I don't think it would be legal. The law says you can't carry on any Public or Private school grounds. So not sure how they are funded or how students get money makes any difference. There are a few exceptions, getting permission for an administrator is not one of them. He can't legally tell you to carry a handgun anymore than they could tell someone to carry drugs. It is a state law and he doesn't have the authority to bypass it. Know if they want to pay you as "private police" officer...then under 39-17-1309(e)(6) you could carry. -

Oh I understand....was more of just a playful suggestion. Just tell them you want to post a sign stating your policy on firearms. They may think you mean a 39-17-1359 sign...but if they don't ask...

True, but state courts do take notice of rulings in other states even if they are not bound by them.

If you are speaking of the guy in the video from NC.....the open carry of handgun without a permit is legal in NC. It doesn't require you identifing yourself or having a permit any more than carrying a basketball with you. Now if you are in TN, that is 100% correct, you must have your HCP on you when armed and present it to the officer. However I'm still not sure how if you are just standing around, not driving, not being armed but not having goverment issued ID could be seen as interfering with police duty. Even if he suspected you of a crime...again all you have to do is identify yourself, by verbably stating your information. As EMTRN said it would make it easier of course to have a DL. You're right this thread isn't about about the video, but I was scolded rather well when I told I shouldn't respond if I didn't know what I was talking about....so I just wanted to get clarification on everything (like having ID) that was being talked about.

I have to agree, if you are not going to inform...and that is ok with me, then I wouldn't store documents you may need and the handgun in the same place.

Wow....and you are the one that told somone else not to be so smug. Maybe I misread the post...if so, my bad. In the mean time I'll be waiting to see the law that requires all of us to carry ID to be posted by those who better know what is being talked about.....

You are not required to carry ID in all states. AFAIK in TN there is no law that requires you to carry govement issued ID. If there is, I would like to see it. If you armed - you need a HCP, If you are driving - you need a DL, If you are checking out a book - you need a library card, but just standing on the street corner - you don't need any ID. As was posted in another thread TN does not have a stop and ID law. But even if you were required to ID yourself, verbably giving your name, address and DOB is identifiying yourself. It would seem you may be the one that can't read...jth_3s said he wished the officer would leave it where he could get to it...not just see it as David said.

IMO...No. What if something would have happened where you needed it while on the way back out to your car? I acknowledge that it could have been dangerous to reload it in the store, but so was removing it from you and unloading it.

Of course I would have complied as well. But in all honesty, while I don't want to do anything to alarm an officer, easing his concerns and worries is not is not my main concern. Especially irrational (not saying that was the case in this case) worries and concerns. I mean it would ease the concerns of some in Nashville/Washington D.C. if we weren't allowed to carry or even own firearms. Of course I don't want to do anything to cause me to go to jail, but at the same time doesn't mean that all actions by those that would take you are correct either.

While I admit I think the OP is making a slightly bigger deal out of this than need be......there are some somewhat valid points being made IMO. First, Yes, the law does say a LEO can disarm a HCP holder if he feels it is needed for the officer's, HCP holders', or the public's safety. If this is officer felt that...then ok. I also agree no one can really know what he felt. But....how many agenices do instruct their officers to or indvidual officers simply disarm EVERYONE? I feel (have no way of knowing) the intention of the law was to allow LEOs to disarm those they thought might cause a problem....not to disarm EVERYONE. Also....I have to say...I would hate to see ever see it "common place" to simply hand over your firearm because a LEO wanted it. Granted in some cases it may be necessary, but in others it may not. I think the OP once he has learned there is a law that allows it, is not so much faulting the officer, but the law and maybe the officer's/agnecies inturpriation of it.

The check when you get a HCP is run through the FBI and TBI The check when you purchase a gun is done through TICS which is a point of contact for NICS. TBI Instant Check System So in both casses (HCP and Purchase) you are being checked on a state and national level. But as I said the trouble is....a check may or may not be run on a HCP renewal, but if it is, it is only every 4 years.

If you can afford it, then that's fine I guess. Because your lawyer is not going to work for free. Also you will see very little, if any, money from them. Just to note...I don't like seeing lowlifes winning frivolous lawsuits either. -

I think you are mixing two different things. Criminal Charges and a civil lawsuit. The state will only be involved in any criminal charges filed against someone. It could be the shooter and/or the person shot depending on what crimes the DA thinks either or both of them may have committed. As far as a civil lawsuit....anyone can sue anyone else for just about anything. But that would be between the private parties, not the state. As far as the shooter suing the BG and family....for what? Even if a lawyer did take the case, to what benefit? ....you really can't get blood from a turnip. -

Are you really serious? First a citizens rights should always be foremost in an officer's mind. I know the seldom are...but they should be. But legally he is under obligation to observe the person's rights....or he may be the one in trouble at a later point. Officers in states where the Open Carry possession of a handgun is not a crime, should consider that is the very scenario at play when someone calls about a MWG. That is not to say they do not need to be suspicious and careful, but they need to remember it is very possible that absolutely no crime is being committed. Have you seen the video posted in another thread where a person is OCing in North Carolina, is asked for ID, refuses...and nothing happens? There are also other videos of people from other states of people doing the same thing. So while I may not always recommend it (and never would in TN), OCing and refusing to show ID doesn't always mean a face plant and getting handcuffed in all states. At least not if it the incident is being recorded....one reason many OCers carry some type of recording device. If it does happen I hope the officer is reprimanded by the judge, as in this case, and eventually LE gets the word. -
Yep doesn't work that way in TN. One reason is the check for a HCP is only run every 4 years when you renew (if then). In the states where a permit allows you to bypass a check at purchase, a check is run more often I believe. At least once a year if not more often.

I probably wouldn't carry there....but there is some question about the agreement that Alcoa, Marryville and Blount County have on the operation of the parks. The law says if parks are jointly operated then all governments, individually, must vote to ban carry before it is banned. While apparently Alcoa and Marryville have done this, Blount county has not. The question now is whether the parks are actually jointly operated or not.
