Knoxville Allowing Fair to Prohibit Guns in a Park
phil1979 replied to Just2Honor's topic in 2A Legislation and Politics
Only if Tennessee had a Republican governor...oh, wait! I guess by "clarification" from the legislature next year, Haslam means to make it clear that some places that were restored for us to carry at are promptly placed back as off limits. What the governor giveth he taketh away. Question is, does the legislature have the spine to make clear their original intent? How about they make it simple and remove all public property from off limits except courtrooms with metal detectors, jails, and mental institutions? Lots of folks in Georgia are watching what happens there in Tennessee. Why doesn't TFA have the guts to sue over this? -

Knoxville City Attorney contact info: Charles Swanson cswanson@knoxvilletn.gov (865) 215-2050 Perhaps enough of us calling and emailing to remind him of possible lawsuits will help him start giving good advice to Mayor Rogero? -

Knoxville Allowing Fair to Prohibit Guns in a Park
phil1979 replied to Just2Honor's topic in 2A Legislation and Politics
Well, there have been an awful lot of local governments successfully sued in Georgia but that hasn't had the effect of repealing any of our state laws that restored gun rights. Local governments will always resist such state laws, because it takes away their ability to infringe on our rights. The courts are the only and best way we have of forcing their compliance. I think the message our state legislature sent them is, "Don't want to lose money? Then don't do stupid stuff to get successfully sued in court." Maybe Tennessee is different. Maybe you have better ways to do this. Or maybe your legislature is incapable of sending the message above. -

Perhaps Knoxville Mayor Madeline Rogero has some deep pockets of taxpayer money to pay out in losing lawsuits for violations of carry rights at Chilhowee Park? I gave her office a call a few minutes ago to ask this very question. The young lady that answered the phone promised to give the Mayor my message. -

Well shucks, no need to get everybody riled up with emails or phone calls to your local officials and the governor. Just deep conceal at the Fair and hope you don't get patted down. /sarcasm -
Riverbend Time: an experience from last year.
phil1979 replied to a topic in Handgun Carry and Self Defense
Wonder if Riverbend will update their website now with regard to their weapons policy? It's certainly legal to open or conceal carry your pistol there now, regardless. -
Discussion Of Possible Gun Legislation, Parks Again
phil1979 replied to runco's topic in 2A Legislation and Politics
Someone who usually open carries will attend some of these events at public parks eventually. I wonder what the authorities resisting state law will then do? I know I'd be one of the open carriers if I was there. It is my usual mode of carrying my pistol. -
Discussion Of Possible Gun Legislation, Parks Again

I wonder what it will take for Nashville to start obeying state law? They seem to be thumbing their nose at Attorney General Slatery's opinion, as if he were an idiot for actually believing the law says what it says. Will it take a test case, a lawsuit, what? -
TN Attorney General Opinon On Park Property

Just assuming, you know. :-) Holder has been said to be the nation's Chief LEO, and he was an AG. Maybe I connected the dots wrong? LOL -

phil1979 replied to 300winmag's topic in 2A Legislation and Politics
Of course, we know what a corrupt or inept judge could do. However, this should not even get to that point. Do you think a prosecutor would back off when the AG points to his opinion and says it's not a crime? Doesn't the AG have this much pull in TN? Hasn't the U.S. Supreme Court ruled that you cannot be convicted if you are a victim of entrapment? Isn't it entrapment if the Chief LEO says it's not a crime, but they try to get you anyway? -

Ok folks, here's the real deal now. Now it's a different ball-game with the AG's opinion out on this. IF the Chief Law-Enforcement Officer of your state says doing XYZ is NOT a crime, and you then do XYZ, you CANNOT be charged with a crime, because that would be ENTRAPMENT. If they attempt to do this to you, use this as your defense. The AG mentioned the word "recreation" several times in that opinion. That means publicly owned zoos, amphitheaters, stadiums, arenas, museums, etc. are all now LEGAL to carry at, either openly or concealed whether or not they are managed by a private entity, unless otherwise restricted by state law. Print out this opinion and carry a copy with you to show any officer called to arrest you. -
Why would the arena still be illegal? Isn't it a public building used for recreation?
-
So, since the new law, is Bridgestone Area now legal to carry at? They still have a "no weapons" policy on their website. It is a publicly owned building.
-
Perhaps an OC lunch at Coolidge Park in Chattanooga might be in order to help educate folks about the new law? I probably won't be able to make it anytime soon, but would gladly donate a few bucks to help pay for the BBQ.

You know, it's kinda funny when Maine gets Constitutional Carry before Georgia and Tennessee does. I mean sad.
-
Aren't city and county owned museums and community centers already covered under state preemption? If so, they don't need to be addressed in the new parks law. If not, then where do they get the authority under state law to ban guns at those places?
-
So, the only consequence you might be tagged with is losing your permit under 1359? What if the person is carrying on a Georgia weapons license? They can't take that away. LOL Wow, just when I thought things got a lot better in Tennessee, they also got a lot murkier. Hope y'all can clear this mess up. What will it take, and is there the will for folks to step up to the plate?
-
Just take a bunch of photos with your OC'd firearms next to the sign and post them on Facebook to embarrass them.
-
What happened a year ago that caused Knoxville to lose their grandfathered in status to ban firearms in parks?
-
That would not be a legal problem per se (laws are dated), it would only be incumbent on me to research it, as I should know the law anyway.
-
At the end of each of our Georgia bills, something to the effect of "All conflicting provisions of other laws are hereby repealed". Maybe Tennessee needs something like that?

They played that same broken record in GA over and over. With HB 89, SB 308, HB 60, etc... Sounds like a widespread disease. Edit: I placed the dotted line below to separate my comments from the person who posted below. I think I may be having trouble with the quote function. ----------------------------------------------------------------------------------------------------------------------------------------------------- It's like an old broken record. Shall issue passes, (Oh my god, wild west shootouts in the streets), didn't happen. Carry in stores that sell beer passes, (Oh my god, wild west shootouts in stores), didn't happen. Carry in state parks passes, (Oh my god, wild west shootouts in parks), didn't happen. Carry in restaurants passes, (Oh my god, wild west shootouts in restaurants), didn't happen. Guns in cars in parking lots passes, (Oh my god, wild west shootouts in cars in parking lots), didn't happen. Carry in city parks ?? (Oh my god, wild west shootouts in city parks), not going to happen. But you can't tell them that, they will play that irrational emotional broken record every time a new pro-gun bill is passed.

I will as soon as I get a chance to vacation again in TN. I normally OC anyway here in GA, so it's no big deal.

Doh! LOL
