150 Somalian Muslim Workers Fired From Colorado Meat Packing Plant

About 150 workers, most of them immigrants from Somalia, have been fired from a meat packing and distribution plant on Colorado's Eastern Plains for walking off the job to protest a workplace prayer dispute.

 

Depending on the season, the Muslim workers prayed at different times of the day, typically in about five-to-10 minute blocks, Hussein said. But recently a decision was made at the plant to change the practice.

"The workers were told: 'If you want to pray, go home,' " Hussein said.

Yeah, this is crap. What's good for the goose is good for the gander. If my coworkers were getting extra breaks to pray to the moon gods, then I'm getting extra breaks to practice Pastafarianism. Also, Islam allows for make up prayer prior to or after missing regular prayers throughout the day if they were working, so the problem is manufactured BS.

If you walk off the job or strike you better know you have some power. It’s a roll of the dice and came up snake eyes for them.


They'll be fine. They're a double minority living in Colorado. The liberals are probably spilling their white mocha gluten free half caff lattes trying to give them free stuff.

Nice to know some ragheads may be cutting up the meat we eat. I guess we need to just stick to pork as they will supposedly flee from it. Some liberals say oh there are good Muslims to which I say really. Have you ever heard of a Muslim hospital, or when some disaster strikes have you ever seen them open up a Mosque so people could be comforted with a dry, warm place to stay with food and such?? I certainly haven't, but you can bet your last dollar that the Baptists, Methodist and other Christian churches happily open their doors to take in "all" who need a helping hand. Think on this awhile and please respond if you can come up with 1 selfless act of LOVE a Muslim mosque or community has done. I will give you a year.

Perhaps PC will fail in any court cases. I find it disgusting that we are being over ran by folks from off shore taking jobs. In the IT world it is more and more prevalent. HN1 visas are killing the field. 80% or higher are not up to the job and even higher rely on the "Language Barrier" when called out on issues or problems.

We have college grads that cannot find a job because off shore workers will come in and do it at half the money.

Hell, the Muzzies might prevail in a lawsuit -- remember the recent settlement for the Muslim truck drivers who refused to deliver beer?

...and there's always the NLRA. If they were to file a PCA claim with the NLRB, the Board would hold admin law jurisdiction. Could be viewed as protected, concerted activity. Applies to all private sector workers covered by the act, even if not in a union.


'Section 7 of the National Labor Relations Act states in part, “Employees shall have the right. . . to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection.” Strikes are included among the concerted activities protected for employees by this section. Section 13 also concerns the right to strike. It reads as follows:

Nothing in this Act, except as specifically provided for herein, shall be construed so as either to interfere with or impede or diminish in any way the right to strike, or to affect the limitations or qualifications on that right.

Unfair labor practice strikers defined: Employees who strike to protest an unfair labor practice committed by their employer are called unfair labor practice strikers. Such strikers can be neither discharged nor permanently replaced. When the strike ends, unfair labor practice strikers, absent serious misconduct on their part, are entitled to have their jobs back even if employees hired to do their work have to be discharged.

If the Board finds that economic strikers or unfair labor practice strikers who have made an unconditional request for reinstatement have been unlawfully denied reinstatement by their employer, the Board may award such strikers backpay starting at the time they should have been reinstated.'

Essentially, the labor practice in, and of, itself doesn't have to end up being unfair for them to prevail on reinstatement.

I think it was Tyson that had a big hubbub a few years ago about employees wanting to be off for Ramadan. There's another meat processor in Colorado that is staffed 90%+ by Mexican and Somalian immigrants. They have a handful of interpreters that go to various departments in the plant as needed.

Indeed, the feds initiated the Muslim trucker suit, specifically the EEOC, which also represented them in court.
