Handgun Permits - As introduced, makes information contained in handgun carry permit applications and renewals, information provided to agencies to investigate applicant, and records maintained relative to the permit application confidential and creates Class E felony of unauthorized publication of permit information or records. - Amends TCA Title 39, Chapter 17, Part 13.

WITHDRAWN! Today.

Anyone have any more info on this?

Rep. Bass was at the TFA meeting tonight. He was pulling HR0053 due to a higher financial note. By making the penalty a class A misdemeanor instead of a class E felony reduces the financial cost and increases the probability of passing.

IMO, if it takes a lesser penalty to get it passed, so be it.

SUMMARY OF BILL:

Creates a new Class E felony for a person to knowingly publish in any form information or records relating to handgun carry permits, renewal applications or any material required for a permit.

ESTIMATED FISCAL IMPACT:

Increase State Expenditures - $13,000/Incarceration*

Assumptions:

• According to the Department of Correction (DOC), the average time

served for a Class E felony is 1.80 years.

• According to the U.S. Census Bureau, population growth in Tennessee

has been 1.12 percent per year for the past 10 years, yielding a

projected compound population growth of 11.78 percent over the next

10 years. No significant incarceration cost increase will occur due to

population growth in this period.

• Since this bill creates a new offense, no recidivism discount has been

included.

• One Class E felony every three years with 1.80 years time served

(657.45 days). The annualized time served per conviction is 216.95 days

(0.33 annual number of convictions x 657.45 days served). According to

DOC, the average operating cost per inmate per day for calendar year

2009 is $59.80. The annualized cost per conviction is $12,973.61

($59.80 x 216.95 days).

• A small increase in cases in the court system, which will result in

additional state and local government expenditures for processing the

cases and additional state and local government revenue from fees,

taxes and costs collected. These expenditures and revenue are

estimated to be not significant.

*Tennessee Code Annotated, Section 9-4-210, requires that:

For any law enacted after July 1, 1986, which results in a net increase in periods of imprisonment in state facilities, there shall be appropriated from recurring revenues the estimated operating cost of such law. The amount appropriated from recurring revenues shall be based upon the highest cost of the next 10 years.

HB0221/SB0172 has a fine only as punishment. So therefor it's Fiscal Note (see here) says there is not a significant impact.
