Governor Phil Bredesen Vetoes HB0962 (Restaurant Carry Bill)
Fallguy replied to a topic in 2A Legislation and Politics
As has been said, there is not legal definition of a bar in TN or it's law. This bill does not have the curfew or age-restricted venue parts in it. But it only allow carry in what it defines as a restaurant. So if it is just a place on the side of road selling beer an no meal, then no, you could not carry in there. But there are some places that others might consider a bar, that as long as the meet the requirements laid out to be qualified as a restaurant you could carry in there. -

Well...just didn't think it would look good, any of us being arested for carrying of toy guns and those pictures in the paper. Would be hard to make the argument to be trusted with real handguns if we don't know how to even legally handle toy guns. Of course just having a toy gun in public is not illegal, so that is why I was saying be careful. -
Welcome

Just be careful with those toy guns.....lol 39-17-1362 Imitation firearm — Defined — Offense to display in threatening manner in public place. Don't need to give the media another reason to hate us.... -
My LEO brother once told me that just turning the door knob would be considred "forcible entry" because they had to use force to turn the knob. So I don't think the person has to "break in". But you are right in that if they have been invited in and then at a later point you want them to leave, it would be different. Because for one they did not unlawfully enter (the second part of the requirment).

What is Tenn. law on this scenario?
Fallguy replied to andersmg's topic in Handgun Carry and Self Defense
39-11-106(a)(34) “Serious bodily injury†means bodily injury that involves: (A) A substantial risk of death; ( Protracted unconsciousness; © Extreme physical pain; (D) Protracted or obvious disfigurement; or (E) Protracted loss or substantial impairment of a function of a bodily member, organ or mental faculty -

Well in TN it only takes a simple majority to override a veto. So really any bill that passes the legislature and makes it to the Governor's desk has enough votes to override if no one changes their vote. I'm hoping that since this bill passed very large margins in both chambers there will be still be enough to override his veto even if some change their vote. -
Park Bill on the House schedule for Today
Fallguy replied to Fallguy's topic in 2A Legislation and Politics
If/when the Federal Law allows carry in National Parks we will still be able to carry in National Parks in TN. There is no TN law against carry in National Parks. The National Park wording in this state bill was just to clarify that. -
The day after legal restaurant carry
Fallguy replied to Mousegun's topic in 2A Legislation and Politics
I understand....I just usually read all new post in a thread then make any responses. I understand what you are saying once you have found yourself in such a tactically bad situation. You had either be very fast and very sure of yourself if you try to disarm the person behind you or you'd better just do what he says. Also I agree OC can/will attract attention, but I think a drawn gun on you when you firearm is holstered and you aren't doing anything else is not justified. Be well..... -
Park Bill on the House schedule for Today
Fallguy replied to Fallguy's topic in 2A Legislation and Politics
My only real hope for the park bill is that it hasn't really received any media attention...well almost none compared to the restaurant carry bill. So there isn't quite the "public outcry" against it. But.....it's not a lot of hope.... -

From what I've seen the House Clerk has enough knowledge of procedure for everybody.... -
Yes he could, you are supposed to have it with you and be able to present it anytime you are armed. Whether he would or not...depends on several factors I guess.

But he wasn't acting as a LEO but in a security matter. Not sure if was even in uniform or not (can't remember seeing it one way or the other) and didn't identify himself as a off-duty LEO until well into the encounter. So...at first it is simply a stranger coming up behind you with a drawn gun. -

But what political cover do the legislators need? They have already voted and made their position known. I see no reason (as long as the rules allow it) for it be brought up on the house floor the first day they are scheduled and then sent to the senate as soon as possible. -
Phil Bredesen to (possibly) sit on carry bill.
Fallguy replied to Good_Steward's topic in 2A Legislation and Politics
That is correct...see this thread http://www.tngunowners.com/forums/tennessee-politics-legislation/21893-tennessean-saying-bredesen-will-veto-hb962.html -
Yeah...you could probably order one and get it...but it would be against the law...see above

I know. At anytime they choose actually, but usually late-in May, but since they haven't yet, won't be till sometime in June this year. I think it has all been part of the process to this point and still is... Yes I'm afraid will have to listen to the anti's again and this time they can say that LEOs and DAs are against it. I have thought of that an mentioned in the park bill. My hope is that since the park bill has not received as much media attention maybe it's not in the same jeopardy. ...and who knows...maybe he'll want to throw us a bone after this...lol -

That makes sense to me. On the news they said it could be overridden as soon as next week. Once both chambers vote to override, does it skip the Governor this time and go straight to the Secretary of States office? Also since all of this would be done after the effective date on the bill, would it be effective after both chambers override or not until it is assigned public charter number by the Secretary of State? My guess would be the later. -

Hex I understand being upset....but this really doesn't help. Oh...there is no fall session in the state legislator, when the adjourn this session they won't be back till next year. Also the bill can not be modified from what was sent to the Governor, the only vote will be to override or not.
