  3. IANAL, but I think it would be best for armed person, to either have the weapon on their person or in a place that only they have access to. If it is in a location where someone else has can get to it, then it can be argued they have "constructive posession" of it. Sort of like when the dope is in the center console and no one claims it, then the driver and the front seat passenger can both be charged with posession of it. Not to say that all would be charged, but if being detained is of a concern to you, it could definetly add to the length of that I would say.
  4. What difference does it make how much beer is in the boat as long as the person armed is not consuming? ...or are the anti-restaurant carry people right and firearms and alcohol just can't be close to each other period?
  5. From Post 62 it passed. Unlike other states, I don't think there is any provision in the TN law for the stae to help if the Feds charge you.
  6. IMO improper concealment is worse than OC in someways. If you really think people are going to panic and/or it draw attention if you OC, don't you think the sight of a "hidden" weapon would cause the same, if not more, "panic" than if it is already just in plain sight? I'm not saying that OC is better, but just feel that if you CC then it should be done well enough that no one ever knows.

  10. I have thought of doing the same thing. Nothing says you have to display the US Flag, so if you choose to do so, I fell you should do it properly.

  12. If you are sued in civil court by a person you shot and it is ruled as a justifiable shoot, you can recover (which means you pay and then get back from them) any expenses in defending the suit. There is no protection in TN law for the expeses incurred in defending yourself in a criminal trial if you are found not guilty. Also if you injure and innoncent 3rd party or cause 3rd party property damage there is no protection in a civil suit.
  13. I do feel obligated to protect myself and my family. I do this in part by carrying 99% of the time in addition to other measures. I do not feel an obligation to protect others, but that is not to say I would never get involved.
  14. Goes back to the trouble that there are no "bars" and "nightclubs" in TN. Also if you try to prohibit carry in places "where the main fare" is serving alcoholic beverages, that could be seen just as vague as what was struck down. Although granted I doubt it would be challenged.

  16. It seems only those programs for drugs and alcohol are mentioned, not those for sex.
  17. I tend to agree....it seems like any drug "rehab program" would qualify, especially one that where someone was in-patient. However I also agree that it is very unlikely that it would show up on any background check done by the FBI/TBI.

  20. The city I live in does as well. But the don't run any DL information until the LEO ask for it.

  22. You may have missed his point. I think we've always known a LEO had access to see if someone had a HCP. But he is not going to have that knowledge just responding to a call. The only way to know is to run a check on someone's Drivers License. When I worked in 911 it was not routine to run someone's DL when an officer was responding to a residence. Besides going to residence there could be weapons even without a HCP since it is a private residence. You have know way of knowing the names of everyone there. Of course the dispatcher always ask if their are any weapons involved or their. But again, responding to a 911 call it is doubtful that information is going to be checked. I think he posted this to try and clear up the misconception some have as to whether HCP info is tied to your DL or your car tag. ...and as said it is connected to your DL. Now one thing to remember is there are many other ways to check a DL besides just the number on it. If a RQ (Registration Query) or 10-28 in most 10-codes is run on a tag, the dispatcher/LEO can take the name an address received on it and run a check for a DL (DQ) on that name an address. If he does that, he will know the registered owner of the car has a HCP. But in my experience this is fairly rare. Usually the tag is run when the officer makes a stop and the DL is only run after the officer makes contact and decides to run it or not.
  23. After I've thought about....who goes in to banks that much anymore anyway? I mean with direct deposit, ATMs and online banking.... Even when I bought my truck a lot of it was done over the phone, stopped by for about 5 minutes to sign the paper work that was already printed.
