  1. Cowboy, Great meal, fair service, he was nice enough anyway...lol and although he doesn't know you (or me either for that matter), he owes you. Dave's 97% - 3% comes from that roughly 3% of TN residents have a Handgun Carry Permit and therefore the other 97% (LEOs and certain others excepted) can not legally carry a handgun of their property. I understand Dave's argument...if it was a true right, you would not need permission (permit) from the state to exercise it.

  3. LOL....ok I'm with ya cowboy. One last thing on table conversations...sounds like maybe it's your fellow workers that need the advice about engaging themselves in the conversation. On tips and disagreeing with a topic at hand...I agree that the tips shouldn't be based on opinion, but I think for most of us it would depend on whether the waiter was asked for his opinion or interjected it on his own. If he is asked and gives an honest answer and or respectfully declines to opine no harm no foul (IMO), but if he decided to just blurt out his disagreement with what is being dicussed...well that could be a different matter. Anyway...I do believe your intentions were good and just came across wrong as you are new to the board and we really don't know you well or you us. About to take the family out to eat shortly....may lay an extra tip on the wait staff in your honor.
  4. Hmmmm....IANAL either, but I thought it was just the opposite. Just like it is a defense to unlawful possession of a firearm if you are on your own property. I don't think everyone who owns a firearm risk arrest would have to prove they were on their property. But like the affirmative defense in 39-17-1310(4) you may would have to prove that you were picking up or dropping off kids.
  5. Guess that is the difference between accepting a pre-trial plea bargain from the DA and being convicted in court and sentenced by a judge.
  6. Well 99.9% of bill usually have an effective date of July 1 (some Jan 1), but the legislature can put any date they want to on a bill. The date can be different for different reasons. Like the park carry bill has and effective date of Sept 1 (if/when it passes) so that local governments can have enough time to pass ordnance against carry and post signs if they choose to. To be honest I'm not totally sure of why the June 1 date of restaurant carry other than we have waited so long....didn't want us to have to wait another month.
  7. That is not 100% accurate. They can still sue you. The law just says if it it ruled justified they judge can award you certain fees and monies for having to defend yourself against the suit.

  10. I have to agree...if in 1) you meant that those at the table shouldn't talk about such things....well that is just wrong. Me and my group can and will discuss any topics we so choose to at the table.
  11. Good deal... But you know after looking a bit closer at this bill, really all it does is prevent confiscation. It says that can still regulate and control the possession, storage, display, sale, transport and use of firearms, other dangerous weapons and ammunition. So they can still keep you from going out in public armed, stop gun and ammo sales and the like. ...and I'm not saying that is bad, just noting that although they aren't supposed to confiscate them from you, they still retain a lot of control over their display and use. But better than it was......

  14. Amendment 3 removed state WMAs because they are being addressed in another bill. Amendment 2 which makes the bill, does allow for carry in National Forrest.
  15. LOL...I have to say I'm a little torn. Part of me wants to say there was good info in the post another part feels like I've just been talked down to because I may not know how to handle myself in this "new" situation. 1) I don't generally discuss anything "controversial" (politics, religion, etc...) with strangers. 2) I agree people are not always courteous when in public, but many of us with HCP's aren't exactly new to carry and don't generally shuffle our weapon or take it out regardless of where we are. 3) I carry mainly to protect myself and my family. If I ever felt a third person needed to be defended.....I would be making sure I fully understood the situation before getting involved let alone using deadly force. Again....maybe new environment for carry, but not a totally new environment or situation either. 4) I agree a boss may fire you. But I would wager you have already served alcohol to an armed person many time before without knowing it. But I wouldn't be surprised if this doesn't happen less often, at least in the near future, with the new law. 5) Yep.....tip your servers!!

  17. It goes into effect July 1. See here or here Just a note about this law...it will not allow for the use of deadly force just to protect property. Before the used of deadly force in protect property was completely forbidden. With new parts of the self-defense law there are situations in which you might be using deadly force to protect property and life at the same time (car jacking for one). This removes the chance that and over zealous DA might have tried to charge you with using deadly force in protecting property in such a situation.

  20. Ummm...even if the current park carry bill in TN doesn't pass you would still be able to carry in a National Park in TN when/if the Federal law allows it. There is no state law in TN that prohibits carry in National Parks. The current parks bill in Nashville simply adds wording about National Parks to clarify it is legal.
  21. The DOI had already put the rule change into place, then the judge issued the injunction. So I can't say for sure, but I would think if the injunciton was lifted, then the rule change by the DOI would be back in effect.
