  1. Just wanted to give a big thumbs up and thank to Lowbud!! He upgraded the HD in my Tivo several days ago (sorry about being slow posting) and also my computer. Went smooth and now I have more programs in the Tivo Suggestions than I'll ever watch...lol But at least there is pretty much always something on. Thanks again!!

  3. Not sure what will be before the committee today, but on what was before the sub-committee last week...(See post 63) The penalty for violating 39-17-1359 was still a $500 fine only, no change. The penalty for being in a place open to the public that serves alcohol while consuming was the same as the current 39-17-1321 since it was a violation of the above was added as new sub section of 39-17-1321. A class A misdemeanor. From the debate on the bill, sounded like the wanted a stronger penalty for being in a place open to the public that serves alcohol while consuming. Right now, conviction of a Class A misdemeanor, suspends you HCP for the duration of any sentence, but you can get it backed. To me it sounded like they wanted to revoke you HCP for being in a place open to the public that serves alcohol while consuming. Now whether they did that by making it a felony or just adding revocation as part of the TCA is unknown.

  5. The real funny thing is, this thread was revived because of off-topic Open Carry post made in another thread......now this thread is getting way off topic. Guess OC threads just get derailed no matter what is being discussed in them.
  6. Sounds like another case of the DOS worker not knowing the law or proper procedure. The receipt is only good with the physical HCP. Of course they take old DLs and punch holes in them, but that is because they are giving you a new one....
  7. Ummmm...the doors are somewhat closed, you can't post until you register. You can't even look around after 10 post views without joining. You could consider registering as knocking on the door. Once let in you are free to do as you see fit, within the rules, if you don't then you could be warned (posted/PM warning or infraction) asked to leave for a little and come back (temp ban) shown the door and told to never come back (permanent ban)
  8. I think it was actually the whole list of criteria that a place had to meet to be considered a restaurant that judge though an average person couldn't know if a place met all those criteria. The way it works...if a law is determined to be vague...then it is unconstitutional. They originally had other arguments when they first filed the lawsuit, it was only afterwards that someone came up with the vague idea....and it did work for them.......and maybe for us soon enough...
  9. How can you tell from his post how early he renewed? He only stated how long it took, when it arrived and when he applied, but not when his expiration date was.
  10. No doubt Hardaway and some others will make long speeches and last minute amendment proposals to delay, confuse and frustrate things. But thankfully when/if passes and if the Governor vetoes it, it only takes a simple majority to override the veto in the TN legislature.
  11. Thankfully when/if HB3125 passes, the requirment for those ABC signs will be removed from the TCA.
  12. I wouldn't be surprised to see/hear him pi$$ and moan some more, but don't see where they would have any grounds to challenge this one. This bill would completely repeal 39-17-1305...nothing very vague about that. Nothing vague about the words that have to be on a 39-17-1359 sign or where they have to be posted. Also nothing vague about that you can't be consuming while inside a place that serves alcohol. All IMO of course which I admit doesn't legally mean jack squat.

  14. As OS said probably no state allows OC everywhere and anywhere. But if you meant how many states allow OC in general, just like TN requires a permit for.....In 28 states OC is permitted without a permit. Gold Star = Generally preempted open carry permitted on foot and in vehicles without a license; localities generally preempted. Open Carry Friendly = Open carry permitted by state law without a license, but either lacks preemption or does not allow unlicensed open carry in a vehicle. So nearly 1/4 of the states allow OC without a permit and preempt local governments for preventing it, but over half allow for OC without a permit per state law.   18. I don't think anyone is saying that a person who commits a crime shouldn't be punished. The question is, how long should that punishment last?

  21. Just because an item is prohibited somewhere by policy doesn't mean it is against the law to possess it there or make it a weapon. The sign in 39-17-1359 has always allowed for the use of weapons instead of just handguns. I think if have to go somewhere that has a new and proper 39-17-1359 sign, I will not take my handgun in, but I will keep my pocket knife and multi-tool. When if I am ever charged with it....I'll come back and let everyone know. After I make bail that is....
  22. True, all the more reason to have tried and make it clear though. Shouldn't even have to risk a felony just to into the office and pick up a paper or something.

  24. Nor do they have to. There is a specific defense in 39-17-1310 that allows for reaming armed while picking up and dropping off of students. The situation that needs to be addressed is going to the school and leaving the car to attend to something inside the school.
  25. I'm not really sure.... In the text of the amendment it says that a violation of 39-17-1359 is the $500 fine only. I think they were trying to come up with a sign that would give your warning of the penalty for violation of 39-17-1359 anda violation of what would be the new 39-17-1321 by being in place that serves alcohol and consuming. Long story short...there is obvisouly some more stuff to work out. I'm sure what I posted is not the final version of what will be in front of the committee next week.
