It was in the Criminal Practices and Procedures sub-committee. So all the ones that have made it out of there have gone futher than they ever have at least. -

Well yes and no. There are actually two bills, one in the House and one in the Senate. They are paired together. The house bill that passed today will go to the Calendar committee where they will choose a date to place it on the agenda for the full house for a vote. If (I mean when...) it passes there, there will probably be action on the senate bill. The senate is smaller than the house and bills move much more quickly. But after the senate bill passes it would go to the Governor for his signature. Most bills become law on July 1...only a very few go into effect immediately Here is a more detailed explanation. -
If they would have just drawn the gun and shot him there is nothing he could have done about it. If they would have pulled it and forced him to drive somewhere...still not sure how much he could have done depending on where he carries and the fact there were two that were behind him...from that point forward it would just depend on the situation. I really don't mean for this to sound as bad as it might...but letting them get in the car to help them leave the scene of an accident was not a very smart thing to do. But the story does help to serve as a reminder to always be on guard, even when being a good samaritan.

I still haven't seen the text of the amendment on the state's website, so I am a little confused. Would the amendment allow carry in local parks by default and local goverment would have to vote and/or post against it or does it leave it against the law by default and local goverments would have to vote and/or post to allow it? That is my take as well. Although loaded mags is sort of the reason for the bill...because in TN a loaded mag in the vicinty of the gun means the gun is considered loaded.....and actually...even if this bill passes that will still be the case...so if you dont' have a HCP it won't help you any in that regard. -

Well with HB0046 passing out of the commitee, this could all be moot soon. Since apparently the bill even removes the make, model and caliaber of the gun used for the class. So the state will no longer have a record of what type of gun you used in the class. -
I personally don't like carry being prohibited in local parks either. But it is against the law now (despite razorback and mine opinion). The bill was not going to pass with the state lifiting the ban on local park carry, it didn't even have the support of the sponsor on that issue. At least this way, if I understand it correctly (still have seen the wording of the amendment) carry will be allowed by state law in local parks, but local goverments can prohibit and to do so they MUST post signs. Larger cities may post signs if they feel the need to prohibit carry, but many smaller cities may not see it worth the effort. Also...if City X does ban carry in Park A...you only have to try and change the mind of the few people on your city council to allow carry instead of the entire state legislature. Again...it's not perfect, but I think it's better then no carry at all across the board.

What they passed was just supporting the two bills.... Also as waynesan said, the bill as amended specifially allows cities and counties to decided what parks are off limits. So neither what the did do, or what they may do (if the bill passes) has anything to do with the state preemption in 39-17-1314

I believe he step outside to talk to them. If they are investigating a noise complaint, they do not need to come in to the house to check that.

It may help LE (and you) to hear your side of the but they don't have to. AFAIK you don't have to say anything that might incriminate you, like "Yes, I was playing the XBOX loud." and at the same time, you don't want to lie...so....you are sort of left with silence if that is the route you choose to go. May not be the best choice...but it is one.<O:p</O:p <O:p</O:p Also in TN a LEO must witness a misdemeanor to make an arrest, and in this case since it was still loud..the LEO did witness it, but had the noise already stopped he couldn't have arrested him based solely on the neighbor's complaint.<O:p</O:p
