OCing in Walmart in Hendersonville, Tennessee??
Fallguy replied to a topic in Handgun Carry and Self Defense
What would you be arrested for? There is no LAW against OC. Now Wal-Mart of any other place can say they don't want you to OC. To either CC or leave. But you have broken no law, only their policy. The only way you could get in trouble is, if they do ask you to leave and you don't, you could be charged with trespassing. -
According to the TN AG they do. TN AG Opinion 07-148 Question 7: Can a property owner regulate the manner in which the holder of a valid handgun carry permit may possess or carry his or her handgun on the owner’s property? Answer 7: Yes. A property owner has the right to regulate the manner in which the holder of a valid handgun carry permit may possess or carry his or her handgun on the owner’s property. In exercising such right, the property owner may allow a handgun carry permit holder to carry the handgun concealed but not openly, openly but not concealed or in any other manner that the property owner deems appropriate.

I agree...I have been on other boards and they complied all the threads on "Hot Topics" like this, made one sticky thread and then locked it. That way if someone wants to look back or a newbie wants to see all the discussion on it they can...but no real need to keep posting the same stuff over and over and over and over...

Ok...I searched.... I found sever statutes that mention a badge. Many of them say the badge must have info on it that identifies the person. So...the badge itself is not identification. You can get a badge that says Chicken Inspector if you want...and that wouldn't mean you are impersonating a LEO. Here is the one law you may have been speaking of But OCing by a HCP holder is not going armed for LE purposes and a badge that says Handgun Carry Permit on it is not a badge that identifies the person as a LEO.
-
You are the one saying it is a law...if this is so, you should be able to point me to it, not me have to search for it. I agree...it is up to officers discretion as to make an arrest, but it is up to the judge or jury to convict. But...I have forgot there could be LEOs out there with enough of a complex to go around and arrest law abiding citizens for S&G's However just to be clear...as I said before...I do not think wearing a badge is good....if you want to carry a weapon, open or concealed and you have a permit..that is all you need...you don't need a badge. But, I don't think they should be illegal, and I don't think any reasonable person would think wearing one and OCing (and nothing else) would be impersonating an officer.
-
I curious too.... I think it would take some more overt action than wearing a badge and OCing to be charged with Impersonating an officer. I agree that many that see that may think you are an officer, but that doesn't mean it meets the legal definition. Also what is the TCA code that says it is legal for LEOs to wear a badge or illegal for non-LEOs to.

Replied....

Ah yes....the shorts...I really miss the gal that used to deliver to me before I moved.....

I think you are right....HB0053 was more than likely withdrawn because it didn't have a Senate companion bill. So HB0221/SB0172 would be the one to call your legislators about now.

I tend to agree....at least 100% of the time. Now depending factors of who it is, time of day, stated reason of knock etc... I would say there are times I would have mine at the ready, but probably not when the UPS guy is knocking when I expect a package.

Here she is from a different, angle...regulars of the show should remember this episode.

Welcome

To simply answer the question...No, their should not be a law against them.
-
You may be right, but.... AFAIK only VT and maybe AK allow concealed carry without a permit. Again I admit I haven't thoroughly read the GOAs statement or the bill, but not sure I see the same urgency that they do.
-
I haven't read the whole thing in detail, but I believe their point is. You have to have a permit to carry in a National Park. There is land now, that is not part of a National Park, where in some places you may not need a permit to carry. But the NPS is trying to get that land making it part of the National Park and therefore restricting those that could have carried without a permit before on that land. Is that about it?

That's what I'm talking about. I mean how do you know he wasn't moving his coat back to get his wallet or something? ...and you can't go around shooting anyone that chooses to OC just because you saw their gun. Now...as with many situations we discuss, there are hundreds of variables we can't always get into. So...I'm not saying that there would never be a situation in which it would be reasonable to fear for you life if someone showed a weapon...I just meant in general.

Yep, want something with distance. We used Wasp/Hornet spray when I read gas meters. -
Wasn't able to make it to the FONRA meeting tonight, but was a date, time and location discussed? Some of the others get togethers in the past have been and Eat and Shoot. If we were to go that route I would suggest Shoney's for the eat. Two reasons, they don't serve alcohol and they are at the front door of the Great Outdoor Store. See range page here Not sure on how many guest a member can have or if all would have to pay non-member rates, but not aware of any other indoor ranges in the area. If that was acceptable to all, maybe a member there could contact them for details about a group of us coming to the range. But...I'm all for just meeting up with some whether it is just shooting or just eating or any combination there of....lol

Thanks for understanding. You are a better man than I to have gone on live radio to answer such questions. I usually do a lot of looking up before answering a question on here and still have to correct myself sometimes.

No, it means that 39-17-1305 would be amended to allow carry where alcohol is served for onsite consumption, as long as the HCP holder is not consuming alcohol. Also it says that if you are convicted of violating 39-17-1305 AS AMENDED (consuming alcohol in a place that serves alcohol for onsite consumption) you could have your HCP revoked. You have to look at the whole bill. Yes one part says you could have your HCP revoked for a violation of 39-17-1305, but it also changes 39-17-1305 to allow carry as long as you are not consuming.
