http://www.michie.com/tennessee is only updated once a year...I think it took until nearly Sept last year before it showed the change. This bill repeals 39-17-1305 or in otherwords there is no 39-17-1305 anymore.

If you mean the Public Chapter number...it could still be a few days before that shows up the state's website....not sure if it can be given to us by some other means before that or not. As far as what LEOs will need know...it is that 39-17-1305 has been repealed and is no more. So there is no statute against carry where alcohol is served.

Well I won't argue about last Friday or today....lol But now to get the media and Secretary of State's office to change their mind about the July 1 thing.....

SB3012 has to be in effect now...... Look at HB0962 Tennessee General Assembly you can see it was overridden by the House on 6/4/09 , but not assigned a Public Chapter Number until 6/17/09. It had to wait 40 days before it became in effect and that was 7/14/09. Well that is 40 day from 6/4/09 NOT from 6/17/09. Really don't know how else to say it.... If you look at Public Chapter 339 (the number assigned to HB0962) http://state.tn.us/sos/acts/106/pub/pc0339.pdf you can see the only thing that had to be done after it was overridden in the House is for the Clerk of the House to send the bill and a letter to the Secretary of State...which he did the next day after the veto. So.....everyone can do what they want...but IMO it is in effect and if I go out...I will carry.... (except this weekend...going to NC )

Well if you'd like send them this page back... http://www.capitol.tn.gov/Bills/106/Amend/SA1236.pdf which changed the effective date in Section 7 and tell them it was adopted on 4/29/10 and is what was passed

It was because the bill basically didn't have an effective date since it was after June 1, so the Constitution says it has to wait 40 days. However this bill does have an effective date...and it was immediately

Hmmm...wild I hadn't really noticed the dates... But as everyone may remember, last year there was question about the effective date since it did have June 1 and it was after that date. But it was whether it was immediately or not......not after it goes to the Secretary of State etc....

Thanks, I'll check it out... Hmmm...I heard on the news this morning that it would be $200 more than the upgrade price to get one early....who knows...lol Thankfully I am due for an upgrade

I e-mailed Garry about the override and told him there was a bit of confusion about the effective date. He e-mailed me back and said he was on vacation but would let Steve know so he could make the changes to the TN page. The main reason I told him about the confusion on the effective date is so he would check into it....not sure if he did or not....but maybe so.

Will if you look back at HB0962 it didn't show the speakers signning it again either after the veto. I agree....if Bredesen had signed it I think 99% of everyone would have thought it took effect that day. Well the veto being overridden by both chambers has the same effect as him signing it.

My understanding is the card has a RFID chip which is suppose to make scanning it easier than having to inspect the book. Also I didn't think you could your DL anymore unless it was an enhanced DL...meaning one with a RFID chip. I admit...I don't know for sure on any of this.

Don't have one, but keeping meaning to get it...figure it would be easier to already have it then try to get one quickly. Went to TX earlier this year and was very close to the border...might have been fun to have crossed just for fun, but couldn't of course...or couldn't have got back in...lol If you don't have one I would suggest getting the book and card at the same time. Cheaper than separate and the card is supposed to make it a bit faster at the places it is good for.

Yep... From the tag they can take the name of the registered owner, then run that name and see if that person has a HCP...but no guarantee that person is driving or as Jamie points out that it is registered to only one person.

Well they way I sort of read it is, if the LEO thinks it's self-defense, he can choose not arrest you. But if does, and then the DA decides it's self-defense he doesn't have to charge you. But if he does...and the Judge/Jury deciedes you acted in self-defense you won't be convicted of any other part.....but anyway... I'm not sure how the case turned out....I'm thinking of a case, but not sure if it is this one or not....

If the sign is on the door, then No, you have not broke the law by being armed in the parking lot. If the sign is at the entrance to the parking lot, then Yes, you did. What people tend to forget sometimes a property owner can prohibit carry on as much or as a little of his property as he wants to. They can post at the entrances to the parking lot and prohibit carry on the whole place. Or they can post on the door to a single room and then carry is only prohibited in that room. So it is not above the realm of possibility that places that have a separate bar area could post just the bar area, but allow carry in the restaurant portion. The key is you can't carry passed a proper sign, but if there is a sign on the door to the manager's office then that doesn't make the whole place off-limits.

Well I think a 3Gs with the iOS 4 softward would be closer to a iPhone 4 than the 3G was to the 3Gs (if that makes any sense). But a 3Gs is $99...so if I was going to do that...would go a bit more and the the 4...

I can say for sure it is NOT July 1 The ones saying that are looking at the main bill and the amendments that were passed. As far as whether it was Friday night (which is my thought) or not until the Secretary of State assigns a Public Chapter number...still not sure and probably no one out there can give a for sure answer.

I can get a refurbed HTC Tilt 2 for free as an upgrade. I have a Dell Axim now (don't use it as much as I used to) so it would be sort of like putting my current phone and current PDA together...or get the iPhone 4. Of course the biggest difference (to me) is the price. If I had and extra $300...then no question. So will have to see what the wallet looks like between now and then I guess...

The NRA and Rep Todd have said the bill must be assigned a Public Chapter number by the Secretary of State before it goes into effect (which has not been done yet). Myself and few others on here as well as some media outlets think it was effective as of Friday night.
