Gentlemen. I work for Chesterfield PD. I've been involved in the case, so there's little I can give in the way of specifics. What I can say is don't jump to conclusions. There is a reason he was put in a mental hospital, and then court ordered to be evaluated for 30 more days. This guy is crazy. His family is crazy. Brandon is NOT the Libertarian poster child you've been looking for. He is not a hero to be put on the pedastal of martyrdom. He's just a crazy guy that made some very explicit threats against some people and organizations. I'm sorry I can't get specific, but trust me, everything was done to procedure, the arrrest was good and for good reason.

That guy better hope what he is saying is in fact true because if it's not, there might be a slander/libel claim against him and possibly defamation.

anyone can hide behind a username and claim to work for the Chesterfield PD, and say they can't give specifics but that doesn't make it so. If this gentleman did in fact work for Chesterfield PD, he'd know not to say anything at all, so if he is working for the PD and talking about an investigation, regardless of how much or how little specifics he's giving, he could already be violating public/privacy records laws and potentially ruining an investigation, he's already obviously speaking out of line when it's not his place to do so in the firts place. If the guy is in custody, then there really shouldn't be a need to be hush hush. Until i see FACTUAL evidence against this ex-marine, I'm calling bs on the government and their claims.

I'm gonna go put on my jeans, and a long sleeve shirt, sit out on the steps and smoke a cigarette and wait for the Men in Black to come pick me up next because I just said democracy and freedom are now dead, and we live in a Police State where Communism and Socialism reign supreme, via the internet. If y'all don't hear back from me in the next 24 hours, you know what happened.

ps, jail cells are typically cold, so at least I won't freeze my ass off by putting some jeans and a long sleeve shirt on while I'm there.

(the above statement was nothing more than extremely dry humor and sarcasm, if for some reason you experience butthurtedness over this, I will suggest you try preparation h to relieve your burning). :D

Well, gee whiz.... looks like the petition to keep him detained didn't contain a single allegation, so it looks like the assertion by some that he "must've done something" and that "there must be more to the story" has turned out to be patently FALSE.

Good thing this judge recognizes a citizen's constitutional rights. :usa:

Starting to look a lot more like everyone overreacted, including the shrink that ordered more evaluation and the 1st judge that agreed and ordered the 30 days.

Good thing he had big shot lawyers. The average joe would've been railroaded.

glad to see that due process worked itself out. Now, if he is showing "signs of psychosis", I hope he can voluntarily go address whatever it is that may be bothering him and move on. being angry and bitter at your government over war experiences while no doubt traumatic and horrifying, is no reason to remain bitter and angry. If that means talking to someone to talk to, he has resources at his disposal as a veteran and he needs to utilize them, otherwise things like this could manifest themselves later into something far worse.

Sure, but as we know little about what was found (or not), until this happened we were just guessing. You guessed correctly, congrats.

Those who were defending the action were going on as much info as you had - virtually nothing.

Good thing this judge recognizes a citizen's constitutional rights. :usa:

No guess work involved. There simply was no evidence that he threatened anyone. Nice try.

LOL, like any of us knew all the evidence when the story broke. Heck, we probably still don't. You guessed and got lucky, but I wouldn't expect you to admit that.

No worries, I've no horse in the 'who guessed right or wrong' game here, I didn't weigh in on it. I just find your 'told you so' attitude amusing.

Some of us were going on what was reported, not conjecture on what he might have said or done, so I'm not surprised in the least that the judge released him.

I think this one is interestin, and should be carefully watched to its conclusion (...if it's public, which im betting wont be public --- until after the november elections....). Could it be that the provisions of the patriot act were involked and this guy detained under the provisions by a sympathetic magistrate??. Could it be that those provisions were involked and secretly heard, and a federal judge struck em down? There have been a bunch of First Amendment cases over the last few months, all comming down on the side of "free political speach"... I find this very interesting, indeed.

Not sure if this has been posted here if not, on radio they were discussing with a psychiatrist how he could get 30 days. She explained the state had recently changed a few laws that define the law right out of the bat:

Like most state commitment statutes, Virginia’s commitment statute defines “mental illness"

relatively broadly to mean “a disorder of thought, mood, emotion, perception, or orientation that

significantly impairs judgment, behavior, capacity to recognize reality, or ability to address basic

life necessities and requires care and treatment for the health, safety, or recovery of the

individual or for the safety of othersâ€

The situation of them picking up for what he said I have no problem with, but the state law they used to hold him is absolutely frightening. Beck said this morning during that interview that since this law has been enacted, 26,000 people have been subjected to its actions in one way or another. Now I know VerjinuuA people are crazy and all, but 26,000 is a whole lotta people for one state.

If he had a map with all of the local polling places circled in red would that make a difference to anyone? What if he had newspaper clippings of the Detroit and Colorado shootings? What if he told the officers if a certain candidate did not win the election he would fix that?

I think that we have only part of the story as others have said.

I too like TMF have dealt with Soldiers who should be not be in uniform or even close to a weapon. Luckily I was an instructor at OCS and when they left the Company we did not see them again and never followed up.

I did always wonder how they ended up there in the first place.

It might, but it still is a lot of "what ifs". If that is the case, since they took him into custody, they better be

showing some evidence to what you're proposing, don't you think?

It's the lack of being forward that bothers me about this. It looks like something OS described, at this point.

The threat of violence is not now nor has it ever been protected speech or a First Amendment issue.

I just tried to do a search for the full transcripts that led to this guy being hauled off, but didn’t find them.

The Chesterfield Police say they were simply transporting Raub for the FBI, the FBI says they dind’t arrest him they were assisting the Secret Service; the Secret Service says they didn’t arrest him.

As a citizen I expect some answers from the United States Department of Justice. From the statements made by the intake interviewer at the hospital “friends†of Raub had called (the Police?) and said they thought he was dangerous and had made threats against President Bush.

I suspected that when I saw the story because the Secret Service doesn’t show up at your house on general nut case threats against the public. The Secret Service or any other LE agency has every right in the world to walk up and knock on the door and talk to him; no violation of rights there. If it’s an investigation and not an interrogation; the reading of Miranda rights is not required. It appears that Raub agreed to talk with them. However, if a decision had already been made to arrest Raub; Miranda is required if they are going to use any statements he makes against him.

This isn’t rocket science or doesn’t require any high level investigator to view the footage of Raub being handcuffed and start there. Ask him who told him to take Raub into custody and work from there. The three agencies involved are all denying they took Raub into custody. Are we to believe a Chesterfield PD Officer threw cuffs on him and transported him to the nut house without the FBI or Secret Service telling him to do so?

As you heard the attorney say, they are going to sue. As a taxpayer I don’t want to pay for this unless mistakes were truly made. If mistakes were made the United States Department of Justice needs to get off their azz and do their job. They need to make the responsible agency make a public apology and deal with the consequences. If mistakes were not made, and there were creditable threats; I expect to see Raub charged criminally and stand trial.
