When I have ordered from Gunbroker, CDNN, Summit, I pay them first including shipping. They ship to my dealer pre-paid. My dealer runs paper on me and delivers the gun, I pay the $10 Tics fee and his processing fee and that is it. Some say they are supposed to collect sales tax but I didn't buy the gun from him, he in only performing a service.

You pay the original dealer for the gun...then you give them the name of the place you want them to transfer to (be sure to call the local shop and let them know its coming) ...the two shops exchange FFL info, your local shop performs the background check on you, you pay them their transfer/background check fee (if any)

you enjoy your new gun. :)

You shouldnt need to pay the local dealer anything but the transfer fee, and BC...

as far as taxes, I think you need to do a separate form to the IRS, but I am not positive on that....

I think the way the law is written, we are "legally" supposed to pay state taxes on items we purchase out of state. It seems like that was what they were charging people with, avoiding paying that tax, when they were busting them for going to KY to buy cigarettes after the TN Legislature taxed the #$%@ out of them.

That being said, I have bought guns from Buds and had them shipped to several FFL's and was not charged sales tax at the time I picked them up. Maybe it's just special taxes and not sales taxes? :)

Yeah, you're supposed to pay it, BUT the dealer (the one that receives the transfer) can't legally collect it. You're expected to individually fill out the paper work and cut a check to the state.

It would be illegal for them to attempt to collect state sales tax on a transfer.

Of course, you'll be independently reporting your purchase to the state and cutting them a check to cover the tax.;)

actually we've had this discussion here before. You are supposed to voluntarily pay sales tax on anything purchased out of state where sales tax cant be "collected" from an in state retailer... but in most cases they dont know about the item, it cant be registered, so therefor it isnt inforcable. Guns are trackable nad traceable.... kinda like cars and atv's.

So...You are supposed to "collect" the sales tax if its a new gun coming from a wholesale gun distributor. Example CDNN... If the buyer doesnt want to pay the sales tax then we have to give him a special form from the Dept. of Revenue where they will volunteerly pay the sales tax to the state. If he doesnt, and we get audited... then its on him.

Now some people say "Whats the difference in me getting my new gun from a wholesale distributor like CDNN or my used gun from Ma and Pa's old gunshop in anywhere Texas???

The difference is, as an Retail FFL holder, Im getting invoiced for the purchase at the gun distributor level... they report everything that is invoiced and shipped to me to the State of Tn Dept. of Revenue. The transaction between you and Ma and Pa's old gunshop isnt set up and reported that way. So, in the mind of the Dept of Revenue, the gun from Ma and Pa's old gunshop isnt reported to them... therefor the transaction doenst exist in this state.

So its simple... I do transfers for $30+ $10 TICS. If its a new gun from a Distributor... then I will attempt to collect the tax, if the customer decides they want to pay it themselves... then I give them the form. If its coming from Ma and Pa's old gunshop its none of anyones buisness. IMHO!
