How to serve someone with a subpoena?

My stepson's father is one and a half years behind on his child support, and my wife has been to court twice in the last 4 months only to find out he was never served. We live in Sumner county and he lives in Rutherford county. Is there another way to get him served besides the Sheriff Dept? Any help would be appreciated. Thanks

Agreed, there are those who serve papers, they do not have any requirements or courses necessary for them to do so. Many Courier services do it.

For better impact, less expense, and a governmental official stating "yeah, he was served," the Sheriff's office is best. Call their non-emergency line and ask them if they do the service, and how long it takes for them to do so.

Is it being considered civil papers or an actual subpoena? Sumner County would probably have to contact Rutherford and send a copy to be served. When it's served they return it back to original agency. They don't have to do this and Rutherford County may opt not to do it.

contact the courthouse and ask for their list of private process servers. you can hire one for a fee. or you can have the sheriff do it, or the court can assign a process server.

Thank you for all the help and advice, now my wife and I have a direction to go in as soon as a new court date is set. The last court was this past wed.

If you want it done right, get a private process server. Those guys are ruthless and relentless.

Does your wife not have an attorney?

Does Sumner County not have a child support enforcement division? If he has any money to recover, has a driver’s license, or holds any professional licenses; those people are usually on it like a fat kid on cake.

No she does not, we do not have money to get one.

Sumner county has a child support division but I don't know about a enforcement division. We had to contact our State Representative just to get the child support office to do their job. The case worker assigned to my wife does not do her job very well.

I do not know if he has any money or not, he likes to wine dine women and worry about bills later.

His Drivers License was suspended, supposedly because he got a ticket for no insurance and never took care of it, at least that is what he told his son.

Child Support and Enforcement are typically the same, however, if they're not doing anything, you can make an appointment to go talk to the District Attorney. An ex-gf of mine who lives in Columbia, did that and her ex-husband got 45 days in jail the first, time, 60 days the 2nd time, and then 6 months the third time and they revoked his driver's license.

If the case worker is not doing his/her job, document the times you contact her and what is discussed, and record the call if necessary, and then file a complaint against her with the supervisor. If the supervisor doesn't address, escalate it to her supervisor, and keep going up till you get results.

If he's driving on a suspended, there's a way to take care of that. Sit down the street from somewhere you know he's gonna be at, when you see him, give a friendly anonymous call to your local police department with name, license plate number, description of the vehicle and what he looks like, and they'll be glad to escort him to the city motel for an overnight stay, and 3 square meals a day at the taxpayers expense.

Wow. Interesting stories here and I have to add mine. My step-daughter is in her 2nd year at college. Her dad is around $15,000 behind in child support. The CS office told us they have a ...hmm, bond? issued against him for that amount. Can't remember exactly what it was called. But he has spent time in jail, only works for cash, and even when he gets his IRS returns the state doesn't send us that money, he gets it. I can't tell you how much that money would come in handy right now; I could be back to debt free except the house and still have enough money left over to fill our emergency fund. I pray you have better success at your efforts, ZZRguy.

We went to the child support office and found out that the child support office had assigned my wife another case worker. The new case worker is going to send another subpoena with an attachment that he be arrested to Rutherford county.

His ex-wife took him to court last week and the judge told he had to find a job and start paying child support by the next court date (Nov. 17), or he will be put in jail with a $7,000 bond.

all you got to do is hand him the paper tell him he is served .then when he dont show up in court the server tells the judge he was served then they issue a bench warrent for him.now do you know where he works just have someone meet him at his car serve him if you cant find anybody call me i will go david 615-497-4205

Thanks but he does not have a job. The case worker said I would have to have the original copy of the subpoena and she was not helpful in helping me get a copy of it.

Any boy can get somebody pregnant, it takes a real man to be a father. Sounds like his proper title is sperm donor.
