  2. It is not against the law in TN as long as you have permit. Different states have requirements of it either being visible of concealed in a car, so that might be the source of your friend's confusion. I usually just keep it on my person...addmittelay it would make it hard to draw while I'm still sitting in the driver's seat. Sometime I place it in the center console.
  3. Great post jackdog!! I'm with you on the law. If it was must inform, I would do it have no problem, but is is not. So if a HCP holder chooses to be courteous by informing immediately, fine. But if one does not then there should be no repercussion. Also kudos to the trooper for coming around. I would not, situations like this is exactly why I no longer have my HCP behind my DL but way back under other cards.
  4. As I stated in the liquor store post...the biggest problem with these types of signs is the law still requires them to be posted. Apparently this law was never changed when carry was allowed in places that sell alcohol. Also I have seen nothing in any of the restaurant carry bills that address changing 57-4-203 this time. Glad to see Chef Lin's position!!
  5. Overall not a bad interaction. Good deal on educating them on the law. One problem is the ABC still requires places to post a sign that says it is illegal to carry firearms in a place that sells or serves alcoholic beverages. Saw one at the bar at Logan's in Jackson a couple of weeks ago. So no wonder there is confusion. This is also a good example of why it is better to conceal well or open carry IMO. However I admit, when I CC I don't always worry about 100% concealment. But I think a handgun that looks like it was trying to be concealed, but becomes exposed obviously causes more trouble than one well concealed and maybe even more than one carried openly. Of course OC in general and especially in a liquor store will probably require an immediate explanation of the law, that you have a HCP, etc... I would go back.....if it appears they are going to always be anti-carry period....I may go elsewhere, if that is an option.

  8. Yes, I know that Jackson-Madison County General Hospital is posted per 39-17-1359. But I thought you said ANY publicly owned hospital is posted and/or off-limits? All public and private hospitals CAN post, per 39-17-1359. I just wondered if you meant all were and if so how you knew. Also was asking if you meant they were off-limits just because they are a hospital (which they aren't) or if you meant by 39-17-1359
  9. Are you sure all publicly owned hospitals are posted? But...a 39-17-1359 posting is the only way they would be off-limits, there is not a statutory prohibition.

  12. Actually if it is expired less than 6 months, you can still just do a renewal, but as the OP said, you can not legally carry until you get your new permit. To the OP, I'm not sure if the lady signed your wife's on purpose or out of habit...no way of knowing for sure I guess. But if I was you guess I couldn't help but to wonder too. If an officer looked closely at the paper work and her old permit...she might not be considered legal, since it would show a renewal date after the expiration date on the permit, regardless of what was signed. But doubt many LEOs would make a very big deal over what might be considered a clerical error.
  13. Yes... The "recreational property" thing is property owned by the government. Here is a thread about carry on TVA waters, it is legal, there is even a copy of TWRA letter stating it is legal.

  17. I hope so...on both accounts. Believe me...I am not stocking up on ammo, getting a bunch of tinfoil or looking for a group of guys in the woods to join up with. I just think things could be much better and they have been going down hill long before Jan 20, 2009 or Nov 11, 2008.
  18. I really didn't mean to start anything about the exact wording of the oath. the UCMJ or the like. It just seemed to me that some where trying to remind others, the military could/would be used against domestic enemies. So I was just trying to say IMO those that may oppose operations of the government are not necessarily automatically domestic enemies by the standards of the constitution.

  20. While I am not suggesting any specific course of action. I do feel the "leaders" in Washington are just as out of touch with the "people" as the crown was with the colonies 200+ years ago. As far as the oath mentioned...remember, it is to defend the constitution, not necessarily to blindly follow the orders of those above you. I personally think that those in D.C. are much more violating the constitution than anyone that might seek to remove them from office. But I agree David is overall right about the best course action to deal with things...even if it will take longer.

Yes TN law says they will only issue permits to residents 21 and older, and that you have to have a permit to be able to carry ..but, TN law also says they honor all other states permits and doesn't make a distinction about age, but does other things like that is it good for the carry of handguns only and not other weapons or other whatever else the permit may allow in the home state. So since they did place restriction on out of state permits, you would think that if they intended age to be one, they would have included it. Of course since this is out of state residents normally wouldn't be staying in TN for a long period of tiem.
  23. 39-11-614 says you can not use deadly force to protect property. So if you were in a situation where you were proctecting your life and maybe also your property (carjacking) an over zealous DA could charge you with using deadly force for protecting proprety, even though you were also in a self-defense situation. The bill prevents a DA from being able to charge for using deadly force while protecting property if you are using deadly force as would otherwise be allowed by law...(self-defense)
