They order appetizers and one glass of wine each since they are all driving.

After an hour they head to their respective homes where they find husbands still in front of the computer typing away on TGO.

After disarming, the women lure the men into the bedroom using their wily charms. 1 has to work little harder as her man is a lifetime benefactor.

In Tennessee what crime (s) if any were committed?

And how did they get the guns off of TGO husbands?

Well the law states you are in violation if you drink and carry. It does not give any other info like being drunk or intoxicated. Just can't drink and carry.

Just what we need is a bunch of rednecks drunk carrying guns. Dang, somebody's beer can might get shot. Lol

Not legal to have even one drop of 1% alcoholic drink while armed. Legally that is.

I disagree with the law but it is what it is. Zero tolerance and all that bs.

 

Dam that sucks... Least in MI they lower the level from .08 to .02 when armed...

This sentence is unclear.

 

If the women are disarming themselves, it implies they were drinking AND carrying at the bar. It is against the law to drink and carry.

 

If the women are disarming their husbands, before engaging in intimate activities, the only crime committed was distracting their husbands from their most-favorite activity in favor of their second-most-favorite activity. I'm not sure where to find that in TCA Annotated.

Well, I'm not exactly sure about what the story is referring to as "disarming"...

To answer the implied question, though:

- Being armed while consuming alcohol inside a business where alcohol is served, and/or

- Being armed while under the influence,

are both illegal.

 

Either is a class A misdemeanor, punishable by:

  • up to 1 year in jail
  • a fine of up to $2,500
  • or both.

Also, if you do either one while inside a business where alcohol is served, your permit will be suspended for 3 years.

 

Per TCA 39-17-1321:

 

 

39-17-1321.  Possession of handgun while under influence -- Penalty.

  (a) Notwithstanding whether a person has a permit issued pursuant to § 39-17-1315 or § 39-17-1351, it is an offense for a person to possess a handgun while under the influence of alcohol or any controlled substance or controlled substance analogue.

( B) It is an offense for a person to possess a firearm if the person is both:

   (1) Within the confines of an establishment open to the public where liquor, wine or other alcoholic beverages, as defined in § 57-3-101(a)(1)(A), or beer, as defined in § 57-6-102(1), are served for consumption on the premises; and

   (2) Consuming any alcoholic beverage listed in subdivision ( B)(1).

(c)  (1) A violation of this section is a Class A misdemeanor.

   (2) In addition to the punishment authorized by subdivision (c)(1), if the violation is of subsection (a), occurs in an establishment described in subdivision ( B)(1), and the person has a handgun permit issued pursuant to § 39-17-1351, such permit shall be suspended in accordance with § 39-17-1352 for a period of three (3) years.

In this scenario the women were armed whilst consuming.

It says nothing as to whether it is illegal for me to go over a buddy's place and have a beer or two while armed. As far as being under the influence goes, that is a nice gray area up to the discretion of the officer one may interact with. Edited by Chucktshoes

It says nothing as to whether it is illegal for me to go over a buddy's place and have a beer or two while armed. As far as being under the influence goes, that is a nice gray area up to the discretion of the officer one may interact with.

 

Yup, it's not necessarily unlawful to consume while packing, but the first sip in an establishment open to the public becomes a Class A 'meanor.

I agree. If a few beers makes you unsafe to be around a gun, you were already unsafe to be around a gun before you drank the first one.
