  1. I believe OhShoot is right. This would seem to be even backed up in the AG opinion about carry in parks where school activities were going on. The AG said the HCP holder could store their weapon in their car during such events and he cited 39-17-1309© when he said that.

  3. Got a phone call from Rep Todd this evening. He had legal check and they said they cold not find any case where "substantially similar" has been defined or ruled upon as used in 39-17-1359. We talked about getting an AG opinion, but both agreed that based on previous AG rulings he doesn't seem to be on "our side" so could be worse off than we are now. I think he said he is going to talk with someone about it a little more, he just wanted to get back with me. I have to say I have always had good dealing with Curry. I don't live in his district but he has always got back with me in some form when I have contacted him. Anyway....just thought I'd pass this along.

  6. http://www.handgunlaw.us/states/arkansas.pdf AR is Must Notify to LEOs Off Limits places: (1) Any police, sheriff's, or Department of Arkansas State Police station; (2) Any Arkansas Highway Police facility; (3) Any buildings of the Arkansas State Highway and Transportation Department, or onto grounds adjacent to such buildings, except that this subdivision (a)(3) shall not apply to rest areas and weigh stations of the department; (4) Any detention facility, prison, or jail; (5) Any courthouse; (6) Any courtroom, except that nothing in this subchapter shall preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his courtroom; (7) Any polling place; (8) Any meeting place of the governing body of any governmental entity; (9) Any meeting of the legislature or a committee thereof; (10) Any building wherein a state office is located; (11) Any athletic event not related to firearms; (12) Any portion of an establishment, except a restaurant as defined in § 3-9-402, licensed to dispense alcoholic beverages for consumption on the premises; (13) Any portion of an establishment, except a restaurant as defined in § 3-9-402, in which beer or light wine is consumed on the premises; (14) Any school, college, community college, or university campus building or event, unless for the purpose of participating in an authorized firearms-related activity; (15) Inside the passenger terminal of any airport, except that no person shall be prohibited from carrying any legal firearm into the terminal if the firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft; (16) Any church or other place of worship; or (17) Any place where the carrying of firearms is prohibited by federal law. (18) Any place where a parade or demonstration requiring a permit is being held, and the licensee is a participant in the parade or demonstration; or (19) (A) Any place at the discretion of the person or entity exercising control over the physical location of the place by placing at each entrance to the place a written notice clearly readable at a distance of not less than ten feet (10¢) that “carrying a handgun is prohibited†( (i) If the place does not have a roadway entrance, there shall be a written notice placed anywhere upon the premises of the place. (ii) In addition to the requirement of subdivision (19)( (i) of this section, there shall be at least one (1) written notice posted within every three (3) acres of a place with no roadway entrance. © A written notice as described in subdivision (19)(A) of this section is not required for a private home. (D) Any licensee entering a private home shall notify the occupant that the licensee is carrying a concealed handgun. ( (1) In addition to the places enumerated in this section, the carrying of a concealed handgun may be disallowed in any place in the discretion of the person or entity exercising control over the physical location of such place by the placing of a written notice clearly readable at a distance of not less than ten feet (10') that the "carrying of a handgun is prohibited." ( 2) Provided, no sign shall be required for private homes, and any licensee entering a private home shall notify the occupants that he is carrying a concealed handgun. © No license issued pursuant to this subchapter shall authorize the participants in a parade or demonstration for which a permit is required to carry a concealed handgun. "Restaurant" means: any public or private place, without sleeping accommodations and that place: (A) Is kept, used, maintained, advertised, and held out to the public or to a private or restricted membership as a place whose primary function and purpose is to take orders for and to serve food and food items; ( Actually serves full and complete meals prepared in a fully equipped and sanitary kitchen and prepared from uncooked foods for service to and for consumption by its guests or members on the premises; © Has a seating capacity of at least fifty (50) people; (D) Has employed a sufficient number and kind of employees to prepare, cook, and serve suitable foods to its guests or members; (E) On Sundays, serves alcoholic beverages on-premises only, in conjunction with meals; (F) Serves food on all days of operations; (G) Maintains separate sales figures for alcoholic beverages; and (H) Has gross sales of sixty percent (60%) or more from the sale of food, food items, and nonalcoholic beverages, or, in the case of excursion boats, has gross sales of sixty percent (60%) of their gross income from boat rental fees and sales of food and nonalcoholic beverages.

While I agree with you on the difference between Fed Ex/UPS policy, what is posted on the ATF site and what the USC, *Title 18-Part I-Chapter 44-§ 922(e) actually says on when notification is required, the USC does say that notification is to be written when it is required and not verbal. * - US CODE: Title 18,922.   12. I agree all the speakers were great, and the County Mayor seems like very common sense type of guy.
  13. I believe that is the bill. Not sure if they can...but they may just move up the part actually doing with the credit card part and let the National Park carry wait till Feb '10. But definitely ought to be watched.
  14. The resolution was tabled by an 18-0 vote. According to the county mayor since it was not removed from the table in this meeting it is done and the issue would have to be introduced from scratch again. He didn't think that would happen. Was good to finally meet you Worriedman.

  17. It is not all about money. There were several other good reasons. You may have noticed more spam if it was't for admins/mods trying to keep it clean. However I don't feel it is up to me to list all the reasons, the TGO David can if he wants to. But becoming a benefactor is neither required or expected to enjoy the forum in general. I simply like the forum so much that I wanted to contribute to make sure it keeps going. This was before I was a Mod and I have never posted anything in the Trading post section.
  18. In TN possession of a firearm in your car or boat is NOT like possession in your house. You do not have to have a permit to posses a firearm in your house, you do have to have a permit to have one in your car or on your boat. (Unless either is acting as your residence at the time, I don't thing kayaks, bass boat or the like would ever qualify as your residence) Regardless of what any signals for distress may be.....that doesn't mean it is lawful to posses the firearm. Just that if someone has one (legally, preferably) those are signals they can use. I really hate the term "Castle Doctrine/Law" It is really just a general term for the collection of firearm and self-defense laws. It means different things in different states and sometimes even in different situations within the same state. Just because you say TN has the "castle law"...doesn't mean every law in TN is the same as every other state that has the "castle law" Now one way you car or boat is like your house is that if someone forcibly and unlawfully enters either, the law would presume you are in fear of your life or serious bodily harm.

  20. Sounds like the statement of a worker....I know most managers (whose bonus is based on the income/profit of the place) don't care how late or how many people come in. Or for sure the owner...(as noted in the post from nearly 2 months ago that I think you are talking about) What's the difference between a group of 20 and 20 individuals that happen to come in at the same time? Yes, it is very inconvenient to have to cook large amounts close to closing, but you are open until you are open. You shouldn't expect to not have to cook and serve food till after closing.

  22. Not only music venues....but within the confines of the building of any venue that serves alcohol, if they are not a restaurant per 39-17-1305©(3)(... So while it would be a bit of a gamble....this is why I hope if we lose the lawsuit the legislature comes back and simply makes a general exception for HCP holders regardless of the type of business or simply repeal 39-17-1305 all together. Which I know is a long shot on both accounts....

Doesn't really matter, the law says it is illegal to carry within the confines of a building (doesn't say what type of business has to be conducted in the building or anything about the amount of sales) that sells alcohol for onsite consumption. Unless they are a restaurant as defined in 39-17-1305
  24. Wish I could go Friday. I don't get off work till 7:00 Friday morning....no way I could make it to Nashville by 9:00 and last time had to be in the courtroom nearly 2 hours before the hearing just to get a seat.
