  1. Hmmmm... Well there is another Federal Court Ruling out of NM that said OCing was not enough probable cause to detain someone. Now that is because OC without a permit is legal in NM. So I guess one thing to keep in mind is most of the time these are state casses that have reached the federal level and any decision is based on the state law...which of course is different from state to state. But regardless the statement from this judge is just dumb...

  3. They say the info on the status page is supposed to be accurate to within 1 hour, but I figure we'll hear about it by some means when whatever happens happens....
  4. I'm sure Mike will post in a little, but maybe it is the new 39-17-1359, I was just curious since he didn't give any specific reason. I was wondering if maybe he looked at the introduced bill (which is horrible) and not what actually passed. I'm not 100% happy either...but we have already debated it so not going to go into all the reasons again...but overall I don't think it's the worst thing.

  6. There's only a short amount of time left in this session...I imagine the Speaker Pro Temp and/or the Deputy Speaker can handle the rest of it if need be. Then they will have another election for speak next session...and I've wondered what kind of chance he had again anyway....

  9. No the bill would go back to the floor of each chamber. I think his point was just to let us know there will still be people on the hill next week and that this week isn't the end of the session.
  10. He only has till the 18th right? So as long as both chambers have at least one legislative day after Tue we might just make it....right?
  11. That is about the size of it. ...and I'd say 99% of us on TGO would see you being armed as being prepared. But.....some others may see the act of making it known you are armed OC, Shotgun in the hand etc... as provocation and that it was the BG that was first in fear. Now I wouldn't see that way...and I hope that at least 1 out of 12 in TN wouldn't see it that way either, but that is the reason some say you shouldn't even confront robbers/burglars/thieves while armed.
  12. I think you're right. A funny side note is....we may have China to thank for Restaurant carry in TN. Since otherwise I'm sure Phil would wait till the absolute last day and hope the legislature had adjourned.....
  13. See below. Not aimed at anyone...we have all done it... But that is one problem that has occurred before....many times amendments are introduced that completely rewrite the original bill, but when the bill is discussed most don't go past the original bill on the state's website. Of course you also have to check to see if the amendments have passed to know if the apply....
  14. Legislative sessions..... Maybe someone who know a bit more than me can confirm this. Isn't each session of the legislature 90 days? The Senate is showing this Thursday as their 87th legislative day. The House's website not laid out exactly the same...so not sure about them, but would guess it is roughly the same. So if this is correct, there should be at least one more week left and enough time to override the veto.
  15. +1 .....just as long as they don't close the session this week. As of this moment there is nothing on the House or Senate's schedules after Thursday of this week. One reason that makes me wonder if that is why he is waiting till then instead of doing it today.

  17. Anytime I have e-mailed him about a bill I didn't recieve anything back until well after it was decided one way or the other.

  19. I don't think so... Seems what we have is... 39-14-405. Criminal trespass 39-14-406 Aggravated criminal trespass It seems the aggravated has more to do with causing fear and not necessarly having a firearm or weapon. http://www.michie.com/tennessee
  20. Just to be clear, it is SB3012 that has the three issues in it, not the current law. But very good clarification on what make a law void for vagueness
  21. I do think the current 39-17-1359 is vague and a lawsuit may have a good chance. Hower as pointed out SB3012, that is on the governor's desk, does give guidence to substantiallysimilar in that it must include 3 certain things. Also this bill does allow the international symbol alone to be a legal posting. So if SB3012 becomes law I think a suit woud be a bit harder to win.
  22. Nope...not rich at all. If I talk to an attorney and he says it could run that much I will not hire him. I mean it would be ridiculous to pay over $1000 to get out of a $500 fine. IMO this is only about a half-a-notch above a traffic ticket and in all honesty could be handled by yourself, but if you feel the need for an attorney there is no reason to get a Johnny Cochran wannabe.
  23. If I couldn't take care of the situation at the time and actually ended up charged with a violation of 39-17-1359 I never meant to imply I would just rollover and pay the fine. I just meant that if after the best efforts of me and/or my attorney I was still found guilty, I would pay the fine and not loose a lot of sleep over the ordeal.
  24. Can't argue with any of that. As you said...no need to debate his actions, but...it was several high profile incidents and not a single, non-press worthy event that got him to where he is.
  25. That would be going against the trend.... Last couple of years have been much better for us, even if we haven't got all we were looking for. Even under Nafieh I don't think any restrictions really got tougher. If you could find it..I would like to see if any state does have a law that prevents the issuance of a carry permit if got carrying where posted. Like others have posted, in many other states a posted sign doesn't have any legal consequences at all. Shoot as of now...you can not have a HCP, get convicted of illegal possession of a handgun and later still get your HCP in TN. Hard to believe they would ever be harder on "illegal carry" for those with a HCP. I mean look at this bill even...be armed and drunk in a place that serves alcohol is only a 3 year suspension...not even a revocation. Which means you don't have to go through the whole process to get it back...just pay the reinstatement fee. In 5-10 years I'm hoping 39-17-1359 is repealed or at least the fine lowered.
