My bad....I sort of misread "States are standing up to the Feds" The money thing is right...as I understand it at least. Whether open liquor in a car is good or not....that is a seperate matter. But either way I don't think it is a matter for the Federal Government.

IMO the money from a Benefactor membership benefites TGO and thereby everyone as a whole, more than actual membership benefits and individual. Although we have a Classifieds area it is not the main purpose of the site and those that pay just to post concern me a little. So IMO it might be better to simply donate the money straight to TGO (everyone) if you can't find any single member that it could help.

Actually now with so many "specialty" plates in TN even cars can have the same tag number, just for different type of tag. Once or twice when I dispatched and ran a tag it might come back with 2-3 results. All the same number, but one on a normal tag, one on Friends of the Smokie Mountains tag and the other on a Reading First tag.....or something like that anyway.

Yes....and No. From debate I watched on a bill last session, TN is actually still getting federal money, it just can't be used for certain things because passengers are still allowed to drink in motor vehicles. If we passed a law that prohibited that, then the federal money could be used for the other purpose. However that would mean one state agency that has been getting the federal money for the last few years would no longer be getting it and probably look to the state to make up the difference. So the legislature's real purpose about not changing the law you mention is money, not sticking it to the Feds......

I think you're think of a HCP. As far as a HCP goes, you can't have had two DUIs within 10 years and none of the convictions within the last 5 years. Also you can't have been hospitilzed for alcohol or controlled substance abuse within the last 10 years. T.C.A. 39-17-1351©(11) and 39-17-1351©(10) But as far as the purchase of a firearm, all Form 4473 ask is "Are you an unlawful user of, or addicted to, marijiuna or any depresent, stimulant, narcotic drug, or any other controlled substance?" Form 4473, Question 11e Nothing about DUIs (at least not directly) on the purchasing of a firearm.

Over half of all denials are reversed on appeal, but not all denials are appealed...so makes me really wonder how many would be reversed. I think most of the time the problem is there isn't a final disposistion to a charge. That being said, not sure why a single DUI from so long ago would be a holdup on a firearms purchase in the first place.....

Well what really needs to happen is major reform of the BATFE if not their elimination. At least start with doing away with the idea that interstate commerce clause allows them to control a firearm from cradel to grave. I mean they have had so much control for so long that now they think they are allowed to control any firearm...even those that have not travelled in interstate commerce. But anyway.... -

As I read the law in the past, it says those with a state issued carry permit are exempt from the 1000ft rule. So the only places that I can this applying are those that can/do carry without a permit in those states it is allowed. Now TN says it honors out of state permits "as if issued by" TN so whether that means a TX permit is like a TN permit when it comes to the school zone, I'm not sure? But I'm also not sure if it being an out of state license makes a difference. In the two cases cited in the other post (United States v Tait) and United States v Nieves-Castaño, neither are directly on topic about out of state permits. In fact, in the first one the charges were dismissed and uphelp as dismissed, because he had a state permit. In the second since it was in Pureto Rico...not really sure about the laws down there, but they appealed the conviction based on "void for vaguness" of the law not whether it was actually legal for her to have the weapon. I did not read the other cases, and there may be something more to this that needs to be checked, but by no means do I think it means the reciprocity is banned by Federal Law....seems to be an attention grabbing and misleading title ....at least to me. -

Pretty much the way I was told. Not that I ever put my handgun in the glovebox, but this is one reason I know keep my registration and insurance card above my sunvisor instead of in the glovebox....less range of motion to get to them. I agree....and in TN no biggie, but in Must Notify states may want to verbalize that you are armed......after saying you have a permit of course. -
I have one....not sure what it weighs exactly...but would say it feels "sturdy", at least for what it is, but it's not what I would call heavy by any means.

You might look at one of these In Car Gun Safe It meets the TSA requirments for checking a firearm in your luggage and it can be used in your car or motel room, by securing the cable around a fixed object.

I don't know of any agency that prohibits off-duty carry (just saying they could). I have seen post by LEOs on here saying that how and what they could carry of duty was controlled by their chief/sheriff and that was why they got a HCP. The law you talk of says that "written directives" of the CLEO supersede the state law, it is only intended to remove any statutory limits, not restrict their CLEO. 39-17-1350. Law enforcement officers permitted to carry firearms — Exceptions — Restrictions — Identification card for corrections officers. (a) Notwithstanding any provision of law to the contrary, any law enforcement officer may carry firearms at all times and in all places within Tennessee, on-duty or off-duty, regardless of the officer's regular duty hours or assignments, except as provided by subsection ©, federal law, lawful orders of court or the written directives of the executive supervisor of the employing agency.

Also the CLEO of the agency you work for can regulate (even prohibit) off-duty carry if being a LEO is the only authority you carry under.

I know Henderson and Madison have county Fire Departments. I believe Gibson does as well. While Decatur doesn't have a "county" department there are 8 volunteer FDs spread out in the county the provide protection. Instead of a fee they charge if they respond. -

Losing your job is one thing going to jail is another, or at least being held personally liable for wrong doing....no "qualified immunity" like there is for LE. But these Fire Fighters did not "work" for the county of Obion anyway, they "worked" for the City of South Fulton. Does anyone if the SFFD is a full-time paid department anyway...or is it just volunteers using city owned equipment. I do work for a full-time paid department....but I can't take the equipment anywhere I choose and do with it what I want, no matter how noble my intentions may be. -

Yep...although not called "Fire Insurance" this is basically what a subscription fee is in these cases. No telling the money I could save if I didn't have to pay my health insurance premium until I got sick, or my car insurance premium until I had an accident. -

The only mistake here was the guy not paying for his only source of Fire Protection. The only one that has anything to answer for is him. The citizens of the area where this guy lives (county) have nothing to decided when it comes to who runs the city Fire Department. If the citizens of that area are truly concerned about fire protection they can save their $75 and buy their own Fire Truck as several volunteer FD's have done in my area and start their own department. I have to say I'm a bit surprised at this thread as well.....so many want to defend or at least excuse someone who made their own poor decision and blame those that were willing to offer a service they didn't have to. I agree with what someone else posted....South Fulton may very well decided to stop the fee program and just keep their trucks home after all of this. Then the people of that area will be without period, whethere they are willing to pay and/or remember to pay or not. I'm sure as individuals they wanted to respond. I work for a DoD contractor, The Fire Trucks we have are owned by the Army, the Ambulances are part of the GSA fleet. If there was a fire or accident somewhere involving someone I knew....I couldn't just go get the Truck or Ambulance because it may be the right thing to do. That equipment is not mine. The equipment at the neighbor's didn't belong to firemen (unlike some Vol Dept) it didn't even belong to the citizens of Obion County (that this guy is one of) it belonged to the City of South Fulton. Now I know there are Emergency Personal that would respond to a call 100 miles from home if they could, but that just isn't the way things are normally.
