So I go to the La Vergne PD...
Fallguy replied to E4 No More's topic in Handgun Carry and Self Defense
That's about it....can carry in a courtroom during a county commision meeting, etc.. Couldn't legally carry in a hospital room (or any other room) if there was a hearing going on at the time. -
Was pretty wicked Good question...

Don't think there is any 100% clear cut answer either way. If the LEO thinks you are interfering with performance of his duties, then yes you could be told to at least back off enough so as not to interfere. If you not interfering and are in a public place, don't think you can lawfully be ordered to leave the area, minus any other extenuating circumstances, such as breaking a law by being where you are. Of course on a traffic stop, one extenuating circumstance could be you (being the one in a second car) could be illegally parked and therefore you have no legal right to just sit on the side of the highway. Most emergency lanes are for just that...emergencies, break downs, etc... Or if you are on a road with no emergency lane, you could be a traffic hazard by being stopped on the side of the road. But if you are in a parking lot and are staying back and not bothering the LEO then that may be a different story. These are just my personal opinions on the matter and not based on any legal training or direct knowledge.......

It's free to get the change of address kit from your local post office as well. Have done it twice in the last year. It also includes some good coupons...so it actually pays you....

You don't have to have a permit to carry any firearm on your property, period. -

I can't remember which state it is that has the gun locker law....and it actually applies to any and all places that post against carry, but I also remember reading it is not really enforced. -
If you meant changing the address on your HCP and/or DL (which is what I thought you meant) you can do it online here https://www.tennesseeanytime.org/chgdl/ As found in this TGO thread http://www.tngunowners.com/forums/firearms-law-faq/21586-tennessee-handgun-carry-permit-change-address-duplicate-copy.html If you change your address online you will not get a new HCP or DL. At the end of the process you are given a chance (one and only chance) to print out that you have changed your address. That print out along with the DL and HCP you have will work. Depending on how close you are to renewing each, I wouldn't worry about getting a DL or HCP with your new address on it. I'd just wait till you renew and you'll get one with your new address at that time. But if you want to order a new DL you can. https://www.tennesseeanytime.org/dupdlr/index.html To be honest not sure if you can get a duplicate HCP online or not. Or you can go to any DL station and tell them you want to change your address.

Wasn't planning on a drink, but this thread has made me reconsider. Maybe some Jack and Coke with a good cigar..... -
As has been said and we all know...you can use deadly force if you are reasonably in fear of your life or serious bodily harm. If it goes to trial, there are going to be many other factors the jury will consider besides just whether the other person(s) was armed or not to determine if they feel it was reasonable.

Because cops don't have enough to put up with on a daily basis already, and desire to make more of it for themselves right? Seriously? You really believe that? You honestly think that cops go around making crap up so that they can get hammered by Internal Affairs later? Not sure if LEOs try to bluff citizens they know are acting lawfully often, but it probably does happen some. I believe LEOs mainly try to bluff citizens when they aren't sure of the law themselves and/or don't want to admit they are wrong or check to see if they maybe are. Most LEOs are not going to tell someone they made a mistake. So it is better to get the citizen to comply with some demand, like giving ID, leaving the area etc... rather than just backing off after engaging in an interaction. To this LEOs credit he did back up and apparently get clarification, that OC without a permit is legal in NC and that a person is not required to produce ID. Not very many LEOs I've known or have dealt with would have done that, they would have kept demanding ID or making other request, until the person either complies or gets upset and then get them for disorderly conduct. However....the LEO did not come back and tell the OCer he was right or acting lawfully....of course he had no obligation to either I admit. -
The state requires the class to be 8 hours long. Yes, depending on the size of the class, teaching just the basics does not take near that long.

Yeah, but if you could OC without a permit, you could carry and save a total of $200+ I don't think you should have to have a permit period to OC or CC. Has worked for VT and AK. You can OC at the age of 16 in VT. I think the state should have to prove you are disqualified, for whatever reason, to carry...not you have to prove you are. But that's just me..... -
I think a lot of people forget the course is called Handgun Safety Course. I believe the main point of the class is supposed to be how to safely handle a gun. I think when the state came up with it, they were thinking that people that have never even handled a gun may be getting a HCP and this course would help them with the basics of handgun safety. Comparing it to driver's ed is not a bad comparrison....you by no means know all the traffic laws or have superb driving skills after that course, but you know the basics well enough (or should) to get your DL. It is then up to you to learn more and develop your skills. As far as displaying your weapon....I wish TN would pass a law like AZ recently did AZ Chapter 183
-
FWIW it appears http://www.michie.com/tennessee has been updated with the new laws passed so far this session.
-
But that doesn't really explain why the applications ask Why you have it.... To me just the simple truth would be the best, So I can legally carry a handgun.

NM: Judge tell police to leave OCers alone
Fallguy replied to Glock30Owner's topic in 2A Legislation and Politics
Good post TMMT In TN an agency can hire and officer and doesn't even have to send them to the academy for a year. Now I'm sure Nashville (who has their own academy) and Memphis may not put officers like that on the street, but the majority of other places do. So at any given time there are several officers out there around the state that have basically had NO training in what the laws are, other than what other officers have just told him. In smaller departments, they are lucky if another LEO is on duty period, let alone riding with a training officer for a year. Also gun laws are fairly simple in IL right?...No citizen can carry a handgun period. So not a lot of finer details to know. The reason more citizens don't make complaints is they can put their complaint if file 13 about as quick as the department can. -
I you are stopped out of state......
Fallguy replied to DUXBUSTER's topic in Handgun Carry and Self Defense
Each state's database and system is different of course. It's been about 10 years since I was dispatching, so that is what I was going, but admit things could have changed. TN law says they will recognize a "facially valid" permit from any other state. Sounds like they are considering there may not be a way for a TN LEO to run a computer check on an out of state permit. I guess some other states may be the same way. -
First thing I'd do is not mention there is a firearm in the vehicle. If the driver doesn't have a HCP, as a passenger I don't think I would volunteer that I did. I'm assuming the driver doesn't have in your situation since if he did and is sober enough to drive, he could carry your firearm...remember no limit on the amount of firearms someone with a HCP can carry.

It may be true that if you run a Georgia DL in Georgia that it won't show if the person has a Georgia permit, but I'm 99.9% sure that if you run a TN DL in any state it will show your HCP status to the agency that ran the check. As was said before your TN DL and HCP number are the same...as I'm sure you know, when you run a TN DL it just simply has a line (just like a line for Name, Address, DL Class....) for Gun Permit and it say Yes or No I always check http://handgunlaw.us before going out of state to see if a state is a must inform or not. -
State parks have been legal to carry in since 06/12/09 when the Governor signed HB0716 into law. Public Chapter 428 There may still be signs that say firearms are prohibited but it does not apply to HCP holders.
