  2. Probably not, but I wouldn't count on him being speaker again. Since he is not a republican anymore, if they have a majority, they are not going to nominate or vote for him. If the democrats have a clear majority...well I'll give you 3 guess who will be elected speaker and 2 of them don't count.

About the difference between TN and Federal law on a felon using a firearm for self-defense Parting information on talking to a lawyer after a shooting Of course I know the time constraints on a radio show don't always allow you to give the same answer one might given more time and access to reference material...so please don't think I am picking apart the answers you gave. But.....there are some areas I'd like to ask you about. Reciprocity There are many states that honor a TN permit and states whose permits TN honors without actual written reciprocity agreements between the two state. Private sales While no paperwork is required for a private transaction in TN. There are laws that say you must not have reason to believe the person can not purchase/posses a firearm. 39-17-1303(a)(3) Brandishing a firearm As you said many times though, you have to have a reasonable belief of immanent death or serious bodily injury before you can use deadly force. So...do you really think that someone simply flashing a firearm and recovering it would constitute that? Of course I know each situation is different and the caller on the show mentioned that verbal threats had just previously been made as well. Arrest on a Class A misdemeanor/Domestic Violence 39-17-1352(a)(6) basically says that if you do anything that would keep you from getting a permit in the first place, then your permit could be suspended or revoked...which includes being under indictment for Domestic Violence 39-17-1351©(6) However in general simply being arrested for a Class A misdemeanor does not cause your permit to be revoked or suspended. Only a conviction of a Class A misdemeanor. 39-17-1352(f)(1) Gun on Dash LOL, while it does seem funny for this area, and granted that is the only area you were dealing with...some states actually do require the handgun to be on the dash if you do not have a permit to carry a handgun. Purchase of Firearm and Getting a permit to carry. While it really was more just the way the discussion when, at times it was a little blurry as to when Purchasing a firearm was being talked about and when Getting a permit to carry was being discussed. At least you did try to clarify it a couple of times. As I said, please don't think I am picking things apart, the above in red is simply my take on the issue and I admit you have more experience in these matters, so any correction or clarification is greatly appreciated.
  5. No, that is incorrect. As was discussed in many other threads, the first proposed rule change did have wording about following state law about state parks. But the final rule change that was approved removed that wording. The final rule change does allow states to pass laws against carry in National Parks, but if you can carry in a state, in general, you can carry in a National Park in that state regardless of whether you can carry in state or local parks in that state.

  7. Yep, that is another one. I have it in my list of bills here put didn't think to post it as well. The fact that HB0221/SB0172 are already companion bills, they may move better than HB0053...at least as of now.

HB0390/SB0578 Handgun Permits - As introduced, permits handgun carry permit holders to possess or carry a loaded rifle, loaded shotgun, or loaded magazine or clip therefore while in a motor vehicle. HB0411/SB0383 Firearms and Ammunition - As introduced, creates Class A misdemeanor offense of attempting to buy firearm when prohibited by law from possessing firearm and attempting or selling firearm to person known to be prohibited by law from possessing firearm. HB0489/SB0265 Criminal Offenses - As introduced, allows person who has permit to carry a handgun to carry gun in place where alcohol is served for consumption on premises if person is not consuming alcohol or is not otherwise prohibited by posting provisions. HB0490/SB0263 Firearms and Ammunition - As introduced, allows probation and parole officers with valid handgun permit to carry handgun under same circumstances as law enforcement officers and allows board to require additional training if they carry during employment. HB0503/SB0084 Firearms and Ammunition - As introduced, authorizes person with a handgun permit who is not consuming alcohol to carry handgun in building where beer or alcoholic beverages are being served subject to posting of property provisions, and adds violation of possessing a firearm where alcohol is served as a reason for revocation of a person's handgun permit. HB0521/SB0245 Firearms and Ammunition - As introduced, allows persons with handgun carry permit to carry in public parks, public postsecondary institutions, and restaurants where alcoholic beverages are being served; allows judges and district attorneys to carry firearms where law enforcement can carry if they have permit or appropriate training. HB0584 Law Enforcement - As introduced, permits the disclosure of mental health records when requested by a state or federal law enforcement agency for the purpose of conducting a firearm criminal history background check on the patient. HB0617 Law Enforcement - As introduced, authorizes commissioned reserve deputy sheriffs authorized in writing by sheriff and reserve police officers authorized in writing by chief of police to carry firearms on and off duty to same extent as full-time law enforcement officers. SB0314 Domestic Violence - As introduced, requires person subject to order of protection to surrender all firearms the person owns or possesses to the sheriff of county of residence and creates Class A misdemeanor of person subject to an order of protection possessing a firearm. SB0468 Law Enforcement - As introduced, permits the disclosure of mental health records of a patient when requested by a state or federal law enforcement agency for the purpose of conducting a firearm criminal history background check on the patient. SB0576 Handgun Permits - As introduced, allows person who has permit to carry a handgun to carry gun in place where alcohol is served for consumption on premises if person is not consuming alcohol or is not otherwise prohibited by posting provisions.
  9. If this is the case, it sounds like something that needs to handled internally and possibly by new employee policies, not an illegal city ordnance.
  10. Only as far as if the state allows carry and recognizes your out of state permit. But as others have posted the new rule specifically says CONCEALED.

  13. I've heard it 3 ways depending on who you ask. He said..... 1. ...he would vote for Munpower (Don't think he ever actually said that) 2. ...he would vote Republican (That is what he did, but I don't think that is exactly what he said either) 3. ...he would vote for the Republican Candidate (Which is what I think he actually said and did not do.) But I agree it is pretty much semantics. Depending on what he actually said, he may or may not have kept his word, but he did what he intended to which is be vague enough to stay unnoticed till it was too late. As far as him being kicked out of the Republican Party...I really don't think it will make any difference on any of the bills we are interested in. I believe he is still going to do whatever he was before. Of course from what we are reading now...he may not as open to some legislation as we first thought. That really goes back to the Speaker's position itself, regardless of what party affiliation the Speaker is. I think it is simply ridiculous that one person can have so much power that he alone can decided if a bill moves through committee or not....but anyway....what were talking about?

  15. Not that I know of. He was elected Speaker for the entire 2 year session. Although it is usually along party lines it doesn't have to be, it is simply whoever receives a majority of the vote regardless if they are R, D or I or whatever the make up of Rs, Ds or Is that vote for them. It simply means that current make up of the house is 49 R - 49 D - 1 I Unless he joins the D party...but with committee assignments already made, not sure if it would really affect anything either way.

  17. I changed my address a few months ago and it doesn't have my current address. Of course this is not an up to the moment live link to the DOS, I imagine the Commercial Appeal got the info at some point a few months ago and developed this database on their own. Might want to contact your legislators about.. HB0053 Handgun Permits - As introduced, makes information contained in handgun carry permit applications and renewals, information provided to agencies to investigate applicant, and records maintained relative to the permit application confidential and creates Class E felony of unauthorized publication of permit information or records.

  24. Well that's good. Very possible a policy change and/or the original statement was not actual policy. There has been more than one case of the website, the person on the phone and the person at the station all saying 3 different things. Good to see they are mailing back receipts though...that is new...guess it is a sign of the times of how long a renewal can take though.
  25. I started to use Driveimage last night, just after it got started it came up with a CRC error. I ran chkdsk on a reboot. It got further, but then had another CRC error. I tried chkdsk one more time....still a CRC error on using driveimage, this time I just told it to ingore all and it has continued on. Still not done, backing up nearly 200gb via USB, I know I know anything I have done since the shadow has been created won't be in the image. I haven't really done much, I just wanted to ask about this. Will the fact that ignored CRC errors make the image useless for backup? Is there something else I need to do to try and clear the CRC error up? Thanks.
