TICS Denial

Hey there,

 

Recently escaped California and moved to TN. Went to the Glock Store to purchase a Glock 19 and was denied. Called TBI and no information was given as to why. I have purchased many guns while a CA resident and never had any issues. Finally got some information out of them and the denial is based on a juvenile arrest I had in 2004 at age 15. TBI said they need the disposition of that case to clear up the issue. Well my juvenile record was sealed and destroyed according to the courts on CA and the arresting agency has no disposition other than the case was referred to the juvenile probation agency of that county. I’m back in CA for some other stuff and was able to go to the department to get a copy of their records regarding the case and the juvenile clerk is writing a letter saying that my juvenile record was sealed and destroyed. Any tips to help clear this up?

You just might need a lawyer. With the new background check system where they’re looking into juvenile records because of the recent shootings, you might not be able to handle this by yourself.

I just picked up a signed letter from the county clerk where I was arrested as a juvenile saying my juvenile record has been sealed and destroyed. TBI is saying that is not enough because there is no disposition of the case. This is getting frustrated considering we moved to Tennessee in search of freedom.

If I were in your position and had the werewithal to do so I'd lawyer up and maybe reach out to GOA and FPC; from a strictly not-legal-advice-giving internet person's perspective it sure seems like your rights are being infringed and you are being caused harm.

I had something similar happen to me when I moved to TN and applied for my HCP. An old arrest/conviction in California, charges and case were dismissed. I had already purchsed several firearms over the recent years and held a valid, current Illinois Concealed Carry Permit and we all know how difficult it is to get one of those. However, TN still required a disposition of the Cali case. Like you, the record of the case had been destroyed. I, however, had a copy of the adjudication of dismissal (thank goodness) and sent it to Nashville. Still, it didn't satisfy their requirements.

I ended up hiring an attorney in California (in the county that handled the case) for $500 and got the record expunged. Only then did TBI approve my application.
