  1. Well as was said, if they are posted with signs that conform to 39-17-1359 or at schools, then yes a polling place is off-limtis. However there is no laws that says polling places themselves are off-limits. None of the polling places I have been to around my county have been posted.... I guess it is different from county to county if they choose to post or not.
  2. The limo/RV vs Van and like was something that came up in the debate in Nashville. When they were looking at passing a bill to completely prevent Open Containers in a vehicle, they were going to make exceptions for limos and RVs and such, but then some argued that it was punishing the less fortunate that maybe couldn't afford a RV/Limo to go watch the game and only had a large van. However as I said before the reason the law is the way it is now in TN is because of money...... I mean if the state really wanted it 100% legal for passengers to drink they would remove the part that allows cities/counties to make their own ordnances/resolutions...
  3. LOL...not 100% sure I'd want them to on everything anyway... As someone said, if your in a state where open container is illegal period I might can see that as they are already breaking the law But reckon in TN how many cars LEOs pass or pass by them that they didn't even notice because the driver was sober and driving properly. I'm basing this as someone that has both driven someone around that was drinking and I wasn't and as someone that has been drinking in the passenger seat and the driver was not drinking.... Perhaps......and maybe I'm just as law abiding as others I guess.....:-\

  8. Well...not exactly.... You're right in that you can only be charged with a DUI for being under the influence (regardless of a .08 BAC...at that point it is simply presumed) not just for drinking while driving. However that is where the Open Container law comes into place......as the driver you can't have an open container regardless of being under the influence or even consuming...just so long as it is in your possession.
  9. How is that? Even without carry permits, it is illegal for a felon to be in possession of a handgun....don't really need the lack of him having a permit to make it easier to jail him. Otherwise you are saying he is the same as a simple otherwise law abiding citizen that happens not to have a permit.
  10. True, but there is supposed to be a right to keep and bear arms. One should not have to get permission from the state to exercise a right, the state should have to prove you unfit in some manner, not you prove you are.

  15. Well as was said a city or county can pass their own ordnance/resolution. The city I live in prohibits open containers anywhere in town period, not just in vehicles.

  21. Well it hasn't "changed" it's been like this since 1994 at least. 55-10-416. Open container law. (a) (1) No driver shall consume any alcoholic beverage or beer or possess an open container of alcoholic beverage or beer while operating a motor vehicle in this state. (2) For purposes of this section: (A) “Open container” means any container containing alcoholic beverages or beer, the contents of which are immediately capable of being consumed or the seal of which has been broken; ( An open container is in the possession of the driver when it is not in the possession of any passenger and is not located in a closed glove compartment, trunk or other nonpassenger area of the vehicle; and © A motor vehicle is in operation if its engine is operating, whether or not the motor vehicle is moving. ( (1) A violation of this section is a Class C misdemeanor, punishable by fine only. (2) For a violation of this section, a law enforcement officer shall issue a citation in lieu of continued custody, unless the offender refuses to sign and accept the citation, as provided in § 40-7-118 . © This section shall not be construed to prohibit any municipality, by ordinance, or any county, by resolution, from prohibiting the passengers in a motor vehicle from consuming or possessing an alcoholic beverage or beer in an open container during the operation of the vehicle by its driver, or be construed to limit the penalties authorized by law for violation of the ordinance or resolution.   22. Again....it's not the "rules" is that David has repeatedly said the classifieds is not the main purpose of the forum....that is is just side benefiet for the members. What I was/am slightly concerned about was somone that only has one post (or very few anyway) and that post is selling a firearm. If that is there only post then more and likely unless they are a friend of a member (if so why haven't they already joined) no on can really know much about that person. It was my understanding that (orginally at least) the classifieds was so that if you, I, DaveTN, Punisher84, JAB, strickj etc.....wanted to sell/buy something it could be done in a common, easy to find place. Not so just any joe-blow could come by and sell one. But as you said, the point is really moot on titan14's offer as he has limited it to those with 60 post and registered for 3 months. And Titan14...I'm sorry for my off-topic post in this thread.....
  23. Oh I agree....but I also don't think I'd want this offer to go to someone just wanting to use the classifieds. I hear ya..... But as I said in a post in the Ready Room (that only Benefactors can see:)) I paid my membership just to help pay for the website, not for any of the benefits that may come with it.
  24. Indeed they are...... What actually showed in the display was a 4-digit code 0001, 0002 etc.... each code coresponded to they type of plate. So unless you had a list of codes and what type of tag matched that code...you really didn't know which type of tag matched the code. I would just have to ask the officer the type of vehicle it was on and see if matched one of the results I got.
