Giving a handgun as a gift

Hi

Just wonder if somebody could tell me if I have to go through a FFL if I give my brother a handgun as a gift in person while he is visiting here in TN. He is from out of state and just wonder what needs to be done legally, both in his state, AZ, and here. He has a CCW Permit from there.

Hi James....Your brother is not a TN resident, which means that the gun will need to go to an FFL in his state....You can give a gun as a gift with no FFL if you are both residence of the same state.

now, you need to follow the law...because ATF lives across the street and is watching...:)

Just wondering still though if I give him the gun while he is here, though can he bring it back with him and then go to a FFL there and transfer it? I have no problem doing things legally and correctly, like alot seem to, I just want to know exactly what to do.

The act of giving it to him is ipso facto a transfer. If you do that and he goes home and forgets to get it transferred via ffl, what's going to happen? He'll be in real trouble when they figure out he hasn't registered his gun with the state.

To be legal, you must ship the gun to his FFL...

and all of the checkpoints between state lines will know. :)

You have three sets of laws that you are responsible for, Federal, <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" /><st1:State><ST1:pTennessee</st1:State> and <st1:State><ST1:pArizona</st1:State>.

The easiest way for you to make sure you are legal is to have him contact an FFL in his area, and follow that FFL’s instructions on how to proceed. He may let you ship it to him or he may tell you to have an FFL here ship it to him.
