  1. Certainly it can be, if the dismissal was part of a pretrial diversion or the successful completion of probation. Happens all the time.
  2. “Large†frame S&W would be the “N†frame. The “K†frame would be more along the size of the Ruger. What model S&W are you comparing? I have never used Ruger’s Customer Service, but S&W’s is the best in the industry if you need it. I use S&W as an example of what Customer Service should be in all industries, not just the gun industry. Of course the days of Customer Service are about gone.
  3. Not with a conviction. That is clear in the statute you are linking. Depends on what we are talking about. Expungement of an arrest that was dismissed or asking for expungement of a conviction.
  4. This is a debate that we can’t win and it’s silly to get sucked into. Are HCP holders living at the foot of the cross or less likely to commit a gun crime than the average citizen? Probably not, the average citizen is not a criminal. Thousands of permit holders lose their license or are refused licenses each year. Is there a box to check on a Police report asking if the arrested is an HCP holder? Not that I have seen. However, when a serious gun crime is reported by the news and the suspect has a carry permit; that will usually be stated. It’s easy to refute claims that HCP holders don’t commit crimes; documentation is available and they can drag up all the news stories to go with them. Making a statement that HCP holders is a safer group than criminals that have records is a given. Stating that they are a safer group than average citizens is mere speculation. Why do some of us want to get trapped in this debate anyway? It is a given that armed thugs carry guns. Disarming us (or the citizens in general) only gives them power.

    Is that based on your years of experience? I’m just having fun… you titled this thread “Stirrin' the pot!†That’s what I’m doing. I didn’t call any shot gun crap; don’t put words in my mouth. You learned a new word “Fanboyâ€â€¦ we get it. I guess that is what I am. You seem to need a pat on the back telling you that you did good. So here it is… pat, pat pat… you did good kid. As long as you are happy that is all that counts.

    This will end the way all these shotgun threads end. The 870 is a proven performer that has been around since way before you were born. If you want to call those that have knowledge and experience “Fanboysâ€; so be it. But I would suggest that since you have your mind made up, you buy what you want and don’t worry so much about getting your feelings hurt because everyone doesn’t agree with your choice.

  8. That’s fine; and it may be true for your area. My point was that if someone does a real background check or a criminal history they will not only be able to know what the charges were but will have copies of the Police reports. You asked and I’m just answering based on my experience of doing background checks. Nothing is ever gone.
  9. Because Police department and Military background checks aren’t just computer checks. They contact the local departments where you lived. Local arrests records are not removed just because you got an expungement. I have an arrest for having a gun in my car in Illinois. The charges were dismissed, but the arrest record is still there. If I did not disclose it; it would show up.
  10. Or the ejector rod has come loose and backed out. Either of those problems are pretty easy to fix yourself if no one has tried to force it and bent the ejector rod.

That is why if you are a potential juror in a death penalty case they will ask you if you can vote for a conviction if you know the penalty is death.
  16. Religion was brought into the discussion because we were talking about murder. You really can’t make decisions about murder without religious beliefs being involved.
  17. I disagree. We are talking about a group of people that do not get to enjoy the freedoms of the average citizens. Being a cop is a choice, you are held to a higher standard. If you have bad credit many departments won’t take you. If you have a divorce do to your infidelity many departments won’t take you. If you have a problem with drugs or alcohol most departments won’t take you. Is it fair? Sure it is. You are going to make judgment calls on citizens. My discretion was taken away on DUI in the 80’s. No breaks for DUI. No sending someone home in cab, no allowing someone else to drive, no allowing them to park the car, arrest was the only option. Why? Because the pressure put on law enforcement by MADD and the insurance companies worked. I saw people’s lives ruined and their careers ended because of DUI arrests. I saw young people’s dreams shattered because of DUI arrests. I’m suppose to watch that happen and think it’s okay that a cop gets a second chance; a cop that should have know better than anyone the consequences? I don’t; it’s not okay. Anyone here that is familiar with my posts knows that I’m one of the first to jump in when a cop comes under fire for making a mistake. Mistakes are made by cops every day. Mistakes are things like not knowing every law that is the books or making a mistake in what they think they are seeing, or having a Judge disagree on what they thought was probable cause for a search; those are mistakes. Firing up a joint, sticking a straw up your nose or a needle in your arm, or crawling behind the wheel of a car when you know your BAC is beyond the legal limit; is not a mistake. It is a crime; a career ending crime. If you want to give them a break and send them to rehab; fine. But just like some citizens; they need to find a new line of work when they come out. Also a cop’s credibility is destroyed when they have been convicted of a crime. It can be brought up in every trial they testify in; it goes to credibility. By my statements I do not mean to imply that cops are better than anyone else. But the reality is that they are held (by the public and by most of the departments I have experience with) to a higher standard.
  18. Wow… that’s sad. The citizens of the state of Tennessee and especially Memphis should be outraged. Police Officers are held to higher standard, which is just understood; it goes with the job. DUI and drug abuse are choices; not a disease. Overlooking a minor offense prior to becoming a cop is one thing; allowing it and putting a stamp of approval on it after they are cops is criminal. But hey, look at the bright side… now all the cops that are fired by other departments can move to Memphis. That should allow him to keep the pay scale down. If you are appalled by this; I agree with you. I also predict that this policy won’t last long, especially if the national media decides to grab on to it.

  20. We don’t have a clue. Why don’t you fill us in? Having bad cops is one thing; having bad cops and doing nothing about it is something else. Is there a reason to believe that MPD would allow an Officer to be selling stuff out of the back of his patrol car while on duty, or that they are about to knowingly graduate a multiple DUI offender from the academy? I’m just asking, I don’t know anything about MPD or their reputation.
  21. No, a Police Force does not answer to the President. He wants a force that he is the Commander of, and has control over. Governors, State Police, and local Police are not under his control.
  22. You can apply to most departments with a misdemeanor arrest. But most will not accept you. I have no knowledge or experience with MPD, but I’m calling on a multiple DUI offender being allowed. THP just played that game in the media. They were brought under fire for having Troopers that had a single DUI from 10 or 15 years ago. Hiring someone that shoplifted or had a bag of weed as a kid and has since went straight is a whole lot different than hiring a multiple DUI offender (or even a single DUI). They are an enormous liability if the department knows it.
