HB 2509 Passage

I read that last week the legislature passed HB 2509 and sent it to the Governor's office today.  The bill would eliminate 39-17-1302(a)(4), removing short barreled rifles and shotguns from the list of prohibited weapons.

Since they will still remain under NFA restrictions, what exactly is the purpose of this bill?  They killed all those other worthy pro-gun bills but spent the time and effort to pass something that will have zero practical impact.  I don't get it.

If a TN cop see you with one, they are not supposed to enforce the federal law or report you to the atf. If the atf catches you, TN will not assist I any way.

Essentially we would be in a situation similar to California with illegal immigration and Colorado with marijuana. In that the state and local authorities cannot arrest you for those crimes and only a federal LEO could. Essentially, assuming my understanding is correct, you could have a SBR and be totally fine so long as an ATF/FBI/DOJ/ABC... agent doesn't show up to your home and arrest you for breaking federal laws. However, before doing anything I would consult an attorney and maybe your local rep.

So I finally connected with my state rep (my fault not his) and he stated that this was not like the Texas Suppressor bill. Rather this is more like the abortion bills states have passed that don't really do anything until the federal law changes. In this case, the NFA would have to be amended or eliminated and then this law would make SBRs legal to own in TN.

Thanks for the clarification. I can understand the reasoning behind that, though it seems extremely unlikely that it will ever go into effect. On the other hand, I never thought Roe v Wade would be overturned to activate the TN abortion law, so you never know.

From what I’ve read, even though it would be legal in TN. If the ATF or FBI wants to get involved it would still be a felony.🤬
