  1. Yes, TN honors all other states permits, even those issued to those under 21. But as has been said, the law also says if you become a resident of TN you must get a TN permit within 6 months 39-17-1351®(3)( It would seem it is clear their intent is to require TN residents to have a TN permit to be able to carry. Some LEOs might not have a problem others may, I think it is defiantly questionable enough that it could cause trouble. However, if you want to get a permit I would say go for it, it would allow you to carry in other states for sure. Just check, there are a few states (4 I think) that do not honor non-resident permits.

HB3125 w/ amendment does the same as HB2694 (repeal 39-17-1305) plus requires exact wording for a 39-17-1359 sign and removes old code requiring sings in places that serve alcohol that are out dated. So HB3125 is a better bill, but HB2694 doesn't have a fiscal note (although HB3125 doesn't either w/ amendment) so it shouldn't have to go to the budget committee and therefore might have a better chance of passing.

  11. HB3125 by was taken upon in the House Finance Ways and Means committee. It is one of the "evenly divided" House committees as established by Speaker Williams. Calls were made to all known favorable Representatives including Speaker Williams who has the right to vote on the bill to appear and vote the bill to the full committee. The bill, as amended, has no fiscal note impact. An announcement was made by Rep. Steve McDaniel that Rep. Todd, the sponsor, had requested the bill to be rolled two (2) weeks. This move is one of significant concern given the expected course of this legislation.

  16. On HB3125 it appears there is no fiscal note with new amendment, see here. Hopefully it only has to go before the sub-committee, because of the fiscal note on the orginal bill. Have to admit I'm not 100% sure, but if debate on the bill is limited to the budegtary impact (of which there is none with the amendment) there shouldn't be any problem....but....

Firearms and Ammunition - As introduced, prohibits employers from prohibiting employees possessing a handgun carry permit from transporting and storing a firearm out of sight in a locked vehicle on any property set aside for vehicles; prohibits employer from terminating, demoting, or other discrimination against such employees. - Amends TCA Title 39, Chapter 17, Part 13 42. HB3240 by *McCord. (*SB2391 by *Jackson, *Gresham, *Faulk, *Black, *Bunch, *Tracy, *Yager.) HB2881 by *Rich, *Harrison, *Dennis, *Matlock. (*SB2528 by *Faulk, *Jackson, *Ketron.) Handgun Permits - As introduced, authorizes department of safety to make available to public through an electronically searchable database whether person has an unrevoked handgun carry permit based upon information provided by requester; authorizes sale of permit holder addresses in bulk; and makes all other handgun carry permit information confidential. - Amends TCA Title 10, Chapter 7, Part 5 and Title 39, Chapter 17, Part 13
  18. True, never meant to imply that no one has ever been charged. There is a database that shows how many HCP are revoked, but I don't think it gives any specific reasons. True again, but I still feel the LEO is more apt to tell you to leave than charge, especially if there is any question on if the sign is valid. Now if HB31255 passes and there is no doubt what a proper sign is and a place post such a proper sign, I doubt I would carry past it.

But your not supposed to have to search Hi and Low for a sign....there are supposed to be posted in a way that it is "plainly visible" But as OS said....we have yet to here of person charged with such a violation. Maybe another reason is because a violation is a misdemeanor. Unless a misdemeanor occurs in an officers presence, there isn't much he can do about it. So it would be up to the property owner to pursue the legal case, assuming you were back outside and even decided to hang around until LE arrived. I imagine most property owner's just want you and/or your gun out of their place and don't want to take a day off to go to court.
  20. I guess I always thought the "incident to" meant while the event was occurring or at least only immediately before or after. Sort of like a search incident to an arrest...the arrest has occurred then there is a search. The officer can't search you (without PC or a warrant) because he is going to arrest you at a later point. In other words, you couldn't put a loaded rifle in your truck in the morning and keep it there all day because you were going to go hunting later in the afternoon. Now if you were at one hunting site and then going to another...then maybe, but I could see a LEO say you are no longer hunting if you are in the vehicle. Also I never had thought it to mean you could have a firearm with you while your fishing, but that you could have a knife with a blade longer than 4" for scaling, cleaning, etc... the fish or otherwise illegal items needed for fishing. As far as age goes, I can't find anything in TCA that address long guns and juveniles. On Handguns, it is generally illegal for a juvenile to poses a handgun. There are 8 defense listed in 39-17-1319(d)(1)

  22. IMO No, as again, IMO they do not meet the requirements of 39-17-1359. If HB3125 passes, then there is no doubt those type signs would not meet 39-17-1359 as that bill requires "exact" wording to be valid.

I believe if you were to check 99.9% of the places that have signs like that aren't trying to prevent carry, but are trying to prevent loaded firearms from being given to someone during a pawn or service transaction. If I were behind the counter of a pawn shop or gun shop, I wouldn't want someone hadning me a loaded weapon to keep or work on.
