  1. Regardless of if they have a sign or not....Now that you have been given notice that they do not want you on the property armed....even if they were to take down the sign and you returned armed you could be charged with trespassing. See AG opinin 07-148
  2. I agree...there are simply to many variations for all to be processed in a way to take the same amount of time. The biggest difference in each application I would say is each persons local sheriff. As most know I guess...a copy of your application goes to your local sheriff so he/she can provide any information thay may contradict the information on the application. The sheriff has 30 days to do this. Some may do it the same day...some may wait a little while...some may never send it back and the DOS had to wait the whole 30 days before they can continue processing it. The TBI also had 30 days to run the background check based on the info on the application and do a criminal record check using one set of fingerprints and send one set to the FBI for a federal record check. Again could be done soon...or several days for various reasons. Also figure in mail time for the application to the sheriff, the prints to the TBI to and from the DOS and then at some point the HCP to you.

  4. Stop and Identify laws have been ruled constitutional by SCOTUS, but TN has no such law. So I think you have to be in custody or detained before you have to idnetify yourself. But in TN you must present your HCP upon demand to a LEO. Obvisouly if you are OCing he can ask to see your HCP. I think this is somewhat related. The reason a LEO can't stop you while driving just to see if you have a DL is, there is no law against driving, in general. Just that you have a license to do so. Well there is a law against carrying a weapon in TN. Having a HCP is just a defense to that law. Now in states where OC is legal without a permit, one could argue that a LEO shouldn't stop someone for simply OCing, but in TN as far as the officer knows you are breaking the law by carrying a firearm until you are able to "defend" your actions by presenting your HCP.
  5. Someone correct me if I'm wrong...but you really don't have to verify this information just as long as to your knowledge they are not inellgiable to purchase a firearm....and on private sales they don't have to be over 18. Right?
  6. That's about it.. In this case if Open Carry is allowed by state law a city or county can't pass a law/ordnance that prevents it if they have preemption. In TN the preemption law is 39-17-1314
  7. You know...something else that helps this arguement is by law they can't prevent off duty LEO's from carry there. 39-17-1350 So apparently they just want them/us to carry on duty type weapons...

  9. I understand and thank you for the answer. I believe it is up to each person to choose how and when and what the carry and not for anyone esle to judge. I would just say though that something bad could happen just as easy at the Home Depot, church or your friend's house as it could anywhere else. Often places we frequent become "comfortable" to us and we tend not to be on guard as much as we might be otherwise. I would argue this is dangerous though and just because we are familar with a place doesn't make it safe...and we should be on-guard anywhere actually. This is simply my opinon and may not even be worth $.02...but there it is.

  11. It would be nice....but I wouldn't hold my breath... I'm of the opinion we shouldn't need a permit from the state in the first place.
  12. Well any places that instructs on any subject (martial arts, dancing, etc...) is a teaching place, but that doesn't necessarily make it a "school" under 39-17-1309

That is in correct...you do not have to take the class again if you apply within 6 months of the expiration date. 39-17-1351(m) A permit holder shall not be required to complete a handgun safety course to maintain or renew a handgun carry permit. No permit holder shall be required to complete any additional handgun safety course after obtaining a handgun carry permit. No person shall be required to complete any additional handgun safety course if the person applies for a renewal of a handgun carry permit within six (6) months from the date of expiration.
  15. Hospitals are not off-limits by law in TN. Of course they can post like any other property. Properly posted signs do carry the weight of law in TN. To be correct it must be worded "substantially similar" to 39-17-1359 and is supposed to be posted at every entrance used by the public.
  16. Guess it all depends on whether you think you are more likely to need to draw while stopped or moving....
  17. Although I haven't done it...that is the very reason I have thought of setting up my shoulder holster for a left hand draw.
