They incorporated the mcdonald case in the exact same manner as the 1st amendment issues - so you are standing on thin ice making this argument. jayc's poiny is the principal knowing took an action which is unlawful. You may not agree, but that does not make it any less unlawful. I do agree with his sentiment that government official who disobey the constitution should have some sort of repercussion in order to dissuade the bad behavior of others. What that punishment should be, i dont know. But think how many times we have discussion on TGO about various 2nd amendment violators who just do whatever they wish - DC,Chicago, CT anyone? Sorry but you are incorrect here as well The 14th amendment has been used by the courts to incorporate most amendments in the bill of rights - ie holding that no one can be denied their enumerated right by the state. Follks keep conflating this issue beyond its simple nature. The principal orchestrated an organized prayer. No one is "taking your religion" - and its well established that individual prayer is protected. The problem is the school (ie the government) led a specific denominational prayer. And that is NOT legal or appropriate no matter how many times you say it is. And how is it so difficult for some of you to see the principals statement does not take away or contradict what the cheerleader said. Its not like she said the principal did not make the request. And he is on record in his OWN words on that, so you can stop the nonsense that there is a contradiction

The principal publicly stated he directed the prayer over the PA. No one is questioning the cheerleaders veracity. The problem here begins and ends with the principal. If the cheerleaders on their own want to pray - no problem If the entire stand wants to pray and then do a wave or two - no problem Its a problem when the school itself gets in on the act. Simple
