Gallatin Parks NOT TO OPT OUT!

Dear Ron,

I attended the Gallatin City Council's working session last night (3rd time) and briefly spoke during public comments.

As you know, the State statute will permit HCP Holders to carry in ALL PARKS (State, County, City & Federal has already passed this) effective September 1st, 2009 UNLESS a County or City governing body affirmatively votes to "opt out" of the statute; i.e. NO ACTION would mean the state law takes effect.

Last night, the Council DID take action on the matter, they voted Unanimously to NOT OPT OUT; thus effective September 1st, HCP Holders will be allowed to carry in parks, WITH THE UNDERSTANDING that, as per the July 14th, 2009 Tennessee Attorney General's opinion, that HCP Carry Holder's remain PROHIBITED from carrying in any park where School (Private/Public) "activities" are taking place.

Since HCP Holders will have NO WAY OF KNOWING when School Activities, games, field trips, etc. are occurring the HCP Holder is subject to "conflicting criminal statutes," and must be aware of this. Last night all HCP Holders informally acknowledged this proviso.

Personal advice (nothing formal or legal), refrain from carry in the "ball parks" or sport recreational sites (including Civic Center, golf course; etc.); should one choose to carry, AT MINIMUM, ALWAYS CARRY "COMPLETELY" CONCEALED (as one should at all times, anyway, except when hunting!) and do not display in any manner.

These "conflicting criminal statutes" MUST be resolved in January when the Tennessee General Assembly reconvene because one can assume that virtually ALL State, County, City & Federal parks routinely serve to host organized sports and activities for schools throughout the state and present the same inherent jeopardy to HCP Holders. Accordingly, HCP Holders will need to seek "relief" from this erroneous and unintentional conflict ASAP via their State Representatives/Senators.

I am proud to see that Gallatin's City Council voted unanimously to NOT opt out, thus maintaining the operationally mandatory State-wide uniformity by letting the statute become effective September 1st. Unfortunately, many City Council's foolishly (my opinion) voted to opt-out and thereby have created a "piecemeal-hodgepodge" of areas where Tennessee HCP Holders (including the 34 states we have legal reciprocity/mutual recognition with) must be aware of; a complete nightmare as "experienced" and later preempted state-wide in many other states

Hopefully, are Legislators will:

  • <LI style="TEXT-ALIGN: justify; MARGIN: 0in 0in 0pt; mso-list: l0 level1 lfo1; tab-stops: list .5in" class=MsoNormal>Add HCP Holders to the list of people exempted from the firearms prohibition at school activities
  • Preempt County/City prohibitions against carry in parks thereby making it uniform state-wide like in most states.
