Well whether one chooses to support a business owner that was opposed to pro-carry legislation may be a seperate issue but it is a worth mentioning when someone is looking to do business with someone. Why support those (if you have a choice) that don't support your viewpoint? I really can't tell for sure what your problem is..... If it is carry in crowded places...that could be practically any public place, not just resturants, whether or not the serve alcohol. It for sure sounds like you have a problem with people who may not spend their money wisely and/or bubbas/rednecks.....but that doesn't necessarly have anything to do with their ability to use a firearm. Some wanted resturant carry so they could be armed to and from the resturant and/or not have to leave it in the car...not necessarly planning on opening up fire in a crowded place or without a clear target. If you have faith in the laws....the law forbids those armed to consume. LEOs have not duty to protect you and may or may not be any more qualified with their firearm as HCP holder. How in the world would OC change any of this?

  6. Public Chapter 1009 see http://state.tn.us/sos/acts/106/pub/pc1009.pdf effective June 4, 2010 ammended T.C.A. 39-17-1359. The above supercedes what is in the free online version of Michie's Legal Resources This post will be removed once the update is made.

The veto SB3012 was overruled on June 4 this year and went into effect immediately.
  14. Yep...there is an AG opinion saying that landlords can prohibit renters from having firearms in the apartments/houses they rent. So not hard to believe that a business property owner could post their property despite the wishes of any tenants....
  15. To be able to carry when not working as a Guard you will need a HCP, I believe. However according to T.C.A. 39-17-1351(e)(3) if you have had that training within the last 5 years you do not have to take the state HCP safety course. So that may be what they are talking about....you'd still have to pay the $115 and show proof of the armed security guard training. So...yes you need the permit, but no, you will not need the safety class (as long as the training was less than 5 years ago).

  18. Well so many people ask if "place so-and-so is posted". This way they can check to see if someone has already been there and reported. I would like to see people note whether it's just "not posted" or if the spoke to and/or know the managers and if they have stated they "will not post" I'm not sure what the best solution is. I know TGODavid is working on a software upgrade. I may check with him about creating a seperate database for resturants and parks in addition to the current posted places database.
  19. ARRGGHHHHHHH......there is that term "Castle Doctrine/Law" again. Long story short...No, you can not have a loaded handgun in your car unless you have HCP. The Castle Doctrine does not mean the same thing from state to state. It is not some single law that a state adopts and then it means the same things. It is a group of laws dealing with firearms and self-defense, but can be and are slightly different from state to state. Some states do allow you to have a loaded weapon in your car without a permit, but TN is not one of them.
  20. To be honest with no one in/at the car at the time I'm not sure if there is a 100% correct answer... May depend on the officer. Of course if no on is around the car....why/how is anyone going to be searching through the car to find it? Now if she was in or around the car and you weren't...there could be a problem I guess.

  23. 39-17-1352 doesn't specify whether a permit is to be suspended or revoked on any specific offense. If suspened it doesn't say for how long. So in those cases I assume it is up to the DOS. So I figure the 3 year susspenion in 39-17-1321 is because the legisalture wanted a specific amount of time for that specific crime. So just because susspention, revocation or length of susspenion isn't mentioned in other laws, doesn't mean your HCP can't be...it just means that it will be left up to the DOS...at least IMO. But I agree that susspenios/revocation would be an additional penalty on top of a $500 fine...but not sure if the law/court system/DOS would see it that way.
  24. We have debated this on here before...I personally think you can leave a handgun in a car based on the bold part below. However some aren't so sure. There have been bills to help clarify this, but they haven't passed yet.. Now as stated the above only applies to the misdemeanor subsection © and not the felony subsection ( that is the intent to go armed part. http://www.michie.com/tennessee
