Well not the easiest way to do it, but can right click on the page (below the red line) then choose "Properties" under Address it will give you a long link directly to that page. That is correct, but also each store at a mall is also it's own business. So if the entrance to the mall from JC Penny was posted, it would still be illegal to carry in the mall (assuming other entrances are posted) even though it may be legal to carry in JC Penny itself.

Yes, it would be nice to see first hand coverage of this. It appears the DA would agree with your opinion that he wasn't thinking right, it seems voluntary manslaughter takes that into account. Which I admit I'm a bit surprised about... You make a decent argument about still being a threat, I think it would be stronger had he not chased him, but it may work anyway. -

You're right in that he didn't have to strike the guy and/or escalate it. I think ArmaDeFuego's point may have been that some think the guy that has been charged is the one that chased the other guy down to continue whatever may have happened on the road. So one could make the argument the deceased is the one that kept the confrontation going by following this guy. I agree with others had he lived, he also would have been charged with something. ponpoi -

That is my understanding of things...they guy charged is the one that had a "legitimate" reason to be in the parking lot. My thoughts as well. Guess I really didn't know that even if you had "adequate provocation to act in an irrational manner" it could still be such a serious charge. Again I imagine you are right. 39-13-103. Reckless endangerment. (a) A person commits an offense who recklessly engages in conduct that places or may place another person in imminent danger of death or serious bodily injury. ( Reckless endangerment is a Class A misdemeanor; however, reckless endangerment committed with a deadly weapon is a Class E felony. -

Just for the record.... 39-13-211. Voluntary manslaughter. (a) Voluntary manslaughter is the intentional or knowing killing of another in a state of passion produced by adequate provocation sufficient to lead a reasonable person to act in an irrational manner. ( Voluntary manslaughter is a Class C felony. According to 40-35-111((3) a Class C Felony carries a sentence of 3-15 years and a fine up $10,000. -
39-17-1311((1)(J)(iii) makes an exception for gun and knife shows when approved when approved by the adiministrator of the property. So the allowing of a gun show doesn't automatically mean carry is allowed by those with a HCP at other times.

"Gun Buster" signs are under 39-17-1359, Parks are to be posted per 39-17-1311. 39-17-1311 specificaly excepts parks from it and says they are controlled under 39-17-1311.

All I can really say is be aware, be prepared and resolve yourself to the fact that if a BG forces a situation, that you want to be the one going home. On the mental side of being aware and prepared, I tend to do like when I'm riding the bike (or could be like when you play baseball) evaluate your surondings and think about "if this happens, I should do this....."

Posting for parks is covered under a different law (39-17-1311) than posting for other places (39-17-1359) The trouble is, parks are still illegal in general, it is just an exception if you have a HCP. His opinion is based on a conviction of a person at a school even though the school didn't have the signs required by the law that makes school off-limits. The wild thing is...the park law 39-17-1311 actually still requires ALL parks to post, even if they haven't opted out...but they can opt out of having to post, unless they opted out on allowing carry, then the must post, but apparently you can be charged even if there aren't signs....... So I still stand by that 39-17-1311 just needs to be repealed like 39-17-1305 ....and YES, we need a new AG

When it comes to parks, the law 39-17-1311 says the must post. However the AG has issued an opinion that someone could be charged even if signs aren't posted.

It is whoever controls the park, not necessarily where it is located. In some cases it could be more than one local government.

I'm not a hunter, so I appoligize if this is a stupid question...... but if they are no longer considered game, but a nuisance animal, do they need a season or aren't they just shoot on sight? (As long you are in a location where it is legal....) -
This is one time I disagree.... If these places are putting the old signs up because an ABC inspector is telling them too...it needs to be reported to the ABC. According to the ABC person my State Reps office talked to, inspectore are NOT supposed to be requring places to post these old signs, or threaten them with a violation if they don't put them back up. I didn't have all my facts together about when and where they were still being required to post them and when I did check found they had already been taken down...so sort of gone as far as I think I can with that...(used up all my credit) Now of course if the place is posting these to satisfy some without actually prohbiting carry (something I've never fully bought into) then I guess that is different....

Could it be that it was because he was with a TWRA officer and a Park Ranger? From what I can find those type of people do hunt and trap the hogs, but I couldn't find anything where the average citizen could hunt them.
