  13. Sort of like you can be charged with DUI even if the car isn't moving...as long as you have the keys and have the ability to make it move, you are the operator of the vehicle.
  14. True, but you can use deadly force to prevent a carjacking. In fact a car is just like your house in the sense it is presumed you are in fear of death or serious bodily injury. Also the website you post is wrong about places that are off-limits. You can carry in Airports, unless they are posted, you can now carry in Federal Parks, you can carry in public facilities...just not public recreational facilites.
  15. I would say that is different then, than if a church runs a school or if there is a chruch on the campus of a school.
  16. The law actually says you can't carry anywhere on campus, not just the school building.
  17. I believe he means Which is basically saying you can not be charged or convicted of any 39-17-13XX law (which includes all off-limits places) if you used your gun in self-defense. Just a note...there is a court case that basically renders the "charged" part useless if the officer does want to charge you. The court ruled that since the law mentions being conivicted...you could/would obviously have to be charged first. The court also said that "justifiable self-defense" is something to be determined at trial and not by a judge at a pre-trial hearing.
  18. Glad I didn't watch it...lol Sontany and Camper in the committee and sub-committee get me fired up enough without watching Naifeah on the house floor. Guess it is just hard for him to realize he isn't the end-all-be-all decision maker anymore....
  19. Actually technically that wouldn't be a school, unless they had the proper documentation etc... from the State Dept of Education. Just because "teaching and/or instruction" goes on someplace doesn't make it a "school" by law. What is I meant is...President XYZ High School, is off limits 24/7 even if there are no students, there is a county wide yard sale going on or whatever. That as far as 39-17-1309 goes, it is still a school.
  20. This has been discussed before here, but since it is over a year old, I'll let this thread continue. The short answer is NO. A school is a school 24/7. It also doesn't matter if the school is private or not. The law just says schools, it doesn't distinguish between public and private.

  22. LOL... I don't go out to eat often, but every time I have...I've been out of there before 11:00pm To really I don't like the part about not being able to drink. There is already a law against carry while under the influence. I mean if I leave the gun in the car, go in, have a couple of beers with my steak, come back out and rearm and drive off (legally)...what is the difference than if I had been armed all the time? Well...the difference today at least is...the bill would not pass without there being a restriction on drinking (that will probably never be removed) also it would not pass without some attempt to show they are trying to keep guns out of "bars". However, the TFA keeps saying that a clean bill has passed in the Senate for the 3 years...and that maybe some or all of the restrictions could be removed in a conference committee, but who knows....
