certain ones....no. -
Hmmmm well I admit I haven't pulled my certificate out in a while and looked at it, got it nearly 20 years ago, but I think mine only says ASP expandable baton.
