Are you telling me that a LEO can search a parked car, with a person sitting in it at a store, for no apparent reason? What happened to Probable Cause as a precursor to search and seizure? A woman sitting in the rider's seat talking on a cell phone to the grand baby is a reason to bust in and search? If the weapon is out of sight in a console or glove box, how does the LEO know there is a violation occurring? And as of this year, a non-permit holder can be in a vehicle, with an unloaded long arm, but, with ammo in proximity, just not in a clip, chamber or magazine. Your bare hand does not constitute a clip, chamber or magazine, and by Law, you can keep the ammo close if loose and not inserted in a clip, magazine or in the chamber.

Not trying to be argumentative, but, it appears that there is no difference in your house and your vehicle according to TN State Law with respect to where you are entitled to provide for self defense. ( (1) Notwithstanding the provisions of § 39-17-1322, a person who is not engaged in unlawful activity and is in a place where such person has a right to be has no duty to retreat before threatening or using force against another person when and to the degree the person reasonably believes the force is immediately necessary to protect against the other's use or attempted use of unlawful force. (2) Notwithstanding the provisions of § 39-17-1322, a person who is not engaged in unlawful activity and is in a place where such person has a right to be has no duty to retreat before threatening or using force intended or likely to cause death or serious bodily injury if: (A) The person has a reasonable belief that there is an imminent danger of death or serious bodily injury; ( The danger creating the belief of imminent death or serious bodily injury is real, or honestly believed to be real at the time; and © The belief of danger is founded upon reasonable grounds. Section 1 © © Any person using force intended or likely to cause death or serious bodily injury within a residence, dwelling or vehicle is presumed to have held a reasonable belief of imminent death or serious bodily injury to self, family, a member of the household or a person visiting as an invited guest when that force is used against another person, who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence, dwelling or vehicle, and the person using defensive force knew or had reason to believe that an unlawful and forcible entry occurred. Correct me if I am wrong, but I see nothing in the Public Chapter that requires a permit to avail a Citizen of the coverage of this Law, and, I see no differentiation in a person's home or vehicle, no more duty to retreat put forth regarding your vehicle than at your home or curtilage? It would seem reasonable that if a HCP holder was required to leave his weapon in their vehicle for a short period to satisfy the Law re a posted business, that the weapon is under their control in their vehicle, and not some other person in the vehicle any more so than at their residence.

If possession via proximity were the sole criteria for prosecution , would not a loaded handgun in a home during the permit holder's absence be the same thing if a non-permit holder was present (i.e. wife, girlfriend, parent)?

Needs to be an issue we work on in the Legislature. I find it ludicrous that in a vehicle I own, I can not leave my loaded weapon locked up inside with my wife there. Seems the only time it would be an issue is if she had to use it, and then TN statues say there is no prosecution for defending one's self. If I am licensed to carry, and a posted sign precludes my ability to carry inside someplace I need to be, I can't see the sense in making the wife stand outside the car while I go in, and if you can, you obviously do not know my wife. What do I have to do, take her set of car keys away and make her stand in the rain, snow or heat in a parking lot while I go inside a posted place, (Dr.'s office, school etc.)? As it would be legal to give her a shotgun with an open breech, and let her hold a handful of buckshot, it seems this is a little beyond the pale.

To do what? Construction employment is down significantly, there are no manufacturing jobs coming open. Just what is it that Republicans want cheap labor for? With unemployment at the level that it is, and the number of good 'ol American Citizens out of work, just what do we need illegal immigrants to do? I do not know a single Republican who is in favor of allowing more illegals in, and I know several. Maybe back when housing was going strong, or factories being built, but I think that old saw has gotten a little dull as of late.

Depending on who winds up as the Speaker of the House, that may change dramatically next year. Just look at what the move from Naifeh to Williams accomplished. Speaker sets the Committee rosters, does he not?

If you consider the Tea Parties as "political connections" then I guess you are correct there, but I do not believe one has to be a mindless Dem/Rep minion to have a shot at a County or State office. I am seeing ground swell type campaigns that are being very effective this year. As for "name recognition', there are differences now than what the status quo has been. I am involved in a couple of campaigns where the candidate is going against conventional wisdom (no prior political experience), and the local established party "machines", doing it on the cheap and I guess we will just have to see what the results are.

I am ecstatic because I have my guns, both for hunting and protection. I hunt deer because my wife has a serious health problem, and needs a high protein, low fat, very low cholesterol diet, which venison fits very nicely. I have my guns for protection because a lot of good men died to make sure I can, and only a fool would imagine that the personal ownership of firearms is anything other than absolutely necessary to security. I am pleased as punch that the Birthday of this Nation approaches, where we celebrate the actions of men who desired Liberty, and bet all their goods and their very lives to bring it into existence. No, he gets to carry in his establishments regardless. As the Owner, he is not under the same restrictions that the patrons are, he, and any one he names as responsible for 'security" can carry without needing a permit, or going through a background check. It is just us average 'ol citizens that he does not trust to know how to act.

As the parts and pieces of the "Health Care Bill" come to light: I have been able to put $7K a year into my FLEX Medical account, as my wifes medications cost in the neighborhood of $28K per year above what our insurance pays. New rules from the Gov. limit that now to $2,500.00 a year, so I get to pay tax on an additional $4.5K. This thing is really going to work for me! Plus, I got a letter from my Employer telling me I will be paying income tax on his portion of my Health Care, which will be an additional $17-20K. I am so happy I could, well, you know!

strickj, how does one get experience to earn your vote? Does Class President or President of the Student Body in High School count? HvyMtl, did you watch any of the Legislative sessions? If some of the State Legislators I saw have "Political Connections" I would say they must be pretty dense. This mentality leaves us with only the people we have there now. Capbyrd, you would need to build a coalition, get out and talk to folks. Find people that see things your way and get them to help campaign, talk with the party of your choice and let them know you want to run for a specific office, and then file for the Primary in the race of your choice. Start a full year+ ahead of the Primary. We elected a first timer to the County Commission, this year in Madison County. I think the time is ripe for new voices to be heard. Be prepared to have you life picked apart, yours and your family's, and you friends. If you can stand the heat, go for it!

If everyone obeyed the law, we would not need them big 'ol jail houses. Anybody that thinks just because the law says you can't have guns needs to check out Chicago or DC any hot Saturday night. Long ago, and not so far away, I spent quite a bit of time in places that sold alcohol, among other things. A lot of them were built on stilts, and sat close to water. Each place had a couple of guys that had some iron about them, and you learned early to be polite if you did not want them to place them up side your head with some force if you chose to not abide by the rules of the establishment. If required, they would adjust the type of use. They liked your money, they did not like lip or trouble. They did not drive squad cars either. Fast forward, pretty much any place that serves is going to have a few people who care not one whit for the rules and regulations, and if you think a "Law" is going to filter that type of individual out, I have some land for sale.
