Mark@sea. Sad to say my experiences in the "construction market" are different than your friend's. Illegals are used in this "market" heavily, as they are cheaper. Apparently, you have not been on a job site of late.

Here is an experience I had on a job site 2 years ago. Rumor pops up there are INS agents on site. Within, say 10 -30 seconds, 90% of the workers, for lack of a better term, melted away. Poof. Gone. Of course there were no agents on the site and 30 minutes later, all were back, joking about it... Anecdotal evidence? Perhaps. But hey, just my experience.

I guess you don't travel much. Or have the dubious pleasure of staying in hotels for business. Most every hotel I have stayed at had to be under $55 a night. Again any HR person will tell you, the "easiest" way to cut cost is to cut labor costs. Most of these hotels used immigrant workers to clean. I personally did not ask each to see their green (actually hot pink) card. Were they illegals? Probably, but I didnt ask, so I can say I didn't actually know. But, hey, most all were of a certain cultural background and did not speak English. But hey, just my experience.

Those "day laborers" you write about? Seems a ton of them are used in construction, from building, to repair. The way it is done is simple: The Contractor contracts the work out. The work is then contracted out more, down to the point where the original Contractor can claim total ignorance of the legality of the "day laborers" working on the site. That is how the game is played.

Thankfully, I am not in that business, but I know a lot of people in the business, from the "big guys" who build huge office buildings, to the little guys who wall board. So far, your one friend's view does not add up to my friends. Oh, and your one friend's view is the definition of Anecdotal.

Claiming someone does not have background knowledge to speak on a topic is a personal attack. So, check how your write things. If that was not your intent, well, good. As for your little attempt at humor- well, I know you feel better.

Again, this guy is STANDARD for CALIFORNIAN politicians. He will keep his office and will be re-elected, if he chooses to run. Odd state out there.

They will stop at NOTHING to get their way. By demeaning the person asking the question., pete just reaffirmed he is superior. He couldn't answer the question with any truth, so he does what any elitist politician does, demean his opponent. These are the people that are the greatest danger to the Republic. ...

I fully agree. The good news is that Stark is 78 years old. We can only hope that God in His Greatness calls this socialist trash home soon to be with his buddies Byrd and Kennedy. That being said; there is little chance of unseating him because of his constituency. Hi there. I'll give you three guesses as to what I do for a living. You're wrong. At the very least misinformed. As the general contractor of a jobsite, it doesn't matter whether or not the subcontractor is the one who hired an illegal or not. Due to the lawsuits, the majority of construction companies (those who want to stay in business) regularly screen subcontractors and require documentation of their workers. If documentation is found to be false, the company then can go after the illegal aliens. In school work, background checks are required of ALL workers who will be working on the project. Construction company owners were behind getting that legislation passed. If you saw someone violating the law, HvyMtl, you should have made use of your cellphone or one at the nearest gas station and made a difference. We all lose if no one turns in those fly by night companies that break the law.

New Tennessee Law on Employment of Illegal Aliens

On January 1, 2008, a new Tennessee law took effect, Public Chapter No. 529 (click HERE to download PDF). This law amended Tenn. Code Ann. § 50-1-103, and effectively threatens business license revocation for Tennessee employers that "knowingly" employ an illegal alien (even a single alien).

How does an employer "knowingly" employ an illegal alien? Either with actual knowledge that an employee is not authorized to work in the United States, or by failing to fully adhere to federal employment verification procedures (such as by failing to fill out Form I-9 correctly, failing to examine an individual's identity and work authorization documents, or failing to re-verify an employee whose employment authorization documents expired during employment). Even an employer's recklessness or negligence in this area might be found to satisfy the "knowingly" standard.

If a report is made of an employer's possible employment of an illegal alien to the Tennessee Department of Labor, the agency will investigate the matter. If there is substantial evidence that the employer did knowingly employ an illegal alien, a contested hearing will be held before the agency and, if there is clear and convincing evidence that the employer did knowingly employ an illegal alien, its license to do business in Tennessee can be revoked until the employer shows that it is no longer in violation (i.e., it has fired any illegal aliens in its employment). For a second offense, an employer's business license will be revoked for a full year. No rights of appeal are included in the new law.

This law is very Draconian. Although prior bills in the Tennessee legislature would probably have been preempted by the federal immigration laws, the new law appears to have corrected most if not all of the deficiencies leading to federal preemption in the prior bills. Until a legal challenge is mounted on the new law, it is only safe to assume that this law will be upheld.

The new law does not require employers to use the federal database for verification (E-Verify). However, it does provide a safe harbor for employers that use the E-Verify system and hire individuals who are shown as eligible for employment through that system. Therefore, it may be advisable for Tennessee employers to utilize the E-Verify system. Also, if an alien produced fake but proper-appearing documentation as part of the I-9 process, the employer will likely not be found in violation. As noted in a prior Web Alert (Click HERE for prior web alert), a new I-9 Form is now in effect.

What should employers do to avoid losing their Tennessee business license by employing illegal aliens? In addition to using the E-Verify system, it is probably a good idea for whatever individuals at a company are involved with I-9 documentation to receive refresher training on I-9 compliance. It might also be prudent to have an outside firm conduct an audit of an employer's I-9 compliance, prior to an audit by the federal government or investigation by the Tennessee Department of Labor.

This law is in effect for any company that is licensed to operate in the state of TN.

Never heard Byrd or Kennedy talk down to anyone the way this ass does. Then again you couldn't understand what they said all the time. Maybe its a CA thing, Nancy, Waxman, Boxer. Something they smoke maybe. :(

Green cards haven't been hot pink for over 10 years now. My wife has hers, was issued in 2000, and it is a cream color. The new ones issued in May of this year are less creamy than white with lots of digital printing. So, you're info is bad at several levels...
