Bar Owner Indicted For Killing BLM Protestor Due In Part To Things He Had Said Before On The Internet

This case is worth watching as it hits on some things that not many involved in firearms social media are likely to be innocent of themselves.

Jake Gardner, a white bar owner in Nebraska, has been indicted by an Omaha, NE grand jury for killing James Scurlock, a young black man during a BLM protest in June of 2020.  The grand jury determined on Tuesday that Jake Gardner, 38, will face four charges including manslaughter, attempted first-degree assault, use of a firearm, and terror threats.

Part of the justification from the grand jury came from things that Gardner had posted on his own Facebook wall prior to ever coming into contact with the victim.

 

"There was evidence that was gathered and presented to the grand jury about activity that Jake Gardner was engaged in prior to even coming in contact with James Scurlock," said Special Prosecutor Frederick Franklin.

"Evidence to reasonably be construed as an intent to use a firearm for purposes of killing someone," he continued. "You will want to know what it is, and I can't tell you about it. But what I can tell you is that that evidence comes primarily from Jake Gardner himself."

 

Reportedly Gardner had shared on social media FBI statistics and a screenshot of the President saying “When the looting starts, the shooting starts”.  Again, this before he ever encountered Scurlock.

"Police in Oregon released the following information: "At about 12:20 p.m., Hillsboro Police Department officers responded to the 300 block of Southeast Ninth Avenue after a body was found outside a medical clinic. They discovered 38-year-old Jacob Gardner of Omaha, Nebraska, dead."" 

"Jake was worried he was going to get shot on the way here [Omaha, NE], that some of those folks would gave him death threats...would carry through with them," Monaghan said.

"Dornan [Gardner's Attorney] added he advised Gardner to leave Omaha after Douglas County Attorney Don Kleine initially announced no charges would be filed. Gardner allegedly received numerous death threats and fled to Northern California."

"Attorneys said Gardner planned to return from around the area of Portland on Sunday evening, where he was visiting his father. Dornman said he had a good talk with Gardner and encouraged him they had a good case."

"His attorneys said Gardner died by suicide late Sunday morning and did not leave a note. Hillsboro, OR police say Gardner's body was found outside of a medical clinic."

"Gardner shot himself after authorities in Hillsboro, Oregon, received a call of a suicidal party, said two law enforcement sources who spoke on condition of anonymity. The death happened this weekend, though Hillsboro police would not confirm the death or the time it happened."
