  1. Wow man....I'm all for OC, I have fought the good fight and defended OC on here myself many times. I think the point of the person you quoted was simply if the sign is iffy and/or especially if it is an off-limits place or the sign is legal, out of site is out of mind. See below.

  4. Before I get too far into this...let me say I have changed my way of thinking from before...and I now agree with the OP and other post. But.... A long, long time ago, I used to think about (never actually did) telling a property owner if they had an improper sign. To be honest, in my travels I havn't seen a sign proper, improper or otherwise, so this was more what if. My thinking at the time was, if it was their intention to ban firearms, they should do it legally. The main reason I felt this way because at the time I didn't have quite the understanding of the law as I do now (still not a big understanding) and I didn't really want to be confritational (if spotted) with the owner or LEO about the legality of the sign. So I figure either post properly or not at all. But fastforward a few years and now that I feel I understand the law just a tad bit better and that I feel as long as I am legal (or what I think to be legal) I am willing to argue my point up to a certain degree and I say let the improper postings be. So when someone young or new to carry mentions about informing the owner, I sort of understand where they may be coming from and figure a polite explination as to why that is not a good idea is in order. If it is from someone who has carried a while....well....I just don't understand why they would want to.

  7. LOL...talking about schools. Schools are are required to post signs also, even though they are already illegal per statute. But just like the places that serve alcohol sign above, I don't think it is intended to prohibit carry like a 39-17-1359 sign, but just to inform you of the law. Of course the law relating to the language in the school sign is correct, in the alcohol sign, it's not. On a side note, notice how the law requires exacting wording and sizing on almost every sign it requires to be posted, except 39-17-1359 signs?

  9. I'm really not sure if the word "brandishing" is even used in TN law. In the OP I don't think in an OC state what happened is even close to brandishing. Now in some states, it could be illegal, regardless of whether it is called brandishing. However I do agree that even in TN, you might violate the law, without even touching your weapon. Let's say you and someone get into a heated discussion. Then you intentionally pull back your coat to expose your weapon to him, with the purpose to intimidate to him. Now I'm not sure what it is right off, but I figure you could be charged with something there, even though you didn't pull it out and wave it around.
  10. Actually places that serve alcohol are required to post a sign per 57-4-203(k)(1) Which says.... Each holder of a license to sell wine or other alcoholic beverages for on the premises consumption shall display in a prominent place at the location where such sales are permitted a sign, at least six inches (6") high and fourteen inches (14") wide stating: It's outdated and should be changed....but it hasn't been yet. Of course this is more of an information sign, and not the same as a 39-17-1359 sign.

While I think most instructors are probably good and the ones I see on here even go above and beyond to make sure they have the correct information, there have been several post about instructors giving wrong information in class. Does that mean it happens often? Probably not.....we just hear about it here more than normal. Not too many people post when the instructor does everythign right....lol

  16. Without posting the entire code...look at T.C.A. 39-11-611 Self Defense. What you are thinking of is that if you are in a residence, business, dwelling or vehicle, not only do you not have a duty to retreat, but if someone unlawfully and forcibly enters any of those places it is presumed you were in imminent fear of death or serious bodily injury 39-11-611© The part about not having a duty to retreat anywhere is 39-11-611((1) for the use of force in general and 39-11-611((2) for deadly force. The not withstanding 39-17-1322 has been covered in this and other threads. Just do a search for the others.
  17. Is it supposed to be destroyed by the ATF after a certain period of time like 4473? I guess even if it is though the Chief Law Enforcement Officer still would have a copy.
  18. You have no duty to retreat ANYWHERE you have a legal right to be, whether that is your house or even in public. In some states what the instructor said is actually correct. I wonder if he is from one of those states and not familiar with TN law?

  20. I admit it is hard to believe in a state that allows for the use of deadly force to protect property (yours or a 3rd persons) that OC is illegal. There is an ongoing campaign by Opencarry.org to try and get OC legal in TX. It would be questionable if this situation in the OP would be "intentional" or not. No IMO, but I'm not the one with a badge.
