  1. This is one of those things that pulls me in two different directions. First the need to protect kids form true predators. Next the fact that our government has in effect created a de facto scarlet letter whereby one must go to prison and pay fines then once released continue to be punished for the rest of their lives. For what may or may not be a true predatory crime. In fact many states allow people who are convicted of such things as public indecency to be placed on the sex offender registry. A 17 year old having consensual sex with his 16 year old G/F. A 21 your old giving his 16 year old cousin a porn mag or DVD. Its no longer about rape and child rape, incest, child porn or other seriously deviant behavior. There is a lawsuit in Florida I think where sex offenders are only allowed to live under a bridge because of the number of schools, daycares, parks and playgrounds the city has. There is actually no where the can live except under this bridge that doesn't put them in violation of law. They can go even if their children aren't participating. It's an exception Clarksville Sen. Tim Barnes is working to eliminate. "Under current law, we allow sex offenders too much access to school if they have a child that goes to the school," said Barnes. He recently proposed a bill prohibiting sex offenders from on-campus scheduled activities. "They can go to parent-teacher conferences but only with the approval and the time set by the administration," Barnes said. Many but not all of the parents Channel 4 talked with support the change. "I don't think they should be allowed within 1,000 feet from schools," a parent said. "There are some people that were sex offenders only bc they had consensual sex with a minor," said Penny Brossett. "I mean, yeah, it depends on the sex offense, but honestly and truthfully, if they were convicted of a sex crime, then they shouldn't be allowed near children at all," said Money.

  9. Only in certain circles where certain people believe that specific groups are protected classes. That require strict scrutiny and if they could truly get they way suspect classification would apply...
  10. First off, yes I'd agree with the others you are having a bit of a nutty, especially when you starting calling folks Redneck Klansmen. Tennessee does have a disproportionately high number of its POST certifications revoked each month based on population and the averaging method the FBI uses to ratio police. 1/1000 people. This is a statical model the FBI has developed to gauge the ratio of crimes per 1,000 people vs. the average number of cops per 1,000 people, vs the average ratio of 1/1,000. It was developed by the FBI, not by me, it was developed by people who are frankly a whole lot smarter than all of us at statical modeling. Now Tennessee POST allows non-employed people to avail themselves to the various state academies. Once they graduate and they are given a graduation certificate, POST cuts them a basic law enforcement certification number. This number is held by POST for a period of one year. During this time frame the graduate must become employed by a POST accredited agency. When that happens the agency notifies POST they have employed the graduate and POST thens sends the POST certification certificate to the officers agency, who then gives it to the officer. If they do not become employed within one year of graduating they will have to re-attend the PA all over again. POST does not revoke certifications if you fail to obtain employment. Even after being out of LE for 4 years your POST certification is not revoked, it only expires and must be renewed by re attending an academy. POST only revokes a certification after a formal POST investigation into behavior which will trigger one. Tennessee revokes the certification of an average of 30 officers each month. Since I've been working in my current job with the state I've seen a high number of 88 one month and a low number of 12. But the monthly average has been running around 30 for the past 12 months. This coming from a state who's population is 6.3 million. I attended a class no too long ago that dealt specifically with my field of speciality, which ranked the states for crimes and convictions by police. In 2008 Tennessee ranked 16th out of 50. Ohio which has a population of 11 million ranked 17th, if that tells you anything... There are 374 agencies in the state of Tennessee who employ about 7100 police officers. On any given day POST is working 110 to 120 investigations at the request of the employing or terminating agency. Which ever the case may be. This does not include any open investigations that may or may not be under way by any federal agencies. See I know a little bit about what I'm speaking of. I'm not someone one rambling on and on about nothing. I do not work for POST. I am a state employee, I am a criminal investigator by classification who works in a very high level state office. You can believe me, or don't. It really makes no difference to me or to the information and facts I post. If you wish to set aside you anger at (the information?), or me whichever and discuss this as adults I will be very happy to. Part of my duties include monthly reports to my boss and his boss that contains hard data about official misconduct committed by LE in this state. My boss then includes this information in summary that is forwarded to the Vice Chairman of the Senate Judiciary Committee and the Vice Chairman of the State and Local Government Committee once every 90 days and when specifically requested.

The issue I take is (as folks can read on this very post) everyone automatically attacks those of us who pride ourselves in cleaning out the ranks of corruption in our chosen profession. Were all labeled as some type of sell out. I just don't understand how so few of you cannot understand why a career cop who prides himself in a clean career, who conducts business above board and holds myself to a higher standard wants those out of LE who don't subscribe to this philosophy. The problem is that first, we as a society have yet to even admit there is a problem. Its always the same broken record, one bad apple... blah blah blah... isolated incident... blah blah blah... Next, anytime those of us who wish to educate the public and engage in adult debate try. Were blankly dismissed and deleted as cop bashing. Why? To bring in a parallel if I may. The gun forums and community at times will regurgitate the age old question, will a cop follow an order to confiscate my guns, if that order is given. You would think, all of you being gun owners etc... that you would be very concerned with any indicators as to just what type of illegal and unconstitutional behavior that goes on inside LE today. For it is surly past behavior that is a good indicator as to potential future behavior, if such an order were ever give. All I'm saying is that far too often this issue of criminal behavior and official misconduct in the news is absolutely dismissed as cop bashing, no matter where its posted and no matter who posts it. Its almost like the age old saying, a lie told often enough becomes the truth. In this case if folks yell cop bashing as often as they can over any and all news stories, it becomes an automatic reflex to paint them all into that category. Further helping alone those in the ranks who want you to blindly ignore the forrest for the trees. Just think about it...
  13. Why is it that almost always the discussion of criminal behavior by cops is always painted as bashing of cops, no matter what tone the discussion takes? The mantra is always the same, its not tolerated here... Whatever the reason the public seems all to quick to want to turn a blind eye and dismiss all of these events as an "isolated incident" or blame it on the "one bad apple syndrome". Well I've some painful news for all of you. We've been blaming the "one bad apple" for decades now and the official bad apple count has far exceeded the acceptable bad apple to bushel basket ratio long years ago. The argument no longer holds water when you begin to look at the number and the magnitude of news stories in print and TV media today of misconduct and crimes committed by our police on a daily basis. Not long ago I was even threatened by another officer (Muttling) here on this very forum for pointing out the number of documented, reported incidents. In my current job I am in a unique position to see raw numbers and actual case related documents of these incidents committed here in Tennessee. I can assure you that if someone with a large enough voice took the time to tell the true story about law enforcement (especially in this state) it would shock the hell out of each and every one of you. The number of law enforcement certifications revoked each month in this state by POST is astounding. The only ones who rush to defend these cops are either blind to the facts, are part of the problem or just really have little clue as to what they are actually supporting. I would love to hold an adult discussion about the facts, be it here or in another forum we could all participate in. Just the public news related incidents, (the ones I could publicly discuss) that I would happily reference would stop you in your tracks. And if I could discuss the ones that are currently under investigation or ones that have (for whatever reason) never been dug up by the media. That too would give you a healthy pause I assure you.

  15. I would also love to see this state join the present day and amend the law allowing loaded guns in your vehicles w/o permits. To me that has to be the dumbest gun law on the books here in the Eternal Purple State The Republic of Tennessee...

  20. An attorney would have to show proof to an Appeals Court that he was either under the influence during the autopsy investigation or during his sworn testimony. But a bigger, easier critter to corner would be if he ever falsified an official application, questionnaire or statement that is covered under the pains and penalties of perjury where he was asked if he has ever used any illegal narcotics. If he answered no and its clear he was lying then they might have a ballgame citing his untruthfulness in a sworn statement or any other official documents. This is bad, but sadly typical for this State and those in trusted positions here.
