  1. Note that you can't be "under the influence of alcohol or any controlled substance" while packing at any time or location per 39-17-1321.
  2. Some states allow you to drink while packing up to the legal driving limit. So far, they don't have blood in the bars from the massive numbers of gunfights as far as I know. But that's another matter. Probably wouldn't fly in Bible Belt Tennessee.
  3. Very true. Thoreau's actions are a clear example. On Civil Disobedience is one of my favorite reads. Certainly your privilege. But others see preservation of self and family as a higher value than obeying the law.
  4. I did a search on TCA and found no definition for "open to the public." I think it therefore means that you can just walk in from the street without passing "Go" or collecting $200.
  5. Seems to me this is a poorly written piece of legislation. I think the idea was to keep packers from drinking but this is already inherent in another part of the code: 39-17-1321. Possession of handgun while under influence - Penalty. - (a) Notwithstanding whether a person has a permit issued pursuant to § 39-17-1315 or § 39-17-1351, it is an offense for a person to possess a handgun while under the influence of alcohol or any controlled substance. In all, maybe this gives us an opening to get the law changed since it is unclear if you can pack in a hotel or mall that has a drinking area. I don't think most hotels and malls will want to chase off all the gun carriers. All that really needs to be done is to repeal 39-17-1305. 39-17-1321 prevents you from legally packing and drinking. The problem is not having a gun around alcoholic beverages. The problem is having a gun while you have alcohol in you.

Possession of firearm where alcoholic beverages are served. — (a) It is an offense for a person to possess a firearm within the confines of a building open to the public where liquor, wine or other alcoholic beverages, as defined in § 57-3-101(a)(1)(A), or beer, as defined in § 57-6-102(1), are served for on premises consumption. Does this mean you may not pack, with a permit, in a hotel if it has a bar under the same roof? Seems to me this is within the confines of the same building. How about a mall that has a restaurant that serves alcohol?

    Lots of folks in the Memphis area will do a transfer for $20-25 + NICS. Looking over the list at GunBroker, I find people charging $10-50 and some adding percentages and use (sales tax) fees. Obviously some people want your transfer business and some will grudgingly do it if you insist. Go to http://www.gunbroker.com/User/DealerNetwork.asp and put in your zip code. http://listings.shotgunnews.com/fflguide/ also has a list but some of the info looks out of date.

    I used to travel to Clarksville a lot. The Chamber of Commerce there put out a note saying that if you didn't like the weather right now wait 15 minutes and it would change. That's about the truth.

    Welcome to the loonie-bin (but you've figured out where you are by now) I was born in the only county in northeast Tennessee that voted for secession (Sullivan) to Georgia parents. ALL of my ancestors fought for the Confederacy and I'm proud of that. But I did finally find one distant cousin in Nashville who served as a Union surgeon on Thomas' staff at Chicamauga. He returned home victorious and went bankrupt because the local people would have nothing to do with him since he supported the yankee (small "y") cause. But these days I have a lot of Yankee friends. I even will talk to people from DC. Jack Kennedy once described Washington as a town of northern charm and southern efficiency. I've found that to be true.

    Actually, the tax people are supposed to pay on items bought out of state are use taxes. http://www.state.tn.us/revenue/faqs/salesandusefaq.htm#su13 What is use tax? Use tax, at the same rates as sales tax, becomes due when the user and consumer of taxable merchandise does not pay tax to the supplier. Examples include purchases of tangible personal property for use from an out-of-state vendor who does not collect the tax, extractions from inventory purchased on a resale certificate for personal use and consumption. Generally, contractors become liable for a use tax on materials used in realty construction even when the contractee first purchases the materials on an exemption certificate. Use tax is due even on purchases made by citizens from another state which are not taxed by the seller. Are sales made on the Internet subject to sales or use tax? Yes. Even if a seller does not collect Tennessee sales tax from you, when you ask a dealer to deliver an item to you in Tennessee, you are responsible for paying use tax at the same rate as sales tax. But it is up to the user to pay those taxes and it is not incumbent upon the transfer agent to collect that tax for the state, as it is for sales tax. So...when you buy a gun, or other item for personal use in interstate commerce you are supposed to send the state the use tax in the same amount as the sales tax would have been. But meeting this obligation is between you and the state, not you and the transfer agent as much as the state would like to make it so. The Agent may collect the tax for you, but he is not required to do so. Just check before you use a transfer agent.

    Some dealers think doing transfers will bring them more business in the long run. Some see it as a way to make a little money without tying up any of their own funds. Some see it as a purchaser taking money out of their pocket because they didn't buy the gun from them. Lots of factors come into this. But back to the original question, http://www.gunbroker.com/User/DealerNetwork.asp and http://www.auctionarms.com/help/FFLNetwork.cfm will get you a list of people who want your transfer business. There are people listed in Memphis who will do the transfer for $20 or less, plus the $10 NICS. Be sure to ask if they collect the state sales tax. Some do. Some don't.
  13. You were doing fine up to this point. I can't see any reasons, obvious or otherwise to not carry in a restaurant if you aren't drinking. The fact that some drunk may ignore the law and be packing is a very good reason for sober people to have a gun too.
  14. Look like interesting guys. Anything that gives you some confidence, and ability, to handle a close-up situation is good. Sometimes it can end a fight without using a gun. Sometimes it gives you time to get to a gun, especially if someone is in your face.

It says "are served" not "are being served." Class A Misdemeanor 11 months 29 days $2,500 But note that the building must be "open to the public." Anyone have a definition? Can you pack at the VFW since you have to be a member or guest to go there?

    I tried a light on my G23 and had a holster that would accommodate it, but after using it a while decided for me the light needs to be in my left hand. I can see both sides of the issue. You need to do what works for you. My home has lights from one source or another that would sufficiently illuminate someone invading the sanctum. A light on the gun would be a hindrance to me. Just depends on your setup. I think my previous link made some good points.

  21. The Winchester Silvertip is a lighter but faster round. 60 gr, with a muzzle velocity of 970 ft./sec. out of an unspecified length barrel. Hydra-Shoks are 65 gr. and 925 ft./sec. from a 4" barrel. What their actual velocities will be out of a short barrel is just a guess. I didn't know about the spacer in the Seecamp magazine.

  23. I'm still a bit wary of the 32 Auto. I have a video of the aftermath of an execution killing using a 32 ACP. The first round, shot at the back right of the head at point-blank range did not penetrate the cranial vault. It took a shot to the right eye to do the deed. Bullet placement seems to be the key.
  24. Hey Phantom6, I'll trade you my Sterling 25 for your Seecamp. It's striker fired just like those wonderful Glocks.... Incidentally, I had a Tomcat for a while before trading it for a Kel-Tec P32, that was itself traded for a P3AT. Nice features on the Tomcat, but I agree with your wife that they are bulky. They are also a 32 Auto. BTW, I went in a local gun shop the other day that had both a Lorcin L-22 and L-25. Wanted $100 and $90 for them.
  25. In our area, we have had some problems with people trying, and sometimes succeeding, in pulling over motorists by impersonating officers. We had one rape not too long ago in Hawkins county that happened that way. Here is another incident. Debbie Morris, 47, was driving east on Sugar Hollow Road around 7:15 a.m. Thursday when she came up behind a black Ford Crown Victoria traveling at a slow pace. Morris passed the vehicle and as she pulled in front of it, the driver, Carl Joseph Robinson, 48, turned on flashing lights as if he were a police officer traveling in an unmarked car. Morris noticed the vehicle had Florida tags and no blue lights so she decided not to pull over for Robinson. Instead, Morris called 911 and dispatchers told her no officer from the area was trying to stop her and they were sending out the real police to investigate. But Robinson quickly disappeared. “He had a 800 megahertz scanner programmed with all the local police frequencies in the car,†said Washington County Sheriff’s Office Investigator William Gregg. “He heard them dispatch his vehicle information over the scanner and got scared so he drove away.†A short time later, a Jonesborough police officer spotted the car and stopped the vehicle. WCSO authorities arrived on scene and arrested Robinson after discovering the scanner, strobe lights, other police lights, a CB radio, an emergency equipment control box and a copy of police 10-codes inside his automobile. “It looked just like an unmarked police car, except it had no blue lights. His were all clear,†Gregg said. “He said he bought it at an auction in Florida. He bought the lights and the control panel and installed all that himself.†According to reports, Robinson, 119 Jasper Edwards Road, Jonesborough, had the vehicle painted black in February. “I think he had it painted because he had done this before when it was white and he knew we were looking for that vehicle,†Gregg said. “We notified Johnson City police because they had a couple reports a while back about a white car trying to stop people.†Authorities say fake police make it that much harder for real officers to do their job. “It makes people hesitate when any unmarked car tries to pull them over,†said Gregg, who commended Morris for her quick thinking Thursday. “If you have any doubt, you should call 911 and ask dispatchers.†Robinson allegedly admitted to police he tried to pull over Morris because he was mad she had passed him. He was charged with criminal impersonation of a police officer, light law violations, reckless endangerment and felony evading arrest. He was being held in the Washington County Detention Center on $7,000 bond and was scheduled to appear in Sessions Court today. Meanwhile, another man was arrested Thursday after he allegedly impersonated a police officer while passing a forged check this week. Johnson City police arrested Charles Robert Smith, 3406 W. Walnut St., on warrants charging him with forgery, theft under $500 and criminal impersonation. On Wednesday, Smith allegedly identified himself as a police officer to a clerk at Quick Stop Market, 1501 W. State of Franklin Road, where he then passed a forged check. Smith was being held in the WCDC on $3,000 bond and is scheduled to appear in Sessions Court Monday.
