Did Everything Weapons in Franklin sell me a used gun as new?

Amazing, this thread is proof that better customer service really comes from someone u spend 15 bucks with, versus someone you spend 100 to 2500.00 with.At least the 15 dollar experience may include, would you like a straw? or I'm sorry let me fix that/get another one, add ice,this is wrong let me fix it,get you another crayon, or, Let me get my manager to fix this.....Well do whatever it takes to make your experience fun and exciting!

I would have taken it back in to show the owner or manager the condition of the gun in person. Then if they insisted that the gun was still brand new and had never been fired, and it was in exactly the same condition as all of their brand new guns, I would say "then you won't mind exchanging it for me now to give me another brand new one of the same model". So the only way they could refuse to help you is if they admitted that the gun is now less than brand new, and then accuse you of causing the wear and tear. But no matter what the situation, if the customer is unhappy then a smart owner / manager should offer to do something to please them even if only a small gesture, unless they truly felt or had evidence that the customer was abusing or scamming the business. But many small businesses just don't think or operate that way, either because they can't afford to or because they are not mature enough to realize the right way to handle it. Edited by wileecoyote

Have to do another 4473 at that point for the new gun, AFAIK. I don't think it's the same as a factory replacement if done by FFL?

I think if the customer had left the store for any significant time (maybe >24 hours?) the dealer is required to do another form to document the serial number switch out and verify that the customer did not have a criminal status change after his last visit, but even if so this should not have prevented the business from doing the right thing. It's the cost of doing business.

Not sure what the exact rule is re FFL. A manufacturer can replace a firearm with one with diff serial number at any time without doing official transfer, can ship directly to you.

 

Not all will though, as I found out with an ATI Omni AR-15 lower replacement.

Reason being they have to have a transfer of that serial number on the books to account for it in the log. anything that come in on the books has to have a log out or be destroyed. What manufactures can do is replace a serial number on their transfer book with a new one, but the old one then has to be destroyed.

I bought a new gun that had obviously been fired from one of the top dealers on here. I even ask if it was used. They told me no; it came that way, its brand new. I had no reason not to believe them since guns are fired at the factory.

That powder in the bore wouldn’t bother me but I don’t think manufacturers test with new magazines that go with the gun. That magazine certainly looks used.

During your conversation did he ask you what you wanted done?

Nope, he never asked what I wanted done. No empathy, no apology for the gun being so dirty, nothing. He just "informed" me that the gun was brand new never used, and said Taurus ships dirty guns. Then the excuses about how they wouldn't have rented or fired it in store, etc. I felt like I was a fire he was trying to put out quickly so he could move on to the next one.

Taurus does not ship guns that are that dirty, at leas the three that I have bought new were not.

I don't want anything--never said I did. I just asked for an opinion from everyone here on whether or not they might have sold me a used gun as new. It's all on me for not inspecting the gun better at the store. Funny thing about that that I haven't mentioned before is I was initially looking at a bi-tone TCP and I did look that one over well. I would have bought that one except the slide release was defective--it was impossible to release the slide with it when locked back. Salesman acted surprised when he tried and confirmed it was bad. I guess at that point I figured I'd take the cheaper one with the working slide lock and didn't look at it as hard. I wonder now if they even bothered taking that bi-tone out of the display case. At any rate I've maintained from the start that I should have inspected it more closely. I was looking for nothing other than opinions on the state of the gun. And opinions I got in spades :) I still have yet to shoot it, but I guess Taurus will take care of anything that turns up, so no real harm done other than poor customer service at best. I have working at two gun manufacturers and some retail stores let me add my two cents. Guns come in dirty from test firing. As much fouling as the barrel and magazine have would indicate something else to me. They had issues with that gun at the factory. It took some tweaks to generate it running. They forgot to clean it after every test fire. Then once they got it running it was sent out again not cleaned. If you are going to use this as a carry gun you need to shoot it a lot to make sure it will be reliable. When I built guns they would be test fired if they functioned reiably then cleaned and packed for shipping. When I was in retail if a gun came in dirty I would punch the bore and wipe it down. I don't recall ever seeing one com in that dirty.
On E W the counter guys are friendly enough but the owner and manager are a different story. I will not darken their doorway anymore.

A couple of years ago I bought a "new' bolt action from a Franklin gun shop. Got it home and the warranty card in the box was already filled out with someone else's name and information! Upon returning to the shop the owner agreed upon a modest store credit. I asked him to please initial the credit chit, he jerked it out of my hand, tore it up, and said I was trying to tell him how to run his business. ... Oh, he said the rifle was new but a guy intending to buy it had filled out the warranty card in the store and then changed his mind about the purchase while still in the store!!! ... hmmm.

Haven't darkened Franklin Gun Shop's door way since.

That's as far as I needed to read before guessing FGS.

I had heard the FGS was really behind EW opening. I discounted it as a rumor at the time, but as time passed there seem to be an awful (appropriate) lot of similarities between the two.

What is it about Franklin, why are there no quality shops there?

The guys that opened EW told me face to face that they are former "employees" of FGS during their grand opening a while back.  Just an FYI.

As I travel across the state weekly I visit many gun shops.  I'm glad I haven't been to Everything Weapons.  Most of the shops I've done business in seemed to appreciate their customers and deal fairly with them.

That describes FGS to a T makes me really wonder if and how they were really burglarized a few years ago when they pull crap like that...
