TN Bill to remove restrictions on knife possession and carry

I see what you are saying on one side as far as schools.

 

On the other side, in my opinion, the statute does not prohibit pure possession of a knife at a school, it prohibits possession with 'intent to go armed'.  From what I have read of court cases, 'intent to go armed' means having something for both offensive OR defensive purposes.

 

You can have even a butter knife with 'intent to go armed' if you are carrying it for protection or to go cut someone, or you can have that butter knife to cut up an apple, which to me is pure possession with no 'intent to go armed'.  Same thing with any knife.  Someone may carry a swiss army knife with the scissors to cut strings on his clothes or trim up his fingernails, or he could carry it with 'intent to go armed' as a protection device.

 

I think if pure possession of a knife at a school was prohibited, it would be in this section where possession of firearms WITHOUT intent to go armed is illegal at a school:

 

"(c) (1) It is an offense for any person to possess or carry, whether openly or concealed, any firearm, not used solely for instructional or school-sanctioned ceremonial purposes,........."

 

(b)(1) prohibits having firearms AND knives WITH 'intent to go armed' and is a felony offense. 

(c)(1) flat out prohibits possession of a firearm WITHOUT 'intent to go armed" and is a misdemeanor.

 

Just my opinion.  I am not a lawyer.  I would like to see a lawyer's opinion who is well versed in TN weapons law on the knives.

Heck, I'd be happy just to be able to carry a knife over 4" long if I wanted to let alone a auto-knife. In my home state they allowed you to carry any knife over 4" as long as it wasn't concealed. This 4" limit is stupid whether open or concealed. Death by a 3" blade is just as dead as with a 5" blade.

And as far as shipping autos, I faintly remember reading that its only with the USPS that's is a problem?

That's correct.

 

18 USC § 1716 - Injurious articles as nonmailable, forbids shipping swithblades through USPS.

 

15 USC § 1244 - Exceptions, (to the federal Switchblade Act)

 

"Sections 1242 and 1243 of this title [which covers shipping of switchblades] shall not apply to—
(1) any common carrier or contract carrier, with respect to any switchblade knife shipped, transported, or delivered for shipment in interstate commerce in the ordinary course of business; "

HB0581 would change the existing law to allow possession of all automatic/switchblade knives and enact knife law preemption which would make the state the sole authority on knife laws, which will create consistency throughout Tennessee.

Hmmm....knife? Glock 30.......knife? Glock 30.......seems like my dad always said..."Randall.....remember this, never take a knife to a gun fight". I think I'll stick with the Glock 30. I DO Carry a serrated Gerber though....just FER cutt'n rope though......and the occasional varmint that needs cut'n.........LOL.

I agree with you.  But it is a bit hard to cut my lunch sandwich at work with a Glock.

 

"I told them to cut my sandwich in half, and they didn't do it!  Oh well, *ca chack* BOOM!"

I'm really excited to learn about this bill, so tired of not being able to carry a decent sized pocket knife, or worrying about buying one under the legal length.

I made a unique Email for Mr Harrison and the sent a copy to the rest of the subcommitee.

Here is what I sent them:

 

Dear [Rep name here]


    Thank you very much for hearing HB0581 in your subcommittee.   This knife bill updates the law concerning switchblades and blade length.  It also establishes statewide regulations on knife carry.    Please vote "yes" when this bill comes before your subcommittee on April 3rd.
     I have heard many complaints about the knife laws here in Tennessee from residents of other states who are considering visiting or moving here.  The most common complaint is the 4 inch blade length and the fact that "blade" is not defined in TN code.   This bill deals with both issues.  As concerning switchblades, in the fiscal note attached to the bill, the Department of Corrections states that there is approximately one admission per year.  That is a very small number of arrests.  Also, it is now possible to go to almost any store that sells knives and purchase a knife that, without the aid of a spring, opens as fast as a switchblade.
     Looking at these two facts leads me to believe that lifting the ban on switchblades would not increase crime.   In addition to the two aforementioned changes to the law, this bill applies knife law statewide.
